WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject
of noise in the City of Saint Paul; and
WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other persons or on the community; and
WHEREAS, Trigen Energy Solutions of St. Paul, LLC, represented by Ray LaTronica,
Construction Superintendent, who has been designated as the responsible person on the application,
applied for a variance to allow work to take place on the boiler at the St. Paul Cogeneration facility,
during the period from December 11, 2002 through January 17, 2003; and
WHEREAS, the variance request was granted by the Giry Council, but the project ran into
delays, and Trigen Energy Solutions has requested that the variance be extended on all of the same terms
and conditions but with new dates to permit the project to take place; and
WHEREAS, if applicant is not gran[ed a variance it will not be able to perform the necessary
maintenance work on [he boiler; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the
application and has made recommendations regarding issuing the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for Trigen
Energy Solutions of St. Paul, LLC, beginning February 14, 2003 and continuing through April 14, 2003
for five consecutive twenty-four hour periods during that time period.

1) The variance shall be for the five twenty-four hour time periods chosen
between February 14, 2003 and April 14, 2003 and shall permit boiler
steam blows, an operation for cleaning piping from the boiler to the
steam turbine, during those hours without the limitations set forth in
Chapter 293.
2) Trigen Energy Solutions of St. Paul, LLC shall take any practical steps
available to minimize the noise levels during these periods which do not
otherwise unduly hinder the project or unreasonably increase the costs.
3) That during the initiation of [he cleaning process (s[eam release),
District Energy shall monitor the sound levels at two (2) locations.
a. At 25 feet from the steam vent exhaust (muzzler).

3 4) Exact monitoring locations shall be approved by the Office of License,
4 Inspections and Environmental Protection (LIEP) before the start of the
5 process (steam release).

7 5) If monitored sound levels at the Irvine Pazk location indicates levels less
8 than 55 dBA, the process (steam release) may prceeed uninterrupted.

10 6) If the monitored sound levels at the Irvine Park location indicate levels
11 of SSdBA but less than 65 dBA during the nighttime hows (10:00 p.m -
12 7:00 a.m), the steam venting process shall at a minimum, be modified to
13 reduce the sound level needed to reach 54.5 dBA at the Irvine Pazk
14 location. If District Energy is unable to reduce the sound levels the
15 needed amount at the 25 foot location, the cleaning process (steam
16 release) shall be limited to the daytime hours of 7:00 a.m. to 10:00 p.m.
17 (It is anticipated that with a continuous unrestricted steam venting, the
18 cleaning should take five (5) days or less. A reduction in the steam
19 venting sound levels or the limiting of the venting to daytime hours, may
20 reduce the effectiveness of the cleaning process resulting in possibly
21 more than five (5) days to complete.

23 7) After the inival monitoring, LIEP may require District Energy to
24 conduct additional monitoring during the steam venting process, to
25 verify compliance with these conditions.

27 8) The Saint Paul City Council reserves the right to review the grant of the
28 variance upon receipt of complaints about the noise being created and to
29 amend or revoke the variance.

District Energy Boiler Steam Pipe Cleaning
Attached is a sound level variance application from Raymond Latronica, Construction
Superintendent of Trigen Cinergy Solutions of St. Paul, L.L.C., 50 Kellogg Blvd. West,
Suite 340, Saint Paul, 55102, to allow an extension of the time period needed for the
cleaning of piping from the boiler to steam turbine at the St. Paul Cogeneration facility, 76
Kellogg Blvd. West. The variance is requested for 5 consecutive twenty-four time periods
chosen between February 14, 2003 and Apri114, 2003.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 76 Kellogg Blvd. West.
