1 WHEREAS, the City of Saint Paul ("Cit}�') plans to consuuct a roadway for the Phalen Boulevard
2 Project designated as State ProjecUState Aid Project No. 164-288-02 and City Project No. 02-P-1189;
3 and

5 WHEREAS, the plans and specifications for the project require use of various lands for the street and
6 roadway purposes; and

8 WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul ("HRA") is the owner
9 of property, a portion of which is necessary to construct the roadway improvements for this project; and

ll WHEREAS, the HRA has dedicated this property for roadway purposes as documented in the attached
12 Exhibit "A"; now, therefore be it
13
14 RESOLVED, that the City accepts the dedication of a permanent easement for roadway purposes and
15 temporary construction easement on HRA property, as shown on the attached Exhibit "B"; and be it
16 further

18 RESOLVED, that the proper City officials are hereby authorized to execute any documents necessary to
19 effectuate this dedication.

The City plans to begin construction of the first roadway phase of the Phalen Boulevard projec� Before
contracts may be advertised and awarded, the City must acquire all the necessary property rights. As part
of the acquisition process, the City of Saint Paul must accept the dedication of permanent roadway and
temporary construction easements on property owned by the Saint Paul Housing and Redevelopment
Authority (HRA) in the project area. This resolution provides the proper acceptance of the HRA's
dedicafion.

The City will be able to secure a Right of Way Certificate #1 from MnDOT, which is required before the

AUTHORIZATION TO GRANT PER.MANENT EASEMENT
AND TEMPORARY EASEMENT TO THE CITY OF SAIl�TT PAUL
FOR CONSTRUCTION OF NEW P�3ALEN BOULEVARD
AT PAYNE AVENUE, PAYNE-PI3ALEN DISTRICT 5
WHEREAS, the City of St. Paul has approved the construction of New Phalen Boulevazd from
Williams Hill to Payne Avenue located within Payne-Phalen District 5; and
WFIEREAS, New Phalen Boulevard will have at grade access to Payne Avenue just north of the
Payne Avenue Bridge located within Payne-Phalen District 5; and
�VHEREAS, this new section from Williams Hill to Payne Avenue will open up underutilized
property for development of the Westminster Junction light-industrial park bringing in over 400
new j obs when completed; and
WHEREAS, the Housing and Redevelopment Authority authorized the acquisition of 824 Payne
Avenue, a taac forfeit pazcel in 2002, in accordance with the Payne Avenue Revitalization
Strategy and for Phalen Boulevard roadway use of which part of the pazcei needed for both a
permanent easement and temporary easement is needed for roadway purpose and construction
staging; and
tiVHEREAS, this section of New Phalen Boulevazd is scheduled to be completed by the end of
2003, with activities starting for the roadway starting around November 18, 2002.
NOW THER�FORE, BE IT RESOLVED by the Housing and Redevelopment Authority of the
City of Saint Paul, Minnesota, that the following permanent and temporary easement ue hereby
approved as follows:
1. That a permanent easement is granted for roadway purposes to construct the at grade
enhy to Payne Avenue on the following described property:
An easement for road purposes over, under and across Lots 14, 21, 22 and 23 of Chas.
�Veide's Subdivision of part of Block 45 of Arlington Hills Addition to St. Paul as
recorded in the Ramsey County Recorder's Office and the south half of the vacated aliey
in said subdivision.
2. That a temporary easement is granted for roadway construction staging at the grade
entry to Payne Avenue on the following described properry:
A temporary slope and construction easement for over, under and across the west 10.00
feet of Lots 9, 10, 11, 12 and 13 of Chas. �Veide's Subdivision of part of Block 45 of
Arlington Hills Addition to St. Paul, as recorded in the Ramsey County Recorder's Office

� and the west 10.00 feet of the north half of the vacated alley in said subdivision. Said
easement is to expue on December 31, 2004 or such eailier date the property is no longer
needed. .
3. That the City of Saint Paul reimburse HRA the amount of $16,000.00 for
permanent easement being granted.
