03-209Council File # Q'3 � aOg GreenSheet# �o3K3y RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date 1 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the 2 subject of noise in the City of Saint Paul; and 3 4 WHEREAS, §293.11 provides for the granting of variances from the sound level 5 limitations contained in §293.09, upon a finding by the City Council that full compliance with 6 Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the 7 community; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 WHEREAS, Gabe's by the Park, represented by Tim Weiss, President, who has been designated as the responsible person on the applicaYion, has applied for a variance to allow amplified music at 991 N. L.exington Pazkway, on March 14, 15, 16 and 17, 2003 and October 31, and November 1, 2003; and WHEREAS, applicant is seeking a variance for the hours of 4:00 p.m. to 12:00 midnight on each of those dates; and WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its Saint Patrick's Day and Halloween events; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regazding conditions for the variance; now, therefore, be it RESOLVED, that the Council o£ the City of Saint Paul hereby grants a variance to Gabe's by the Park, subject to the following conditions: 1) 2) The vaziance shall be for the hours of 4:00 p.m. to 12:00 midnight on Marchl4, 15, 16 and 17, 2003 and October 31 and November 1, 2003.
