RESOLVED, That the Council hereby ratifies and approves
the action of the Saint Pau1 Board of Appeals and Review for
the Housing, Building and Fire Prevention Codes pertaining
to the following listed properties and as shown by the
official minutes of said Board of Appeals dated September 22,
1971, a copy of which, marked EXHIBIT "A" is attached hereto
and made a part hereof by reference:

61-71-B 107 West Orange Ave. Gerald Hogeboom
SUBJECT : Request for variance from Section 40 .0 (c) of the St.
Paul Legislative Code which states that no permit shall be issued
for construction of more than one garage or accessory building on
a site.
APPEARANCES: Gerald Hogeboom
PROCEEDINGS : Mr. Hogeboom has received a permit to construct a
garage on the property. He has started to do so. The Building
Department discovered another accessory building on the lot. Mr.
Hogeboom would like to retain the existing accessory building on
the lot and use it for storage. It is too small to be used as a
garage. The new garage would be for a car and truck that he owns.
Mr. Hogeboom presented a sketch showing the location and size of
the existing and proposed structures .
ACTION: Motion by Grove to waive Section 40 .0 (c) of the St. Paul
Legislative Code that no permit shall be issued for construction of
more than one garage or accessory building on a site. Such waiver

is granted to permit Mr. Hogeboom to construct a new garage as
proposed and retain the existing accessary building on the lot.

55-71-B 419 South McKnight Road Donald A. Tousignant
P RI OR HEARING: Septembe r 8, 19 71
SUBJECT: That portion of the St. Paul Legislative Code which
requires a waste line of 1-1/2" minimum. The present structure
has a 1-1/4" waste line.
APPEARANCES : Mr. and Mrs. Donald A. Tousignant.
PROCEEDINGS : Mr. Erickson reported that Maplewood Plumbing had
been informed of the board's position. Mrs . Tousignant said the
state announcement indicated that the house was "suitable to be
moved into the City of St. Paul" . None of the four plumbing
estimates included a bid to change the size of the waste line.
Mr. Tousignant said he intends to pursue the contractor.
ACTION: Motion by Wozniak to waive that portion of Chapter 18
of the St. Paul Legislative Code which requires a minimum waste
line of 1-1/2" in diameter for the dwelling located at 419 South
McKnight Road. Such waiver granted to permit use of the existing
1-1/4" waste line.
Seconded by Peake.

Nayes : none. Abstentions : Tieso. Motion carried six (6) to
zero (0) with one (1) abstention.
58-71-P 782 East Hawthorne Ave. George J. Kastelyns
SUBJECT: Letter of Housing and Building Code deficiencies dated
July 29 , 1971 to Mr. Kastelyns from the Phalen Area Neighborhood
Improvement Program. Inability to qualify for a rehabilitation
loan and grant.

PROCEEDINGS : Mr. Kastelyns purchased the home in August of 1966
on contract for deed for $8,700 .00 His monthly payments are
$115.00 . There is a balance of about $4,000 owed now. Mr.
Kastelyns lives downstairs . A renter upstairs pays $60 .00 per
month. A 3$ loan was approved in December of 1968. The cost
to repair the home at that time was estimated at $7000.00 . Today
the cost to repair the home is estimated at $11,000 .00. The home
has been appraised at $9,500 . 00 . The maximum loan he can now
get is $3,500 .00 because he is purchasing the home on contract
for deed. He has completed a significant amount of work on the
home to include rewiring, installing outside meters, installing
a lavatory and bathrooms, enclose open sewer drains , etc. The
biggest problem is that the house is slipping off its foundation.
The home was originally built as a two-residence unit. Space
heaters heat both units . He hopes to have tiie home paid for in
2--3 years. The home is insured for $20 ,000.00. He would like
to be left alone and fix the home up himself as he can afford to.
ACTION: Mr. Kastelyns was asked to obtain estimates of cost to
repair the basement and foundation and determine whether or not
he wants time to comply. The matter will be reheard on October 13,
19 71.
The following appeals were presented by Jack Mell of the Phalen
Area Neighborhood Improvement Program on behalf of certain residents
in that concentrated code enforcement area. In all cases the
appellants were elderly and had limited incomes. Sometimes physical
and/or other disabilities were noted. The matters were presented
primarily in writing rather than verbally and usually included a
summary information sheet, a list of code violations when applicable,
a program worksheet when applicable, a public health nurse contact
report where applicable and any other supplemental information
which may be helpful to the board. The records are on file in
the administrative office of the board and are available for public
inspection if reasonable cause is shown. The appeals considered
at this meeting concerned the following properties :

59-71-P 693 East Maryland Ave. Phoebe I. & Ted Swanson
APPEARANCES : Ted Swanson
SYNOPSIS : The applicants are sixty-eight (68) years old and sixty-
five (65) years old. They are owners of a single family dwelling
at 693 East Maryland Avenue in Saint Paul. The combined monthly
income of Mr. and Mrs. Swanson is one hundred seventy six dollars
($176 .00) . They also receive food stamps from the Ramsey County
Welfare Department. This structure has many code deficiencies ,
some of which are of a serious nature structurally. Cost of re-
pairs is nearly double the grant limitation of three 1Chousand
five hundred dollars ($3,500 .00) . The owners cannot handle ad-
ditional loan payments or make any corrections themselves .
ACTION: Motion by Wozniak to waive existing requirements of the
St. Paul Housing and Building Codes with respect to the property
owned by Phoebe I. and Ted Swanson located at 693 East Maryland
Ave. for as long as Phoebe I. and/or Ted Swanson own and reside
in said property. Further moved that such waiver be granted until
such time as the property be sold or any other right, title or
interest be transferred at which time said waiver be nullified.
Finally moved that the filing fee be waived.

