Patricia J. Jordan, Robert Shea. PROCEEDINGS : The "Memorandum of Appellant" was perused by each member of the board. Pictures of the third floor apartment and exterior of the home were also examined. ACTION: Motion by Tieso to waive Section 54.15 (3) of the St. Paul Legislative Code that no wood frame dwelling or multiple dwelling be occupied above the second floor for living or sleeping purposes except where the original construction provided for such type of occupancy. Such waiver is granted to permit continued occupancy of the third floor apartment and is granted on condition � that a proper exit from the third floor apartment to the exterior of the building be provided in accordance with the requirements of the St. Paul Building Code and that a fire escape from said exii: and continuous to grade level be provided in accordance with the requirements of the St. Paul Building Code, Seconded by Sommerdorf. � THE VOTE: Ayes : Tieso, Grove, Kamin, Peake, Sommerdorf, Voigt. St. Paul Legislative Code requires a 7' 6" minimum ceiling height. APPEARANCE5 : Fred Gieske. PROCEEDINGS : Mr. Gieske explained that a false ceiling had to be ' put in in order to cover certain plumbing pipes . To put the pipes into the existing ceiling would have weakened the ceiling joists. ACTION: Motion by Grove to waive Section 34 .01 (b) of the St. Paul Legislative Code which requires a clear ceiling height of 7' 6" . Such waiver is granted to permit a 7' 3" ceiling height. The request is to rebuild the garage as it exists . The adjoining neighbor has agreed to permit the rebuilding. ACTION : Mation by Voigt to waive Section 40 .00 (i) of the St. Paul Legislative Code that requires a garage to the rear of a residence to be no closer than two (2) feet to the side lot line. SUBJECT: HRA inspection reports of April 28, 1971 and August 4 , 1971 setting forth Housing and Building Code deficiencies at 414 Sherburne Averiue. APPEARA�vCES : James Whittier, Ken Gauthier. PROCEEDINGS : Mr. Whittier said the total income of he and his wife is $200 .00 per month of which $55.00 is paid for a house- keeper. Mr. Gauthier explained that the property will not be acquired. The amount of work to be done is over the $3,500 grant limit. I.P. APPEARAr10ES: Joseph Knoll. SYNOPSIS: The applicants are forty-nine (49) and forty-four (44) years old. They are owners of a duplex used as a single family dwelling unit at 604 Case Avenue in St. Paul. Mr. Knoll is dis- abled and his wife is employed by Idea1 Brass Company. They are also receiving aid from the Ramsey County Welfare Department. The combined gross income for Mr. and Mrs . Knoll is three hundred twenty-eight ($328..00) dollars . This money is used to support six (6) dependents ranging in age from one year six months (1-1/2) to fifteen (15) years old. This structure has several code deficiencies . Mr. Knoll has made some corrections himself. Cost of repairs is ab out seven �thousand ($7,000 .00) dollars . The owners cannot handle additional loan payments . She feels that some of the code items that were called for need not be done. She was uncooperative with our Rehabilitation Advisor and said that she did not want to be bothered again. . ACTION: Motion by Tieso to waive the filing fee. Further moved by Tieso to waive the requirements of the St. Paul Housing and Building Codes for as long as Mrs . P. Lewandowski resides in said property on condition that a ha�drail be installed on the basement stairway, that a safety-relief valve and a gas shut-off valve be installed on the hot water heater and that a gas shut-off valve be installed on the gas appliance in the dining room. Mrs . Barry lives with her mother who , is seventy-one (71) years old. Her mother is a semi-invalid. Mrs . Barry claims that she and her mother do not need any assistance from our program. Marshall SUBJECT: Section 14.02-1-i of the St. Paul Legislative Code . which requires sprinkling systems in parking garages when the stories above are occupied. Section 8. 04.2 of the St.. Paul Legislative Code which requires design of buildings for business occupancy of no less than 80 pounds per square foot. Section 8. 04 . 4 of the St. Paul Legislative Code which requires provision for weight unless the design live load exceeds 80 pou�~�ds per square foot. Section 14.02-1-d of the St. Paul Legislative Code which requires access openings to be located every 50 feet along one side of the bui ldings . ' NFPA No. 88-1968 which requires exhaust ventilation for garages of 3/4 C.F.M. per square foot of the floor area. APPEARANCES : Thomas F. Marshall, Sidney Feinberg. PROCEEDINGS : Mr. Wozniak became acting chairman. Mr. Marshall explai,ned that they are requesting permission to design for 85 pounds per. square foot total live and partition loads in lieu of 80 pounds per square foot plus partition loading of 20 pounds per square foot. The 85#/sq. ft. total load would exceed requirements of Uniform Building Code by at least 10 P.S.F. , and conforms to requirements of present code provision 804-4 - "in office buildings or other buildings where partitions might be subject to erection or rearrangement, provision for partition ' weight shall be made . . . unless the design live load exceeds eighty (80) pounds per square foot" in their opinion. Mr. Voigt said he saw no problem with this request. ACTION: Motion by Wozniak to waive Section 8.04 .2 of the St. Paul Legislative Code which requires design of buildings for business occupancy of no less than 80 pounds per square foot and Section 8. 