WHEREAS, In the matter of Com�troller's Contract L-7339, City Project No.
70-P-0529, for Widening and Overlay of MARYLAND AVENUE from Johnson Parkway to
Prosperity Avenue, Ashbach Construction Company, Contractor, the specified date
of com�letion is Jnly 15, 1971, and
WHEREAS, The Contractor was not able to com�lete the contract by said date
of completion, therefore be it
RESOLVED, That the proper City Officials be and they are hereby authorized
and directed to execute an amend�aent to said contract extending the time of
comQletion to September 15, 1971, provided however, that this resolution shall
have no force or effect unless the sureties on the Contractor's bond consent
thereto and f ile such consent in writing with the City Comptroller, and be it
FURTHER RESOLVED, That the City of Saint Paul hereby waives all claim for
liquidated damages and that no engineering and inspection costs on this project
will be charged to the Contractor for such extended period.