60-71-P 810 East Cook Ave. Bernice L. Mularczyk
SYNOPSIS: The applicant is seventy-three (73) years old and is
one-third (1/3) owner of a duplex at 810 East Cook Avenue in
Saint Paul. The other two (2) owners are a sister and a brother.
The brother lives with Mrs . Mularczyk and is eighty (80) years old.
He is almost totally blind and is an amputee. He is totally
dependent upon her. Her sister, Mary Jaoorsk, is eighty-five
(85) years old and lives in the Golden Oaks Nursing Home in South
St. Paul. The combined monthly income of Mrs . Mularczyk and her
brother is three hundred eighty-two ($382.00) dollars , excluding
Mrs . Jaoorsk 's assets which were five thousand eight hundred
fifty-eight ($5, 858.00) dollars. Mrs . Jaoorsk uses these assets
to pay the nursing home. This property has several code deficiencies.
The three (3) owners are unable to handle additional loan payments
and are unable to make any corrections themselves . It will be
difficult for the grant money to bring the structure up to the
Saint Paul City Housing Code regulations. It would require
approximately seven thousand ($7,000 .00) dollars to do this .

ACTION: Motion by Grove to waive the filing fee. Further moved
to waive existing requirements of the St. Paul Housing and Building
Codes with respect to the property located at 810 East Cook Ave.
for as long as Bernice Mularczyk and/or her brother and/or her
sister reside in said property.

62-71-P 682 East Orange Ave . Hilda Norman
SYNOPSIS : The applicant is in her seventies (70 's) and is owner
of a duplex at 682 E. Orange Avenue in Saint Paul. Mrs . Norman
has arth ritis which limits her activities . She may accept the �
program one day but not the next. She refuses to let the rehabi-
litation advisors assist her in repairing her home.
ACTION : Motion by Wozniak to waive the filing fee. Further moved
to waive existing reguirements of the St. Paul Housing and Building
Codes with respect to the property located at 682 East Orange Ave.
for as long as Hilda Norman resides in said property.

Voigt. Nayes : none. Abstentions : none. Motion carried seven

63-'11-P 1240 Bradley St. Mrs . Elizabeth Sohlo
SYNOPSIS : The applicant is in her eighties (80 's) and is the owner
of a single dwelling unit at 1240 Bradley Street in St. Paul. Mrs .
Sohlo is homebound. She has a younger woman living with he r. Her
son stated that he feared that if the home were to be repaired
that it might upset his mother and she could have a heart attack.
ACTION: Motion by Sommerdorf to waive the filing fee. Further
moved to waive existing requirements of the St. Paul Housing and
Building Codes with respect to the property located at 1240 Bradley
St. for as long as Mrs . Elizabeth Sohlo resides in said property.

SYNOPSIS : The applicant is the owner of a single family dwelling
unit at 1247 Arkwright Street in St. Paul. Mrs . Buschell is a
widow and is eighty (80) years old. She has Pernicious Anemia and
is under the care of a physician and the Family Nursing Service.
Mrs . Buschell's gross monthly income is approximately $140 .00 .
The structure is over eighty (80) years old and has several code
deficiencies . Mrs . Buschell would be unable to handle additional
loan payments .
ACTION: Motion by Sommerdorf to waive the filing fee. Further
moved to waive existing requirements of the St. Paul Housing and
Building Codes witn respect to the property located at 1247 Ark-
wright 5t. for as long as Mrs. Frieda Buschell resides in said
property.

65-71-P 1252 Arkwright St. Mrs . Florence J. Lyon
The applicant is sixty-one (61) years old and is the owner of a
single family dwelling unit at 1252 Arkwright Street in St. Paul.
The applicant has a heart condition and has been critically ill
several times. Her sister, who lives with her, is seventy-one
(71) years old and has a physical handicap resulting from extensive
surgery for cancer. A new roof was put on this summer and the
house was completely rewired and approved three (3) years ago.
This created such confusion and distress that the applicant feared
that another period of repair to the home would cause her sister
to become seriously ill.
ACTION: Motion by Wozniak to waive the filing fee. Further moved
to waive the requirements of the St. Paul Housing and Building
Codes with respect to the property located at 1252 Arkwright St.
for as long as Mrs. Florence J. Lyon and/or her sister reside
in said property.
