WHEREAS, the applicant was sent a Notice Of Intent To Deny License Application by
the City Attorney's Office, dated December 19, 2002, for failing to obtain the required Special
Condition Use Permit; and
WHEREAS, the applicant did not respond to the Notice of Intent To Deny License
Application, and the matter was then scheduled for the City Council on February 5, 2003; and
WHEREAS, on January 21, 2003 the applicant contacted the city requesting time to apply
far the Special Condition Use Permit. The matter was then withdrawn from City Council
consideration and the Office of License, Inspecrions and Environmental Protection sent a letter
on January 30, 2003 extending the deadline to apply for a Special Condition Use Permit to
February 13, 2003; and
WHEREAS, the applicant submitted an application for a Special Condition Use Permit,
but the application was insufficient. The applicant was notified in writing on February 18, 2003
that the application was insufficient andprovided with documentation on the deficiencies, but the
applicant failed to follow up with the required conective action; now, therefore be it

'I am writing as a follow up to your application for Conditional Use at 1423 Rice Street received
February 4, 2003.
After review, city staff finds insufficiency in the application. The application requires a fee value
of $500.00 which has not been received. Also the application is made without a modification
request of the 15,000 square foot condifion for the conditional use. (Section 6.544 (4), c). I
have enclosed section 60.544 paragraph (4) for your review as well as five other general
conditions that also have to be met for all Condifional Use Permits. (Sec.64.300 Sub. D Paz. 1-5}.
Therefore, we cannot proceed with the application. Pursuant to Minnesota Stahxte Chapter 248,
Article 18, concerning deadline for agency action, we cannot accept the application at this time.
This notice is in accordance with Subdivision 3 of this statute with allows the city ten (10)
business days to deteimine if tl�e application is sufficient to accept and conduct the required
action. `

Dear Mr Yang :
On August 29�', 2003, I sent you a letter explaining that you needed to apply to the
Planning Commission for a Conditional Use Permit for an auto repair operation at this
location. I sent the proper paperwork along with the orders to cease and desist all auto
repair activity until you received approval from the Planning Commission and were
issued a Auto Repair License from LIEP.
This license has since gone to the City Attorney's Office for Adverse Action against the
license. You still may make application to the Planning Commission for the Conditional
Use Permit. This application must be accepted by Planning Commission staff by
February 13 2003 or the adverse action to deny this license will continue
forward.

First off I want to say that sorry for not infortning the city as to the operaflons of YRP. As we
tried to obtain a permd for a repair garage at the location 1423 rice st. saint paul, Mn 55117 and found
out that R would be difficult to obtain one. I general manager of YRP Technology has seized and stop
the repair end of the business as of July of 2�02. The main objective of the operation is in aftertnarket
auto pertormance paRs and accessories ali new parts. Since July we have not opened the repair end
and shut it down just the retail parts end is stiil open. The remainder part or the building is used for
storage. Finding out that we cannot store vehicies at property, all vehicies have been remwed.
If obtaining special condition pertnit is too hard to get then the whole operation is shutting
down. if we were unable to instali the perfonnance parts onto our customers vehicie then that would be
at no advantage to us. So ifi use permit cannot be obtain then we are forced to ciose out our business.
Since November of 2001 I have obtain empioyment work as a store manager ai AutoZone inc.
and YRP has been on and off. t3o repairs or work is being done at the tocation. We are onty using it
as storage space at the present time. If pennd is too haRf to obtain lhan YRP witl shut down and close
out. I have not tried to open YRP for about a year now. If there is any other way to obtain pemiit than
YFtP may re open but as of now YRP is on4y used to store parts (new paAS)
Wiliing to cooperate in any way to obtain use permit if not to late to get one. if not properiy
zoned forthat kind of business then we can move to another location.
For 2003 YRP wouid like to instali the performance parts onto the customers vehicie as
requested. Very light auto repair will be handled at location. if this is proper please let me know and if it
is not then please let us know so.

Dear Mr. Xang:
The Office of License Inspections and Environmental Protection has recommended denial
of the above-referenced license application. The basis for the recommendation is as follows:
On August 12, 2002, the Office of LIEP advised you of a
number of items still needed to process your license
apptication, among them an approved Special Condition Use
Permit. Again on August 29, 2002 you were advised that the
location for your business required a Special Condition I3se
Permit (SCUP) and you were given until September 12, 2002
to apply to the Planning Commission for the SCUP. As of
today's date, no application has been made to the Planning
Commission and you do not have the necessary SCTJP to
permit you to operate an auto repair garage in the location
proposed. Saint Paul Legislative Code §310.Q6(b)(3) permits
denial of the license because the premises which are proposed
to be licensed do not comply with applicable zoning codes.
If you do not dispute the above facts, please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the Saini Paul City Council to
determine what penalty, if any, to impose. You wi11 have an opportunity to appear before the
Council and make a statement on your own behalf. The recommendation from the licensing
office is for the denial of your license application.

On the other hand, if you wish to dispute the above facts, you are entitled to an
evidentiary hearing before an administrative law judge. If you �vish to have such a hearing,
please send a letter stating that you are contesting the facts. You will then be sent a"I3otice of
Hearing" with the date, time and place for the hearing, the name of the administrative law judge,
and an explanation of the procedures.
Tn either case, please let me know in writing no later than Monday, December 30, 2002,
how you would like to proceed. If you have not contacted me by Monday, December 30,
2002, I will assume that you are not contesting the facts. I wili then schedute this mafter
for the St. Paul City Councii and have it glace on the Consent Agenda during which no
public discussion is allowed and the recommended penalty will be imposed.
