CONTRACT FOR SUPPLEMENTAL POLICE SERVICES
This Cotttract is made and entered into this 1 day of 7anuary 2003 by and between the
PUBLIC HOUSIIVG AGENCY OF THE CITY OF SATNT PAUL ("PHA"), and the
CITY OF SAINT PAiJL ("City"), acfing by and through its DEPARTMEI�T OF
POLICE ("Police DepartmenY') for the provision of specific police services to improve
the safety, security and livability of the PHA's public housing property at 1000 Edgerton
Street in Saint Paul.
WHEREAS, East Consolidated Weed and Seed has been awarded $50,000 from the
State of Minnesota (as grantee of federal Weed and Seed funds) as special initiative
funding to be used specifically for reducing illegal gang, drug and gun activity in and
around the PHA's Edgerton Hi-Rise at 1000 Edgerton Street and $45,000 of that amount
has been designated in the agreement between the PHA and District 6 Planning Councii
to be paid by the PHA to the 3aint Paul Police Departrnent to accomplish its stated goals
in Attachment A, which is incorporated into and made a part of this Ageement; and
WHEREAS, the PHA and the Saint Paul Police Department have individually or j ointly
prepared an Eastern District Law Bnforcement Proposal, a 2003 PHA/SPPD Work Plan,
and a 2003 PHA/SPPD Budget Proposal, all a part of and described in Attachment A,
which is incorporated into and made a part of this Agreement.
NOW, THEREFORE, the PHA and the City agree as follows:
Section 1. Scope of Services Provided by the City
The City agrees that through the Police Deparhnent's East Team Police District it
will provide covert detail operations in and around the 1000 Edgerton Hi-Rise
building, in addition to overtime policing in and azound the 1 Q00 Edgerton Ha-
Rise, specifically for the purpose of reducing illegal gang, drug, and gun acrivity,
as stated in Attachment A, which is incorporated into and made a part of this
Agreement.
Section 2. Enforcement of Rules and Regulations
A. The Police Department is hereby empowered to enforce the following PHA rules
and regulations:
Authorized to remove unauthorized visitors in unoccupied structures of
the PHA.
2. Authorized to remove unauthorized visitors on PHA property who aze
creating a disturbance or otherwise interfering with the peaceful
enj oyment of other PHA residents.

3. Authorized to remove and/or bring criminal enforcement actions against
unauthorized visitors destroying, defacing or removing PHA property.
With regazd to the foregoing rules and regulations, the Police Deparhnent
is hereby authorized, on behalf of the PHA, to give criminal trespass
wamings to auy persons deemed to be in violation of the rules or
regulations, that is, to give notice to any violators that their enhy on the
property or premises is forbidden, and to arrest or cause the arrest and
prosecution of any violators, when appropriate.
B. The Police Department is also authorized to enforce the pazking provisions of
Saint Paul Legislative Code, Section 157.20, Public Housing Agency of the City
of Saint Paul — Parking Restrictions.
C. The Police Department is hereby empowered to have removed any and all
vehicles found pazked in violation of said rule or regulation, pursuant to
established City procedure for impounding vehicles.
D. The Police Departsnent is hereby empowered to enforce such additional PHA
rules and regulations and perform such other duties as shall be specified in any
addenda attached hereto or incoxporated herein now or in the future.
E. Nothing herein contained shall be construed as permitting or authorizing police
officers to use any method or to act in any manner in violation of law or their
swom obligation as police officers.
Section 3. Communications, Reporting and Evaluation
A. Communications — Access to Information. The City agrees that the PHA will
have unrestricted access to all public information, in accordance with federal and
Minnesota state laws, which in any way deals with criminal activity in any of the
PHA's communities. Such information includes information made public
pursuant to the Minnesota Government Data Practices Act or any other law
making information public or accessible to the PHA. It is further a�reed that the
Police Department will provide to the PHA copies of such incident reports, arrest
reports or other public documents which document or substantiate actual or
potential criminal activity in ar connected with the public housing developmenYs
in accordance wath federal and Minnesota state laws. This information will be
provided at no cost by the Police Deparhnent on a regulaz basis in accordance
with specific procedures that have been or will be established.
B. Reporting. The Police Deparhnent will provide reports, in accordance with
federal and Minnesota state laws, to the PHA describing the activities supported
by PHA funds. These reports will be provided weekly and may include the

following data regazding the overtime detail only. Reporting on the covert
operation will be at the end of the detail to protect officer safety and will include
information regazding accomplishment of the goals set out in Attaclunent A as
well as all nther public data on the operation:

C. Media Caordination. The Police Department will relay to the Executive Director
or his designee information related to any major crime or incident that occurs on
PHA property, preferably before the media is informed or as soon as possible, in
accordance with federal and Minnesota state laws.
D. Evaluation. The City and the PHA shall cooperate on future evaluations of this
Weed and Seed program as it affects public housing.
Section 4. Term of Contract

