WHEREAS, a Notice of Violation was sent on October 29, 2003, to the owner/manager of Twin Star
VFW Post 8854 d/b/a Twin Star VFW Post 8854, located at 820 Concordia Avenue in St. Paul (License ID#
0057268) alleging failure to provide a membership and guest log book and in violation of Minn. Stat. §
340A.404, Subd. 1(4) prohibiting a club from selling alcohol to anyone other than a member or bona fide guest;
and
WHEREAS, the Licensee responded by letter dated November 4, 2003, requesting a hearing before the
City Council for a public hearing to argue the penalty recommendation; and
WHEREAS, the recommendarion of the Office of License, Inspections and Environmental Protection,
which was contained in the Notice of Violation sent to the licensee, is for a fine of $1,000.00, with $500.00 of
the fine being stayed for a period of eighteen months on the condition that the remainder of the $500.00 fine be
paid within thirty days and that the licensee immediately begin keeping membership and guest log books in a
readable format, to be approved by the Office of LIEP; now, therefore be it
RESOLVED, that Twin Staz VFW Post 8854 d/b/a Twin Star VFW Post 8854, located at 820 Concordia
Avenue in Saint Paul (License ID# 0057268) is hereby ordered to pay a fine of $1,000.00 for the failure to
provide a,�tne�ership and guest log book and for selling alcohol to someone other than a member or bona fide

Please take notice that this matter has been set on the Public Hearing Agenda for the City
Council meeting scheduled for 5:30 p.m., Wednesday, December 17, 2003 in the City Council
Chambers, Third Floor, Saint Paul City Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested matter in that the
facts concerning the failure to maintain a membership and guest log book and for selling alcohol
to someone other than a member or bona fide guest have not been denied. Per your request, this
matter has been placed on the public hearing agenda portion of the City Council meeting, during
which public discussion is allowed. The recommendation ofthe license office is for a$1,000.00
fine with $SOO.OQ of the fine suspended for a period of 18 months on the condition that: 1) you

Dear Sir/Madam:
The Director of the Office oF License, Inspections and Environmental Protection will recommend
that adverse action be taken against your licenses based on the following information:
On May 25, 2003, Saint Paul Police Of�cers observed an
individual inside of the Twin Star VFW who they believed to
be dealing drugs. While investigating, they saw the individual,
later identified as Phillip Jermaine Benson, drinking an
alcoholic beverage. Benson is not a listed member of the Twin
Star VFW. When asked to produce a membership and guest
book, the logs appear to be virtually unreadable and contain
no real information on the guests, but there is no name
corresponding to Mr. Benson's on the guest log. Minn. Stat. §
340 A. 404, subd. 1(4) prohibits a club from selling alcohol to
anyone other than a member or bona fide guest.
Since this is your first violation, the licensing office will recommend a$1,000.00 fine, with
$500.00 of the fine stayed for a period of eighteen months on the condition that you: 1) pay $500
of the fine; and 2) immediately begin keeping membership and guest logs in a readable format, to
be approved by the Office of LIEP.
If you do not dispute the above facts, but wish to have a hearing before the Saint Paul
City Council to discuss the appropriate penalty, you will need to send me a letter with a statement

admitting the violations and requesting a hearin� by Wednesday, November 5, 2003. The matter
will then be scheduled before the City Councit for a public hearing to determine what penalty, if
any, to impose. You will have an opportunity to appeaz before the Council and make a statement
on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearin� will be scheduled before an Administrative
Law Jud�e. At that hearin� both you and the City will be able to appear and present witnesses,
evidence, and cross-examine the o[her's witnesses. The St. Paul City Council will ultimately
decide the case. Please let me know in writing no later than November 5, 2003 how you wish to
proceed.
If you have not contacted me by November 5, 2003, I will assume that you are not
contesting the facts and will schedule this matter for a hearing before the City Council for a
consent agenda, at which time the recommended penalty will be imposed.

