WHEREAS, The Council of the City of Saint Paul, by its
Resolution, C. F. 253792, approved April 27, 1971, vacated the
alley in Block 2, Hazel Park Plat B and a portion of East
Magnolia Avenue and a portion of Van Dyke Street; and
WHEREAS, A condition of said vacation was the granting of a
permanent sewer easement to the City of Saint Paul across a por-
tion of Block 2, Hazel Park Plat B, as more fully described in
the said resolution; and
WHEREAS� The City Council, pursuant to recommendation of its
Department of Public Works, desires to amend the description of the
sewer easement; now, therefore, be it
RESOLVED, Tha.t Council File No. 253792, approved April 27,
1971, be and the same is hereby amended by deleting condition in
Reservation No. 4 therefrom, and inserting the following in place
thereof:
"4. Tha.t the petitioner grant to the City of St. Paul
a 30' wide permanent easement for constxv.ction and main-
tenance of public sewers on, over� and across all tha.t �
part of Lots 9, 10, 17 and 18 and platted alley, all in o
Block 2, Hazel Park Plat B lying 15 feet on either side �
of a line beginning at a point on the South line of said � �
Lot 17 a distance of 3 feet west of the Southeast corner
of said Lot 17; thence run along a straight line in a a �
Northeasterly direction to a point on the North line of �
said Lot 9� a distance of 14 feet east of the Northwest
corner of said Lot 9 ancl. there termi.nating." �

FURTHER RESOLVED� Tha.t, all of the rema.ining terms and condi-
tions of the said vacation resolution, C. F. 253792, sha.11 remain
in force and effect.
