WHEREAS, In the matter of Comptroller's Contract L-7415, City Project No.
71-P-0544, for Widening and I�proving FIFTH STREET from Broadway to 100' East of
John Street and JOHN STREET from Fourth Street to Fifth Street, Ashbach Construc-
tion Co�panq, Contractor, the apecified date of completion is September 1, 1971,
and
WHEREAS, The contractor was not able to complete the coatract bq said date
of completion, therefore be it
RESOLVED, That the proper Citq Officials be and they are herebq authorized
r �nd directed to �secute an amendment to said contract extending the time of com-
� '�%�pletion to October 20, 1971, provided howener, that this resolution shall have
" �f � no force or effect unless the sureties on the contractor's bond conseat thereto
�
and f ile such consent in writing with the Citq Comptroller, and be it
FI3RTHER RESOLVED, That the City of Saint Paul her�by waiv�s all claim for
liquidated damages and that no engineering and inspection costs on this project
Will be ct►arged to the contsaetor for such estended period.