SQUAD 190 (ARNOLD/DONAHUE) MET WITH A CONFIDENTIAL RELIABLE INFORMANT EARLIER TODAY
DURING OUR TOUR IN RESPONSE TO COMMUNITY COMPLAINTS OF NARCOTICS TRAFFICKING IN
AND AROUND THE VFW AT 820 CONCORDIA.
WE EXPLAINED TO THE CRI THAT WE HAVE BEEN HEARING SEVERAL COMPLAINTS OF PEOPLE
SELLING CRACK AT THE BAR AND HAVE NOTICED DRUG ACTIVITY THERE OURSELVES AND
REQUESTED THAT THE CRI ASSIST US IN IDENTIFING WHO THE DEALERS ARE AND WHEN THEY MAY
BE IN POSSESSION OF C/S. THE CRI AGREED TO HELP US OUT WITH THIS. IN ADDITION TO THAT
THE CRI TOLD US THAT A"LITTLE PHIL" WAS IN THE BAR ALL THE TIME AND WAS ALWAYS SELLING
CRACK. I HAVE WORKED THE AREA FOR 15 YEARS AND IN THAT TIME I HAVE LEARNED THE NAMES
AND NICKNAMES OF SEVERAL OF THE PEOPLE IN THE AREA. THE "LITTLE PHIL" THAT I KNOW THAT
HANGS AROUND THE VFW IS BENSON, PHILLIP JERMAINE, 09-14-74. I KNOW HIM TO GO BY THE
NAME OF "LITTLE PHIL" AND ALSO "PEE WEE". BUT TO BE SURE WE WERE TALKING ABOUT THE
SAME PERSON, I ASKED THE CRI WHAT "LITTLE PHIL" DROVE. HE TOLD ME A GREEN VAN WITH A
WHEELCHAIR LIFT OR SOMETHING LIKE THAT IN THE BACK. I KNOW THAT BENSON DRIVES, ALONG
WITH HIS WIFE, A GREEN VAN WITH THE LIFT IN THE BACK AS THEY HAVE A CHILD WITH SOME SORT
OF HANDICAP. I KNOW THIS BECAUSE I HAVE CITED HIM ON A COUPLE OF OCCASIONS DRIVING
THIS VEHICLE.
TONIGHT AT ABOUT 0140 HRS WE AGAIN SPOKE TO THE CRI. THE CRI TOLD US THAT BENSON WAS
INSIDE THE VFW AND WAS SHOOTING DARTS RIGHT NOW. THE CRI SAID THAT BENSON WAS
WEARING A WHITE T-SHIRT AND BLUE JEANS AND ALSO HAD A WHITE HEADBAND ON. THE CRI
STATED THAT BENSON WAS DEALING CRACK AND HAD IT ON HIM RIGHT NOW. WE WENT TO THE
BAR AND WALKED IN THE DOOR. THE DART BOARD IS JUST INSIDE THE DOOR TO THE RIGHT AND
THE PEOPLE THROWING THE DARTS STAND ABOUT 10 TO 15 FT INSIDE OF THE FRONT DOOR. WE
SAW SENSOIV STANDING THERE WITH DARTS IN HIS NAND AND IN THE PROCESS OF THROWiNG
ONE. HE WAS WEARING A WHITE T-SHIRT, BLUE JEANS, AND THE W I HEADBAND MATCHING THE
DESCRIPTION GIVEN TO US BY THE CRI. I APPROACHED _���IM,�$�ClVY�T� �� 'SPEAK TO
HIM OUTSIDE OF THE BAR. HE SAID "OK" AND THEN PIC LL TAB BOOTH
AND STOOD THERE SIPPING ON IT. AFTER A COUPLE OF�d.II���� ��HIM TO STEP
OUTSIDE SO WE COULD TALK. HE NOW APPEARED TO� � �L �i�US AND SAID " WHAT DO
YOUR WANT TO TALK TO ME ABOUT?". I TOLD HIM I WAS'fV�GOING TO TALK TO HIM IN THE BAR
THAT HE NEEDED TO COME OUTSIDE WITH US. HE SAID HE WAS NOT GOING TO GO OUTSIDE
WITHOUT A LAWYER. I TOLD HIM HE DIDN'T HAVE A CHOICE. HE REPLIED "CAN I DISCUSS IT WITH

