C. Sudheimer. The minutes of the meeting of May 12 , 1971, were approved as amended. Mr. Edmunds explained the present home ownership policy of the Ramsey County Welf are Department. Recipients of Public Welf are � purchase homes because of the shortage of rental units and to improve their living conditions. Before a home is purchased by any welfare recipient, it should be inspected by a member of the Housing Coordinator' s staff or by a competent outside appraiser. If a home has code violations or a single costly deficiency, the welfare recipient is advised not to purchase the home. While the recipient has a free choice to purchase the agency has no obligation if there is no agency approval. Agency approva� ; EXHIBIT "A" - 1 - • � . . ,� r-„ .J ... .. however, will provide that the recipient will be assisted in payment if there are overlooked code violations or major deficiencies , and there will be a provision for meeting emergencies . This policy applies only to purchase of homes after the welfare recipient is in receipt of public assistance and does not apply to those persons who receive public assistance after their home has been bought. The following criteria must be met for repairs of $250 or above : 1. Must be 5 members in the family 2 . Must be 20 years life expectancy in property 3. Repairs should not exceed 250 of equity 4. Rental units must be in short supply 5 . Other resources must be exhausted, e.g. , family, loans , etc. 6 . The property must be thoroughly inspected - no other serious deficiencies exist. 4 Most repairs of $250 or above must be approved by the County Board. Repairs up to $250 can be approved by an assistant super- visor. Ed Cleary, Ramsey County Attorney, has advised Mr. Edmunds that whereas liens against property for home improvements are prohibited, there is a possibility that a second mortgage could be taken against the property for such purposes. Mr. Brenna explained the purpose of and criteria for obtaining Section 235 loans which are for individuals of low and moderate incomes . The provisions of Section 518 (b) are to assist homeowners in car�ecting structural or other defects of a dwelling which was purchased with a Section 235 mortgage. . . . It was pointed out that whereas FHA sets forth provisions for loans , it is the lending institutions which ultimately control the eligibility for such Toans. Some specific housing problems of the County Welfare Department were discussed. Mr. Wozniak left. Mr. Tieso became acting chairman. - 2 - � .,c:�+�:Lli�j d�v. ...�� 11-71-H 409 Laurel Ave. Curtis M. Lilleboe PRIOR HEARING: March 24 , 1971 April 14 , 1971 April 28, 1971 SUBJECT : Letter dated February 22 , 1971 to Curtis M. Lilleboe, 1665 Marshall Ave. , enumerating Housing Code deficiencies lo- cated on the property at 409 Laurel Ave. during a survey on November 20 , 1970 by the Bureau of Health inspectors . Letter dated April 22 , 1971, to Curtis M. Lilleboe , 1665 Marshall Ave. , enumerating Housing Code deficiencies located on the property at 409 Laurel Ave. during a survey on April 18, 1971, by Bureau of Health inspectors: APPEARANCES : Curtis M. Lilleboe. PROCEEDINGS : Mr. Blue stated that two exits are not required from the third floor but that the door at the bottom of the stairway on the first floor should be replaced and the door to the apartment should be made fire resistant. . . Mr. Lilleboe receives $45 per month for the units . A letter dated April 28, 1971 from the Housing Authority to Mr. Anderson indicates that the property will probably be acquired by the Housing and Redevelop- ment Authority within the next three years . ACTION: Moved by Voigt to waive Section 54. 15 (3) of the St. Paul Legislative Code that no wood frame dwelling be occupied above the second floor for sleeping purposes and Section 54.11 of the 5t. Paul Legislative Code that each and every dwelling unit contain a water closet, lavatory and bathtub or shower. Such waiver is granted to permit continued occupancy of the dwelling unit on the third floor, to permit two dwelling units to sh are one bathroom on the third floor and to permit seven dwelling units to share one bathroom on the second floor. Said waiver is granted on condition that all other code violations enumerated in the subjects of appeal dated February 22 , 1971, and April 17, 1971, be corrected within ninety days . PRIOR HEARING: February 10 , 1971. - 3 - M • SUBJECT : Building inspection repor� aated Decernber 7, 1970 , indicating an illegal cellar occupancy at 1521 Grand Ave. APPEARANCES : Karl Dedclpn Jr. PROCEEDINGS : Mr. Dedolph inform�d the board that �he basement occupancy would be permanently vacated and that a Certificate of Occupancy would be requested on that basis . The appeal. was therefore withdrawn. 33-71-B 1819-1821 Mechanic Ave. Darrell C. Iverson SUBJECT : Letter dated April 21, 1971, from tne Building Depart- ment to Mr. Darrell Iverson, 1321 Mecr.anic Ave. , indicating what inprovements must be made in order that a Certificate of Occu- pancy may be issued. APP�,ARANCES : Darrell C. Iverson. PROCEEDINGS : Mr. Tieso read the appeal dated May 10 , 1971, re- questing a variance from the 7 ' 6" ceiling height requirement to permit occupancy of the basement apartment which has a ceiling height of 6 ' ll" . Mr. Iverson said the basement unit has one bedroom. He is suing the individual from whom he purchased the building for misrepresentation as it was sold as a `�riplex. He purchased the home in January, 1971. ACTION: Unanimously agreed to carry the matter over to the next regular meeting of the board to give Mr. Iverson an opportunity to consult his attorney as to whether or not he should seek a variance at this time. 34-71-B 1515 Dale Street Elmhurst Cemetary Ass 'n. by Walter 0. Reichow SUBJECT : Discussion between Robert Aries , Sam Blue and Walter Reichow indicating that whereas no building is being erected on property which Elmhurst Cemetery is grading, the fee for grading according to Section 1.09 of the St. Paul Legislative Code would be charged on a square footage basis with no maximum limit. The total fee would therefore be $1,748. APPEARANCES : Mr. Tieso read the appeal requesting that a maximum grading fee of $300 be charged which is the maximum that would be - 4 - . ' . charged if a building were to be erected. . . . Mr. Reichow and Mr. Olmstad displayed a blueprint of t:ze proposed grading. ACTiON: Mcved by Peake to waive Sec�ion 1.09 af the St. Paul Legislative Code changing permit fees �or grading on a square footage basis where no building is to be' erected. �urther moved tnat a maximum fee of $300 be cr.arged for the proposed grading. Sudheimer SL'BJECT : Notice dated May 12 , 1971 to L. C. Sudheimer, 387 Grand Ave. , from Glenn Erickson, Assistant CiLy Architect, indicating that the proposed construction of a winder stairway to the third floor unit is in violation of 6 .02 and 6 .05-6B of �tiie St. Paul Legislative Code which prohibits winders and requires a minimum width of stairs of 3 ' . APPEARANCES : Louis C. Sudheimer. PROCEEDINGS : Mr. Tieso read the appeal which requests permission to install the 5 ' circular stairway between the second and third levels of the dwelling. Mr. Sudheimer said there is an enclosed rear stairway exiting to the outside in the corner of the building. Mr. Sudheimer felt there would be no violation if a family lived on the second and third floors . ACTION: Moved by Voigt to waive Sections 6 .02 and 6 .05-6B of the St. Paul Legislative Code and Section 5. 3 of the Life Safety Code prohibiting the use of winder stairways and requiring a minimum width �or stairs of three feet. Such waiver is granted" to per- mit construction of winder stairway 2 ' 6" in width between the second and third levels of the building. Such waiver is granted on condition that the stairway conform in all other respects to Building Code requirements . Seconded by Sor;snerdorf. The Board agreed to request Mr. Rein to appear before the board to explain some aspects of his proposal. T�:e construction oi St. James Housing was discussed.