04. 4 of the St. Paul Legislative Code which requires pro- vision for partition weight unless ths design live load exceeds 80 pounds per square foot to permit construction as requested. (7) to zero (0) . - 6 - , � 10/13/71 • • Meeting No. 60 PROCEEDIIJGS : Mr. Marshall said the St. Paul Code indicates that sprinkler system should be installed in parking ga'rages where stories above the garage are occupied for other uses , presumably to protect the higher occupancies from a garage fire. Trans- America Corporation requests acceptance of either (a) a four-hour rated floor structure separating the two occupancies , or (b) A sprinkler system installed only under that portion of the separating floor common to both occupancies , as shown on the , drawing, which would accomplish the intent of the code provision. Code requirements for access (St. Paul 14.02-T-d) would be met. No sprinkler system would be required under Uniform Building Code. . Mr. Heinen said the hoses would have to be dragged for one-half block to get near a fire. Mr. Norrgran said an oven effect is created when the corner entrances are closed and a fire exists . A sprinkler system would elimi.nate major fires. Mr. Marshall said the cost differential to install a total sprinkling system is approximately $100 ,000 .Q0 . Mr. Norrgran said he sees no compromise for a total sprinkling system. He said the fifty proposed openings would not satisfy the St. Paul Code. Mr. Marshall said the ventilation would prevent the heat buildup suggested by Mr. Norrgran. The proposed openings are to be 20" wide and go from top to bottom. They are louvered and not considered access routes. Much of the parking wi 11 be in-house. The tower portion of the building is about 150 ' wide; the remaining area is about 35 ' . There is about 12 ,000 square feet of unsprinklered area under the tower. ACTI'ON: Motion by Tieso to waive Section 14 .02-1-i of the St. Paul Legislative Code which requires sprinkling syster.ts in parking garages when the stories above are occupied. Such waiver is granted on condition that floors 3, 4 and 5 each be sprinklered totally beneath and to the east of the towered occupancies as illustrated by said drawings . � Seconded by Sommerdorf. THE VOTE: Ayes : Wozniak, Grove, Kamin, Peake, Sommerdorf, Tieso, Voigt. Nayes : none. Abstentions : none. Motion carried seven (7) to ze ro (0) . PROCEEDINGS : Mr. Marshall said there is no garage ventilation re- quirement in the St. Paul Building Code, National Building Code or Uniform Building Code, but the NFPA No. 88-1968 pamphlet calls for exhausting of 3/4 C.F.M. per square foot of f loor area. Trans- america Minnesota Corporation requests a waiver of this requirement for the following reasons : (Z) We are presently operating seven buildings with enclosed garages having vertical slot ventilating louvers on two or three sides similar to those proposed for this � -7- ' ' � 10/13/7T . ' Meeting No. 6Q project, dependent on natural ventilation only, and have never had a trace of accumulation of carbon monoxide fumes . (2) To move the required amount of air would mean circulating outside subzero air through the garage, compounding the cold weather problems . (3) As is evident at the new First Plational Bank addition, the noise pollution from the exhaust system is highly objectionable and deteriorates an otherwise pleasant downto�,an area. (4) Trans- america Minnesota Corporation feels a performance criterion would ! serve all better in this case, and will Stipulate that we will install a ventilating system if tests under operation of the garage indicate a carbon monoxide level exceeding Board of Health recommendations . The Owner will perform such tests at his expense � and submit results to the Building Department to their satisfaction. ' � ACTION : Motion by Wozniak to waive NFPA No. 88-1968 which requires . exhaust ventilation for gargages of 3/4 C.F.M. per square foot of floor area subject to the performance criterion stipulated in ' the appeal. l Seconded by Peake. � THE VOTE: Ayes : Wozniak, Grove, Kamin, Peake, Sommerdorf, Tieso, 1 Voigt. Kastelyns - PRIOR HEARING: September 22 , 1971 SUBJECT : Letter of Housing and Building Code deficiencies dated July 29 , 1971 to Mr. Kastelyns from the Phalen Area N. I.P, in- ability to qualify for a rehabilitation loan and grant. PROCEEDINGS : Mr. Kastelyns said a bid to do the total work amounted t•o $10 ,000 . A bid to correct the foundation and basement amounted to $4 ,744. 40 . He can borrow up to $350 on security. The Ramsey County Legal Department advised Mr. Kastelyns to get out from under it. He would like to sell the property to the city. He would have no down payment for another house. The $115 per month payments includes taxes . _ g _ , � 10/13/?1 .
