The applicant shall file a copy of the Council Resolution approving the registered land survey with the Ramsey County Recorder's Office. 2. The applicant shall send a letter of commitment to Saint Paul Regional Water Services (SPRWS) that, while Sibley Street is tom up, the SPRWS will be allowed to disconnect an old water line in the alley way (old Lyons Court) from the water main (in Sibley Street). PURPOSE: Registered Land Survey for vertical subdivision of property to create 5 separate parcels (Tracts A-E) to allow underground parking under an apartment building that will be used by an adjacent condominium building. B. PARCEL SIZE: 76,365 square feet (1.75 acres) C. EXISTING LAND USE: Surface parking, church, office building being converted to housing D. ZONING CODE CITATION: State statute provides that registered land surveys shall be approved in the manner required for the approval of subdivision plats. Saint Paul's Legislative Code Section 67.301 states that a plat is required when 5 or more lots or parcels are created, each of which is 2'h acres or less in size. Section 67.406 states criteria for the review of subdivision applications. These criteria are covered below under "H. Required Findings." F. HISTORY/DISCUSSION: The North Quadrant has undergone significant redevelopment over the past 3 years, changing from several blocks of surface parking to a vibrant neighborhood of new housing units, a central green and redesigned streets. Phases 1 and 2 have brought 300+ new housing units to the neighborhood, with a mix of owner and rental, market-rate and affordable units. The two housing projects for which this registered land survey is being filed constitute Phase 3 of the rejuvenation of the North Quadrant, and will result in more than 100 new units being added to the market. The block under review is immediately north of Wacouta Commons, the new park at the heart of the North Quadrant. Conversion of an historic office/warehouse building to 50 ownership loft units and construction of a new 60-unit affordable senior rental building will help diversify the housing options in the neighborhood. Due to a unique and innovative arrangement between these two buildings, parking for the lofts will be provided underneath the new senior rental building, thus necessitating this "vertical" land survey. G. DISTRICT COUNCIL RECOMMENDATION: No recommendation had been received from the CapitolRiver Council at the time the staff report was written. H. REQUIRED FINDINGS: Section 67.406 of the Zoning Code requires that all of the following findings be made prior to approval of a subdivision. 03- ( � �1 Zoning Fiie #03-382-681 City Council Staff Report Page 2 1. All the applicable provisions of the Legislative Code are complied with. This condition is met. 2. The proposed subdivision (registered land survey) will not 6e detrimental to the present and potential surrounding land uses. This condition is met. The proposed subdivision, by ailowing redevelopment on the site, wili improve the value, appearance and marketability of present and potential surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. This condition is met. The subdivision is being proposed specifically to coordinate the reuse/redevelopment of two adjacent parcels. By aliowing for parking under one building to serve an adjacent building, a 60-unit senior rentai building will be built on a surtace parking lot, and an historic office/warehouse building wiil be converted to 50 units of loft ownership housing. Approval of the proposed subdivision will facilitate compatible development of the surrounding area. 4. The subdivision is in conformance with the comprehensive p(an. This condition is met. Redevelopment of the North Quadrant as a mixed-use urban village is called for in the Land Use Plan. It is also supported by the Saint Paul on the Mississippi Development Framework and the North Quadrant Precinct Plan. 5. The subdivision preseives and incorporates the site's important existing natural features, whenever possible. This condition is met. The site is a block in downtown Saint Paui that has no remaining naturai features. In fact, in conjunction with conversion of the Workforce Center building to ownership housing, a landscaped courtyard will be built, bringing much-needed green to the block, and tying it in with Wacouta Commons (a new City park) to the south. 6. AlI land intended for building sites can be used safely without endangering the residents by peril from floods, erosion, continuously high water table, severe soil conditions or other menace. This condition is met, as none of these occur on the site. 7. The subdivision can be economically served with public facilities and services. This condition is met. The site is located in a fully-built-up part of downtown, and is well- served by public facilities and services. I. STAFF RECOMMENDATION: Based on required findings 1-7 above, staff recommends approval of the registered land survey for the block bounded by 9�', Sibley, 10` and Wacouta streets subject to the following conditions: 1. The applicant shall file a copy of the Councii Resolution approving the registered land survey with the Ramsey County Recorder's Office. 2.
