PURPOSE: Subdivision by lot split to create two parcels, with a variance of the requirement to plat previously unplatted land. PARCEL SIZE: 4,700 sq. ft. C. EXISTING LAND USE: industrial uses D. SURROUNDING LAND USE: The site is surrounded by industriai uses E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1) creates five or more lots or parcels each of which is 2'/2 acres or less in size, or (2) requires paved streets, alleys and other public improvements, o.r (3) is previously unplatted land. §67.304 lists conditions for lot splits and adjustments of common boundaries. §67.406 provides criteria for review of subdivision applications. These criteria are covered below under "Required Findings." §67.703 gives the City Council the authority to grant variances from the subdivision regulations and sets criteria for variances. '� H. HISTORY/DISCUSSION: none DISTRICT COUNCIL RECOMMENDATION: None received. FINDINGS: 1. Jason's Dry Ice wishes to purchase 4,700 sq. ft. of land adjoining their site from M T Properties, inc. to use for parking. • 2. Sec. 67.304. Approval of lot spiifs and adjustments of common boundaries. Lot splits and adjustmenfs of common boundaries are permitted without plafting, provided the following conditions are met: (1) The Iot or lots have frontage on an existing improved street and access fo municipal services. (2) The lot or lots to be divided are previously Zoning File # 03-357-158 City Council Staff Report page 2 platted land. (3) The lof or lots meet the minimum standards for lot width and area for the zoning district in which they are Iocated. (4) The division of the /ofs shall not cause a remainrng part of a lot fo become a separately described tracf which does not meet the minimum standards of the zoning district in which it is located or which does nof have streef irontage and access to municipal services. (5) The division does not resu(t in a split zoning classification on a single lot. (6) The division does not result in the creation of a nonconforming structure or use. Ail conditions are met except condition 2. The applicant needs a variance of condition 2 to avoid platting. The findings that must be made to approve the variance are listed in finding 4. 3. § 67.406 of the Zoning Code requires that all of the following findings shall be made prior to approval of a subdivision: (1) All the applicable provisions of the Legislative Code are compiied with. City staff have reviewed the proposed lot split and have determined that all applicable provisions of city codes are met. (2) The proposed subdivision will not be detrimenta! fo the present and potential surrounding land uses. The proposed lot split is consistent with the surrounding land uses, and will not be detrimental to present and future use of surrounding land. � (3) The area su�rounding the subdivision can be planned and developed in � coordination and compatibility wrth the proposed subdivision. The area surrounding the proposed lot spiit is already developed and compatible with the proposed lot split. (4) The subdivision is in conformance with fhe comprehensive plan. The subdivision is in conformance with the land use chapter of the comprehensive plan, which calis for industriai uses. (5) The subdivision preserves and incorporates the site's rmportant existing natural features whenever possible. The site is in a fully-developed part of St. Paul with no remaining naturai features. (6) Ai/ land intended for building sites can be used safely without endangering residents by peril from floods, erosion, continuously high water table, severe soil conditions or other menace. The site is a flat, fully developed area with no flooding, erosion, high water table or soil condition problems. (7) The subdivision can be economically served with public facilities and services. The subdivision is served with public facilities and services from surrounding streets. 4. The applicant is requesting a variance of the requirement in Sec. 67.301(3) and Sec. 67.304(2) to piat previously unplatted land. Sec. 67.703 Variances states that the city council may grant a variance to the subdivision regulations when compliance would create an unusual hardship to the development of the land, based on findings that: • (1) The intent of this chapter is met; (2) The granting of the variance will not be detrimental to the public safefy, heaith or welfare or injurious to other property or improvements in the neighborhood in which the property is located; (3) The conditions b3 - llDa Zoning File # 03-357-158 • Cily Council Staff Report page 3 upon whrch fhe request for a variance is based are unique to the property for which the variance is sought and are generally not applicable to other property; (4J The literal interpretafion of the provisions of fhis chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district,� (5) The special condifions and circumstances do not result from the actions of fhe applicant; and (6) Because of the parficular natural surroundings, shape or fopographica! conditions of the specific properfy involved, unusual hardship to fhe owner would result as distinguished from a mere inconvenience, if fhe sfrict lefter of these regulafions were carried out. The conditions are met. The variance requested is due to a unique circumstance in which the owner of Jason's Dry Ice is seeking to add parking to his triangular lot. Platting is generally intended for large, multi-lot subdivisions where lots will be sold and new development will take place. Platting is unreasonable at this time when no new development will occur, and the area involved is small. Platting will be necessary if and when a future change in ownership for redeveiopment occurs, and should occur at that time. 1. STAFF RECOMMENDATION: Based on required findings 1 through 4, staff recommends approval of the lot split proposed by Jason's Dry Ice with variance of the requirement to plat previously unplatted land at the �orthwest corner of Charles Street extended and Transfer Road, subject to the condition that the applicant shall file a copy of the Council Resolution � approving the lot split with the Ramsey County Recorder's Office.
