RESOLVED, That the Council hereby ratifies and approves the action
of the St. Paul Board of Appeals and Review for the Housing, Building
and Fire Prevention Codes at its meeting of July ' 14, 1971, waiving
Section 4.04-12e of the St. Paul Legislative Code which requires
a rear yard clearance of not less than 22-1/2 feet in depth for
a one, two or three story building to permit construction of the
Shamrock Court Apartments located at 2196-2236 Lower McKnight Road
to within 9 . 30 fe�t of the rear yard line as requested and be it
FURTHER RESOLVED, That said waiver be granted on condition
that no building or buildings be constructed on, nor any ingress or
egress to McKnight Road be allowed from the commercially zoned
property which abuts the aforementioned rear yard lot line and
which is described as follows:
Al1 that part of the East 1/2 of the Northeast 1/4 of the
Northeast 1/4 of Section 11, Township 28 North, Range
22 West, that is encompassed by the following described
line; Commencing at the Southeast corner of the said
Northeast 1/4 of. the Northeast 1/4, thence North 0°Ol'09"
West, along the East line of the Northeast 1/4 for 350.0
feet, thence North 89°41'15" West, parallel to the South
line of said Northeast 1/4 of the Atortheast 1/4, for 40.0
feet to the point of beginning of the line to be described, .
� thence continuing North 89°41' 14" West for 615.00 feet
� to the West line of East 1/2 of the Northeast 1/4 of the
