T • 252��� Meeting No. 45 MINUTES OF THE MEETING SAINT PAUL BOARD OF APPEALS taednesday, January 27 , 1971 Room 210 , Bureau of Health , 555 Cedar St. - 1 :30 p.m. Members present : D. Leske , Ralph E . Koenig, Rabbi Solomon Miller, Frank J. Heller, Burton B. Rudolph . The minutes of the meeting of January 13 , 1971 were approved as mailed. Moved by Tieso that the $5 .00 filing fee be a necessary condition for filing an appeal before said appeal may be formally considered by the board. Seconded by Kamin. Ayes : Wozniak , Grove , Kamin , Peake, Tieso. Nayes : none. Abstentions : none . Motion carried five (5) to zero (0) . 96-70-H 477 Laurel Ave. Charles D. Leske � Ra1ph E. Koenig SUBJECT : Summary inspection report dated October 7, 1970 from the Bureau of Health to Mr. Charles Leske indicating four Housing Code violations at 477 Laurel Avenue. APPEARANCES : Charles D. Leske, Ralph E. Koenig. PROCEEDINGS : Mr. Leske stated that there were twelve two-bedroom units in the building located on three floors and sharing six bathrooms . At one time the building may have contained only six apartments . There are approximately 35-40 people living in the building. Mr. Leske is purchasing the property on a contract for deed. Mr. Leske is also purchasing the adjoining building, also a twelve-unit apartment building, at 479-481 Laurel on a EXHIBIT "A" , 1/27/71 , Meetinc� No. 45 contract for deed. He has reconditioned 477 Laurel Ave. con- siderably to include a new heating system and substantial remodel- ing. He has tried to rent to working couples in order to keep the numbers of people down. The apartments are furnished. Mr. Staffenson said the units could remove their cooking facilities-- the building would then comply with code . Mr. Erickson said that neither building has been certified for occupancy. . Mr. Leske said his taxes for both buildings are approximately $3600- $3700 . An estimate to install the six additional bathrooms was approximately $16 ,000 . The building at 477 Laurel Avenue is worth about $70 ,000 . . . . Mr. Staffenson said there was no guarantee that the Housing Authority would ultimately acquire the property. ACTION: Moved by Wozniak to waive the requirement of Section 54 . 11 of the St. Paul Legislative Code that each dwelling unit be equipped with a water closet, lavatory and bathtub or shower to allow the present condition of twelve dwelling units to share six bathr�oms to continue. Such waiver is to be granted on condition that Mr. Leske use discretion as to the numk�er of people he rents to. Further moved that such waiver be granted until such time as the property be sold or any other right, title or interest be trans- ferred at which time said waiver be nullified. Finally moved that a full Housing Code survey be conducted at the premises in June or July, 1971. Seconded by Tieso. THE VOTE : Ayes : Wozniak, Grove, Kamin, Peake, Tieso. Nayes : none. Abstentions : none. Motion carried five (5) to zero (0) . 102-70-H 516 St. Peter St. Rabbi Solomon Miller G�her Apartments PRIOR HEARING: Meeting No. 43, December 9 , 1970 . ' SUBJECT: Letters dated April 23 , 1970 and September 19 , 1969 from the Bureau of Health to Rabbi Miller, 1195 Lincoln, setting forth Housing Code Violations discovered at 516 St. Peter St . APPEARANCES : Rabbi Solomon Miller. , PROCEEDINGS : Rabbi Miller stated the building presently contained 20 apartments and 21 occupants . He said that he had provided fire doors , sprinklers , bathroom ventilation, door closers and linoleum as requested. . . . Mr. Miller introduced a letter dated January 6 , 1971 from the Housing and Redevelopment Authority of St. Paul indicating its proposed acquisition of the proper.ty , depending on approval by the City Council and the Federal Govern- ment of the proposed NDP A-1-5 Central Core program. . . . - 2 - ; 1/27/71 , Meetinq No. 45 He also presented a letter estimating the cost to install suf- ficient bathroom facilities at about $70 ,000. . . . Mr. Staf.- fenson distributed a revised list of Housing Code deficiencies dated December 23., 1970 which was the result of a reinspection on December 10 , 1970 . He pointed out that the deficiencies other than the absent hand lavatories and bathroom facilities are mainly maintenance matters which could affect safety and health over time. The gas stove deficiencies could constitute an immediate hazard. ACTION: Moved by Tieso to waive the requirement of Section 54 . 11 of the St. Paul Legislative Code that each dwelling unit be equipped with a water closet, lavatory, and bathtub or shower to allow the present condition of some units sharing bathrooms to remain. Such waiver is granted on condition that hand lavatories be installed in units 2 , 3 and 16 to bring existing bathroom facilities up to code and that all other Housing Code deficiencies noted in the letter of December 23 , 1970 be corrected. Said waiver is to be granted until such time as the property be sold or any other right, title or interest be transferred at which time said waiver be nullified. Seconded by Kamin . Heller SUBJECT: Letter dated September 19 , 1969 from the Bureau of Health to Raymond and Frank Heller indicating Housing Code vio- lations discovered as the result of a Housing Code survey on September 18, 1969 . APPEARANCES : Frank J. Heller. PROCEEDINGS : Mr. Heller explained that three to four months would be needed to correct the Housing Code deficiencies . The property is presently held in estate and either his brother may live there and do part-time tax work there or else one of the younger relatives may purchase the house and move in. ACTION: Moved by Kamin to grant an extension of time to July 1 , 1971 during which time Housing Code deficiencies may be cor- rected. Ames , City A�chitect, to Capitol Supply Company, 600 Lafayette Road indicating that a barbed wire has been installed at the bottom of the fence on said property. APPEARANCES : Burton B. Rudolph. PROCE�DINGS : Mr. Erickson explained that the terrain on which the fence is located is irregular, consequently the fence is low in one place. . . Mr. Tieso raised the question as to whether the liability insurance might be cancelled if someone were to be injured on the barbed wire. . . Mr. Erickson contacted Jerry Segal of the City Attorney 's office who explained that ttie policy does not specify where the barbed wire has to be located. ACTION: Moved by Grove to grant a waiver of Section 4 .04-14-d-2 of the St. Paul Legislative Code to allow the bottom strand of barbed wire as is . Seconded by Peake. THE VOTE : Ayes : Wozniak , Grove, Kamin, Peake, Tieso. Nayes : none . A.bstentions : none. Motion carried five (5) to zero (0) . A discussion ensued regarding the situation in which many homes are sold to buyers who are unaware of code deficiencies at the time of sale. The home may possibly be inspected after the sale and deficiencies costing many dollars to repair may be discovered. The City has the means to inspect and advise prospective buyers as to the condition of the house. In certain situations , a home must either meet Housing Code standards or have a Certificate of Occupancy in order to be financed and sold. Mr. Anderson was asked to rough draft resolutions recommending that the council: l . Publicize that within the structure of City government , there is available a free service to examine the con- dition of housing with respect to the Housing Code . - 4 - 1/27/71 _ • � Meeting No. 45 2 .
