This is written in response to the appeal of Virgil A.
Doerfler to relax the density requirements on property
located on the southeast corner of East Magnolia Avenue and
Van Dyke Street. This property is further described as:
Lots 13-15, Block 2, Hazel
Park Plat "B".
This matter was before a public hearing of the Board of
Zoning on February 18, 1971. The staff reported that no
practical hardship had been shown. The staff explained that
for 12 units, a 1ot size of 15,000 square feet is required,
and this parcel is 324.34 square feet or 2.16% short of the
requirement.
In response to a question from the Board, Mr. Doerfler,
the appellant, said he would have enough room for the parking
spaces required for 12 dwelling units.
The Board heard a motion to recommend approval. The
motion was seconded and passed by a 4-0 vote.

A. HISTORY: A parking lot plan for this site providing for a 1:1 parking ratio was
submitted seeking administrative approval on 7/13/70. It was withdrawn wt�en it
was determined that a building permit could °zot be granted before the revised
parking ratio requirement went into effect. There is no rezoning history for
this si.te.
B. PROPOSAL: The aj�plicant proposes to build a 12-unit a}�artment building on the
site.
C. NEED FOR APPEAL: No practical difficulty has been shown.
D. PRESENT STANDARD: In a "C" Residential or less-restrictive district, a 12-unit
apartment requires a lot size of 15,000 aquare feet.
E. VARIANGI;: This parcel has a frontage of 118 feet on Magnolia Avenue and 124.37
feet on Van Dyke Street for an area of 14,675.66 square feet, 324.34 square feet
(2.16%) short of the required 15,000 square [eet.
F. AREA ZONING: The area north of Magnolia Avenue is zoned Heavy Industry. The area
adjoining this site southward to Mechanic Avenue is zoned Light Industry. The
area so�zth of Mechanic Avem�e is °'A" Residence. The C�mprehensive Plan ca11s for
single-family decelopment a_ 6 dwelling units per acre for this area.
G. AREA COTIDITIONS: Multi-family uses adjoin this site to the east and across the
street to the west, Mixed -esidential uses exist south with vacant land northward
to the Soo Line tracka. Beyond the tracks is Hazel Park Junior High School.
H. SITE CONDITIONS: The parce?. is flat, vacant, and apprc�ximately at street grade.

This matter was heard at the Board of Zoning meeting of
February 18, 1971, at which time the staff reported that
revised plans are being requested which makes better use of
the open space.
Mr. Doerfler, the applicant, approved the suggested plan
and said he would submit final plans incorporating the revised
arrangement.
No one appeared in opposition to this matter.
The Board heard a motion to recommend approval. The
motion was seconded and carried by a 4-0 vote.
Subsequently, final plans as requested have been received.

VIIiGIL Ao DOERFLER: An application for a permit to instell 8 63-car parking
lot to be used ia con�unction with two apartment buildinga on property
located on the northeast corner of Eest Magnolia Avenue and Van Dyke Sereeto
Mr. Rosetter presented a site plan to the Board thst was originally submitted
by the applicant. He noted that he drew a different one with a change in the
open-apace area. The staff coaferred with Che applicant, who seemed to be in
favor of the change.
Mr. Doerfler, the applicant, noted he will submit revised plans incorporating
the changes indicated by the ataff. The new plan will have one less parking
space than the original proposal, but will still have the req�sired amount.
When she drove by the site a few days ago, Mrs. Cochrane said ahe not�ced all
the cara that were parked on the street. Mr, Doerfler said there is adequate
parking for the apartnn�nt tenants, yet they atill choose to psrt on the atreeto
Mrs. Cochrane moved for approval of the permit. `The motion was seconded by
Mr, Meiettsy and carried unanimously.