MY WIFE FIRST? I SAID NO HE NEEDED TO COME OUTSIDE THE BAR RIGHT NOW WITH US. HE
TURNED AND STARTED TO WALK INTO THE LARGE CROWD THAT WAS INSIDE OF THE BAR. I
GRABBED HIM BY THE ARM AND STARTED TO PULL HIM TOWARD THE DOOR AND HE WAS GIVING
ME SLIGHT RESISTANCE UNTIL I GOT HIM TO THE DOOR WHERE OFFICER DONAHUE WAS
STANDING. AS WE WALKED INTO THE ENTRY WAY BENSON TRIED TO REACH INTO HIS BACK
POCKET. I PULLED HIS HAND AWAY AND HE THEN STARTED TO REACH lNTO HIS LEFT FRONT
POCKET AND I PULLED HIS HAND AWAY AGAIN. NOW OFFICER DONAHUE GRABBED AHOLD OF HIS
RIGHT ARM AND I HAD HIS LEFT AND HE BEGAN TO STRUGGLE AND WRESTLE WITH US. HE DID THIS
OUT ONTO THE SIDEWALK WHERE OFFICER DARGAY WAS PULLING UP IN HIS CAR AND JUMPED
OUT TO ASSIST US WHEN HE SAW US WRESTLING WITH BENSON. WE TOOK HIM TO THE GROUND
AND HANDCUFFED HIM. AT THIS TIME I RECOVERED 2 CHUNKS OF MARIJUANA FROM HIS LEFT REAR
PANTS POCKET AND A PLASTIC BAGGIE CONTAINING ONE LARGE ROCK AND SEVERAL CRUMBS OF
WHAT APPEARED TO BE CRACK COCAINE. IN HIS RIGHT FRONT PANTS POCKET HE HAD $428.00 IN
CASH THAT WAS ALSO RECOVERED.
OFFICER DARGAY TRAiVSPORTED HIM TO HQ FOR US AS WE WERE ON BIKES.
AT HQ THE MONEY WAS TURNED INTO ML #2 HE WAS ISSUED A NOTICE OF FORFEITURE FOR THIS.
THE MARIJUANA AND CRACK WAS TURNED INTO NL#65 FOR CS TESTING.
W E SPOKE TO THE WATCH COMMANDER, MOORHEAD, AND RECEIVED PERMISSION TO STRIP
SEARCH BENSON IN ATTEMPT TO RECOVER MORE NARCOTICS IF HE HAD SOME OTHERS IN HIS
POSSESSION. WE DID THIS WITH NEGATIVE RESULTS.
BENSON WAS BOOKED INTO THE JAIL ANNEX FOR POSSESSION OF C/S.
DURING THE STRUGGLE OFFICER DONAHUES BIKE SHORTS WERE RIPPED.
On the above date I, Officer Grahek of the Narcotics Unit reviewed this case. No interview was conducted of
Benson, Phiilip Jermaine 09-14-74 due to the fact he referenced wanted to talk to a lawyer before speaking to
Officer Arnold.
While reviewing the case it was discovered that the seizure notice given to Mr. Benson was for an impaired
driver. I reissued the seizure notice on the narcotics seizure form. This notice was given to Mr. Benson at the
Ramsey County Jail Annex.
While working on the case, Officer Pat Scatt asked me to do a judicial detainer on Mr. Benson. This request
was forwarded from the arresting officer - Officer Arnold. Mr. Benson has a long criminal history. Mr. Benson
also fought with the officer in a crowded bar in an attempt to avoid being arrested.
The judiciai detainer request was left with the Watch Commander for review by the signing Judge.

Than you for providing the list of inembers in response to my letter of June 19, 2003. As
I previously indicated, we ue looking at a narcotics arrest that took place at the Twin Star VFW
on May 25, 2003. The police report regarding the incident indicates that an individual identified
as Phillip Jermaine Benson, DOB 9-14-74, was present and drinking in the VPW when he was
anested for suspicion of narcotics.
As you know, your license only permits the sale or service of alcohol to members and
bona fide guests. Because Mr. Benson is not listed as a member, I am writing to ask if you can
provide copies of the portion of the log book you keep to record members and guests which
would show that he was, in fact, a bona fide guest at the time of his arrest.
