the east addition line of said JACKSON AND BTDWELLS ADDITION TO WEST ST. PAUL;
and that part of Curtice Street as opened under an order of the Common Council
June 8, 1889 and as recorded in the Ramsey County Recorder's Office.

15 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
16 Saint Paul Legislative Code as amended, and to the following conditions:

19 1. That the petitioner's, their successars and assigns shall pay $1,200.00 as an administrative fee for
20 this vacation which is due and payable within 60 days of the effecUve date of this resolution.

That a permanent utility easement shall be retained within the vacated area to protect the interest
of Xcel Energy (Electric) over, under and across the west 160 feet of the north 10 feet of the area
to be vacated and any re-platting of easements shall provide service to the property at766 Curtice.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Xcel Energy (Gas Division) for accessing existing facilities.
That a permanent utility easement shall be retained within the vacated azeas to protect the interest
of Qwest CorporaUon for accessing existing facilities.

3 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
4 brought as a result of injuries or damages received or sustained by any person, persons or

6 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
7 because of any claims or liability arising from any violation of any law or regulation made in
8 accordance with the law, whether by the petitioners or any of their agents or employees.

We are not specificaily opposed to a vacation or subdivison but the pian for the construction is not
approved.
Paul, this is a repeat of this mornings email with a littie more info.
Juan, Paul, Tom,
This brings up another good point. Had these 3 issues, site pian, subdivision and vacation come up on a
longer time frame it could have created a problem with the owners getting some of the 3 approved but not
others. This would make the city look bad, or at least contuse the matter. I continue to maintain when
applicable afi 3 processes shoufd be done in one citywide process. Never mind the repeated work by the
several city divisions that cross on some or all of these 3 processes. I'm just glad I remembered the first
one (site plan) before getting into the subdivision and vacation.

Bohlen Surveying & Engineering, Inc. has prepared the legal description for the vacation of
Curtice SU to assist the platting of the Hall Avenue housing development in the southeast
corner of Hall Avenue and Curtice Street in St. Paul. The Curtice Street right-of-way does
not currently contain a public street or public utilities.
The following is the legal description of the Curtice Street right-of-way to be vacated:
Curtice Street east of Hall Avenue and west of Humboldt Avenue.
Attached is a copy of the City section map, a map of the Curtice Street right-of-way and the
area to be developed. Please note that Parcel A will go to Harold Dokmo, fee owner, Pazcel
B will go to Matthew Monzel, fee owner and Parcel C will go to Mark Gergen, fee owner.
All fees related to the vacation process will be paid by Mark Gergen & Associates, fee owner
of 766 Hall Avenue.
Site plans for the 7b6 Hall Avenue pazcel are also included in this submittal. Building pads
12 and 13 are located on the Curtice Street right-of-way (Parcel C). Trees will be removed
and grade will be altered to accommodate the construction of units 12 and 13 (assuming City
of St. Paul approval of this site plan.).