This contract is effective as of January 1, 2003 and shall continue in effect until the
PHA funds allowed to be spent under this contract are exhausted (estimated to be
December 31, 2003), or longer if additional funds are awazded by the State of vlinnesota
(as grantee of federal Weed and Seed funds) or secured from other sources, unless earlier
terminated in accordance with the terms of this Contract.
Section S. Compensation to the CiTy
A. All compensation to the City will be made on a cost reimbursement basis. The
PAA will reimburse the City for services specified in this Contract in a total
amount not to exceed Fortv-Five Thousand Dollazs ($45,000) in the following
expense category:

B. The PHA shall reimburse the Police Deparhnent on a monthly basis, upon
performance of the proposed activities and receipt of invoices evidencing
authorized expenditures.
C. The city shall provide the following documentation in requesting reimbursement:
Copies of Certified Payroll Time Reports documenting names, employee
identification, hours worked in public housing developments, supervisory
approval of the report, and supervisory verification of the necessity for any
overtime worked.
D. A11 requests for reimbursement aze subj ect to the approval of the PHA's
Executive Director, or that official's designee, and the PHA shall thereafter make
payment of the approved amount within thirty days of receipt of the request for
reimbursement.
Section 6. Audit Requirement
The City and the Police Department shall have their finas!cial records audited annually
(as part of the City's annual audit) by an independent auditor and provide to the PHA a
copy of the audit report, which is required for the City as a subgrantee of federal funds.
The audit shall include the PHA funds expended under this agreement and shall
conform to the requirements of OMB Circular A-128 or later OMB circulazs as
applicable. Any audit finding relating to use of the PHA funds under this agreement
must be addressed and cleazed in a timely manner.
Section 7. Non-Discrimination
The PHA, the City and the Police Department agree that in the administration of the
pro�ram(s) no person shall, on the grounds of race, color, religion, creed, national origin
or ancestry, familia] status, sex, status with re�ard to public assistance, marital status,
disability, age, sexual or affectional orientation, political or other affiliation, be excluded
from participation in the program(s) or be denied benefits of the program(s) and agree to
comply with all federal, state, and local laws regazding discrunination.
Section 8. Data Privacy

Deparnnent or the PHA for any purQoses in the course of the performance of this
Contract is govemed by the Minnesota Govemment Data Practices Act, Minn. Stat. 13.01
et seq., or any other applicable state statutes, any state rules adopted to implement the
Act, as well as federat reb lations on data privacy. The parties aa ee to abide strictly by
these statutes, rules, and regulations.
The PHA has designated, and the City and the Police Departrnent agree to designate, a
Responsible Authority pursuant to the Minnesota Government Data Practices Act,
Minnesota Statutes Chapter 13, who is the individual responsible for the collection,
maintenance, use and dissemination of any set of data on individuals, govemment data,
or summary data pursuant to this Contract.
Section 9. Indemnification
The City does hereby release, dischazge and agree to indemnify, protect, defend and save
harmless the PHA from liability for any cost, damage, expense, injury or other casualty,
to any person whomsoever or property whatsoever caused by or arising out of the Police
DepartmenYs use and occupancy of PHA property or services provided under this
Contract, provided that such indemnification shall not be applicable where a decision or
judgment of a court of competent jurisdiction indicates that said casualty to person or
property was the direct result of acts of commission, omission, negligence or fault of the
PHA, its agents or emptoyees.
Each party agrees that it will be responsible for its own acts andlor omissions in carrying
out the terms of this Agreernent and the results thereof to the extent authorized by law
and shall not be responsible for the acts and/or omissions of the other party and the
results thereof. The liability of the City of Saint Paul and the Public Housing Agency of
the City of Saint Paul, and their respective employees, officials and agents shall be
governed by the provisions of the Minnesota Tort Claims Act, Minnesota Statutes,
Chapter 466, et seq. and any other applicable law.
Section l0. Amendments; Termination
A. Changes in the terms of this Contract may be made only by written amendment
mutually agreed upon and signed by both parties.
B. Either party may terminate this Contract upon providing fhirty (30) days written
notice to the other party. Such notice shall be delivered by Certified Mail, Return
Receipf Requested.

Section 12. Benefit and Duty
This contract will be binding upon and intue to the benefit only of the parties hereto. No
third garty or parties will derive any benefits from or have any rights pursuant to this
Contract. Nothing in this Contract is intended to, nor does it, create a special duty on the
part of either party to each other or to a third party.
By signing below, the Public Aousing Agency of the City of Saint Paul, and the City
of Saint Paul, Aepartment of Police enter into this Contract which shall take effect on
the date stated above.

