Dear Sir:
This is written in response to the petition of William H. Paul (Richard
C. Drake) to rezone from "A" to "C" Residence for the purpose of constructing
apartment buildings, on property located on the south side of York Avenue
between Birmingham and Hazelwood, and noted in detail by the legal description
on file.
This matter was heard at the September 2, 1971 Board of Zoning public hearing
at which time the staff report noted the frontage and area, area zoning,
the recommendation of the Comprehensive Plan and the site and area conditions.
The staff said that the area of the site would allow 172 dwelling units under
"C" Residential zoning. A petition in opposition to the rezoning was
acknowledged. The staff noted some of the factors relevant to the rezoning
decision. They included other "C" Residential districts in the area, the
topography of the site and of the general area and the condition of platted
streets in the area.
Mr. Terrance 0'Toole, who represented the petition, indicated the topography
justifies the rezoning saying the site would require extensive grading. He
explained the proposed development stating that it is a definite proposal and
that driveways and utilities would come from York Avenue. He said Birmingham
Street would soon be opened up providing access to East 7th Street.
Several residents of the area appeared in opposition. One stated that if
apartments are built, there will be cars parking on the street in front of his
home even if off-street parking was provided. He noted the unspoiled nature
of the land as it is and said it was not developed because the owner used to
live on the land himself before fire destroyed his home. Another noted that
homes in the area are all fairly new and said that their values would be
diminished if apartments are built nearby because people would then have trouble
selling their property.
In considering this matter, the Board noted the zoning of adjacent land, the
topographical character of this site and highway plans for this area. It was
argued that the presence of apartment buildings increases rather than decreases
property values and that there is a need for more housing to increase St. Paul's
population and tax base. Another argument pointed out that this proposal,

if successful, would urge other rezonings in the area.
Subsequently, the Board heard a motion to recommend approval. The seconding
motion noted that Birmingham Street would be built through to East 7th
Street. The motion carried by a vote of 5 to 0.

A. SUFFICIENCY: The Commissioner of Finance in a letter dated August 1�, 1971
declared the petition sufficient with the owners of 24 of a possible 28 (85.71%)

C. PROPOSED USE: The petition did not state any definite proposal. Multi-family
use is permitted under "C" Residence.
D. FRONTAGE AND AREA: The property under consideration has an irregular shape
with frontage along York Avenue, Birmingham Street and Stillwater Avenue. The
frontage along York Avenue is 462.5 feet; along Birmingham Street 178 feet;
and along Stillwater Avenue 625 feet. The area is approximately 172,749 square