Objectives and Goals
The St. Paul Police Eastem District proposes a law enforcement plan directed at violent
offenders and gang activity within the East Consolidated (ECON) Weed and Seed PHA site,
1000 Edgerton. The overall goal of the plan is intended to address the negative impact of
identified gang members and other individuals engaged in violent criminal behavior involving
the use of firearms in and around the site at 1000 Edgerton. Our enforcement objective is to
disrupt, dismantle and successfully prosecute the organized violent criminal gangs and individual
violent offenders employing an undercover law enforcement operation. The operation will
specifically target identified violent gang members and other individuals who choose to use
firearms in furtherance of their criminal actions within or affecting the ECON PHA site area. We
intend to send a suong preventive message designed to prevent future violence behavior based on
consequences. The Eastern District operation intends a collaborative effort invoiving the St. Paul
Police FORCE Unit, the SN/Nazcotics Uni� at�d the Minnesota Gang Strike Force. The Federal
Bureau of Investigation has committed to the operation as our Federal agency partner.
In meeting our goais we expect to accomplish the following:
Execute 5 search warrants.
Recover 6 firearms.
Arrest and prosecute 5 subjects.
Reduce "shots fired" in the area by 10%.
Reduce firearms related Aggravated Assaults by 5%.
Long term reduction in violence and drug distribution within the PHA site.
Plan Overview
The operation is designed around the ability to remain fluid and pro-active in nature. Our plan is
to adapt and improvise our on going tactical operation in anticipation of the targeted criminal
subjects as the operation unfolds. We are aware-of a developing violent gang wtrose leadership is
based within the ECON site in the area of the PHA building which makes this operaYion timely.
The gang is a well-known entiTy in Califomia recently expanding their cruninal enterprise in St.
Paul. The opportuniTy to dismantle the gang's expansion in St. Paul in its formative stage is at

hand. The operation is an aggressive approach to gang and violent offenders who choose to use
firearms in furtherance of their criminal behavior. The operation is divided into two phases.
The first phase uses a cooperating individual working under the direction of police officers
purchasing narcotics, primarily methamphetamine. We will document these transactions with
personal observation and electronic surveillance. We selected narcotics activity as the initial
means of targeting gang and violent offenders due to the integral role nazcotics distribution
occupies in the gang enterprise and violent individual offenders course of conduct. The
relationship between the use of fireazms and drug distribution is well documented.
The second phase of the operation involves following up of information and intelligence data
developed in the first phase. We will also offer the individuals arrested in the first phase an
opportunity to cooperate with law enforcement affording us to work higher within the gang
hierazchy or offender associates with the intention of addressing firearms used or possessed by
violent offenders. It is our intention to identify source locations of fireazms and narcotics
affecting the ECON area and PHA site and execute search warrants at these locations.
Evaluation
We intend to evaluate the success of the project by the following criteria and methods:
Comparative study and analysis of Part I data and Statistical IVlapping Data related to
Aggravated Assault and Shots Fired.
Comparauve study of gang related graffiti.
Comparative analysis of Statisticai Mapping Data reflecti�lg Quali�y o£Life issues related
to nazcotics activity.
Level of arrests and successful prosecution of subjects occupying leadershi�i rdl�s of
identified criminal gang.

Uniform Oaerations
Uniforms will conduct zero tolerance patrols in and azound the PHA property located in
the East Consolidated (ECOI� neighborhood in an attempt to curtail illegal activities.
Identification and arrests of those committing criminal act, working with youth and
targeting gang and drug activity, the visibility of pa�ol cars, walking and bike patrois in
the neighborhood, the attendance of officers at community events and meetings, will
benefit the ECON neighborhood, unprove the quality of life and allow the residents to
feel safe and secure in their community.
Uniforms will work closely with the F.O.R.C.E. in deating with drug operations. The
police Department will also collaborate with Code enforcement in dealing with problem
properties.
Strateav for the detail
Officers will conduct zero tolerance uniformed patrols in and azound the PHA property
located in the ECON area in an attempt to immediately impact ongoing criminal
activities. Action taken during this operation will certaiuly impact the community in a
positive manner and will foster better relationships between the officers and the citizens
they serve. To this end the following tactics will be employed:
l. Identify Those individuals who aze creating unlawful nuisances and
committing criminal acts.
Identify problem properties and notify appropriate personnel for
enforcement and follow-up assignments.
2. Intervention Intervene and disrupt unlawful nuisance behavior; trafFc offenses;
noise; liquor; gambling; disorderly gathering and problem
properties.
Zero tolerance enforcement of all nuisance and tr�c violations.
3. Interdiction Interdict criminal activity to include nuisance, vice and drug
activity.
4. Incarceration Incazceration of offenders will be immediate unless follow-up
action is necessary to improve prosecution. Juvenile offenders wil]
receive immediate attention through arrest, citation, or referral.
Outcomes
A reduction of drug use in and azound the building. Decrease in crimes such as drinking
in public, loitering, graffiti in and around the building, and other nuisance crimes
efFecting the quality of life for the residents of the building. A decrease in gang activity
in and around the building. A generat feeling of safety for the resadents in and outside the
building. Uniform officers inside the building at various times would reduce
unauthorized parties from being in the building and help reduce criminal activity.
