Dear Sir:
This is written in response to the appeal and application of Skyline Builders
to: 1) Relax the setback and 8-foot buffer requirements, and 2) Install a 172-car
parking lot to be used in conjunction with an apartment project on property located
on the west side of Hazelwood Street between East Maryland and East Ivy Avenues.
This property is further described as:
Lots 2-S, B`lock 3, Rogers and Hendricks ' Acre Lots
No. 2, except the north 101 feet thereof.
These matters were heard at the February 18, 1971, Board of Zoning meeting,
at which time the staff reported that except for this property, the frontage along
Hazelwood Street is zoned "A" Residential for which the Zoning Code requires a
setback of 20% of the depth of the lot. It was explained that if the zoning of
this entire frontage was "C" Residential, the required setback on this property
would be 10% of the depth of the lot. The lots on this site have a depth of
approximately 300 feet, requiring a setback of 60 feet. The staff pointed out that
a 300-foot lot is unusually deep and that normal lot depth is about 135 feet. The
setback under those circumstances would be 27 feet. The applicant is requesting a
12-foot setback. Regarding the building proposed along Hazelwood, the staff noted
its unusual length which tends to augment the visual effect of the minimal setback.
Mr. Terrance 0'Toole, attorney for the applicant, explained that the applicant
owns property for a distance of 101 feet north of the site. This property is zoned
"A" Residential and the applicant wants to build his parking lot up to it. He said
the applicant's plan is thought to be the best way to lay out the buildings, and
they couldn't cut down the size of the buildings and still provide the same number
of units. Mr. 0'Toole said that all the single-family structures built along the
street have 10-foot side yards. Regarding the use of the 101 feet north of the site,
Mr. 0'Toole said that the applicant agreed at the time of the rezoning to maintain it
as a buffer zone. Another representative of the applicant said that they are
uncommittal at this time as to the exact use of that property.
Mr. Melvin Schramm, a resident of the area, opposed the proposal, saying that
his experience on the Fire Department suggests to him that this plan would make it
difficult to get fire-fighting equipment onto the premises.
Mrs. Melvin Schramm opposed the proposal saying that apartment owners should
abide by the law as well as single-family home owners. She said this type of
development forces out single-family home owners. She questioned the adequacy of
the parking ratio standard and claimed that the proposed buildings could be made
smaller to provide more open space.

A number of other area residents also objected to the proposal on the grounds
that it would "crowd" their property.
As the Board discussed this matter, it was noted that if a street had been
platted through between Barclay and Hazelwood, the lot depth would be half what it
is now. It was also noted that the applicant is within density standards and is
providing the amount of parking spaces prescribed by the Zoning Code. It was
pointed out that only one dwelling fronts on this side of Hazelwood, and that the
rest of the block to the south is a cemetery. The relevancy of the present setback
standard was questioned. It was noted that the setback for a lot of normal depth
would be 27 feet. The justification for the variance requested was questioned.
Regarding the area to the north of the site, it was suggested that a condition could
be attached to a recommendation of approval which would establish this property as
a buffer.
Subsequently, the Board heard a motion to recommend approval of the appeal and
the permit because of the depth of the lots, because there is no established building
conformity, and no homes presently facing Hazelwood Street on this block, and because
the cemetery exists south of the site. The. motion was seconded and passed by a vote
of 3-1.

The �ots under considerstion have a depth of epproximately 30�1 �eet, requiring
a setback of 60 feet. Yf the zoniug of this en�tire �roatage c��s "C" Besidence,

to the Board and interested residents. Mrb Terrance 0'Toole, at2oraey �or the

there are 2 pieces of land-locked property. Mr, Mansur said the parking lot
conforms to the design ataadards of the City and haa the appr4val of the

Mro Rosetter indicated that the ataff has worlr.ed ou� a way that � 30-foot
setback could be provided, placing the parking lat i�r. the middie of the
propertye Oae drawback might be that one building w�uld have to be built on
fill rather than placing the parking lot on filled lsn�i.
Capt�in Melvia Schrsma� of the Fire Department ssid ti2a� with u�i��er driving
conditions in Minaesota, getting a fire rig into that type of apartment parking
lot ia absolutely impossible, The buiLdings should be conseructed to eaable
firefighting apparatus to obtain access. He noted the applic�nt is proposing
a slum 10 yeara from now.

lot, accordfng to the apaztmeat engineer. Captain Schramnn said that Captain
Kea Anderson of the Police Traffic and Aceident Section hasn°t had time to
review this particular situation yet.
Speaking for the neighbors in opposition w�s Mrse Melnia Schramm, 1526 Bast
Ivy Aveaue. She aaid ahe feels strongly that the Zoning Board representa the
people of St. Paul, end said the developer has onlq one thing in mind, which
ia money. �esidents hane to live in Che area; the applicant is �orcing the
single-family owners ouL. To explain the rezoniag petition, Mrs. Schraumn
sai8 it was signed by oue person in ehe process o€ s�llin.g his hom�, and two
cemetery owaers. Acroas the streeC from the propo8�t1 is an �partment complex
owned by the same applicant, Skyliae Builders. She said another man was
"forced" to sign the petition since his job was thr�eateaed by the petitioner.
That man has since moved out of the ares. The people that are Ieft in the
area �re verq concerned people. She sa�.d that if single-family owners must
abide by the law, apart�nent o�nners should also have to con£arm to the law,

the plans on psper, since in reality the development will look so much

area being used. for buffer purposes. A representative of the applicant said
they are non-committal at this time. They inveatigated the possibility of
FHA financing, and maybe the buffer would be used for 8 playground or someChi�g
aimilar.
Mr, Manaur said thaC perhaps a condition could be attached to this approvaly
to establish a buffer on that part of the property. Mr, 0'Toole replied that
the applicanC agreed at the time of the rezoning to maint�in it as a buffes
area.
Mxa� Schra� said that a plaqground for the �p�rtmen�s would cut into the
backyards of the residential homes.
Since she feels ad�oining homes should not be crowded, Mrao Cochrane asked why
this appeal is necessary. Mre Ames repli�d that the densiCy requirements are
being met, and that about 8 more anita would be allowed under the "C11 Residence
zoningo Mreo Cochrsne asked if there would be enough room for psrking if the
applicant constructed the allowed 8 additional units. Mro Brown said it is the
ataff's opinion that they probably could not provide Che park�ngp si�ce Che
present plan proposes stalls 8� feet wide. Thi� mee�s the minimisnn design

Upon a question by Mr, Mansur, Mr, Brown said the Tr�ffic Engineer is c�nce�aed
with ingress and egress froia the street; he noted th�t in gon�e instancesA the
Traffic Engineer looks at the whole area, but in this c�sen the �rafffc Engineer
knows that the majoriCy of the traffic would g� down H�zelwood ta M�rylan�

Mr, Ames pointed out that Capt�in Schramm of the Fire Department feels th�y
should review this proposal, Captain Schraua� replied that small apartmen�
bufldings around town are getting by with inadequ�cies, but a development of
this size needs further review.
A woman from the neighborhaod asked i£ a parki�g 1oe runs up eo the proper�y
line, would a fence be required. Mr, Ames replied that bumper ar wheel atops
are the only requirement.
Captain Schramm questioned whether it i� legal to use, the 10� fe�2 on the
northerly end of the property as a playground, sinc� � buffer z��� is supposed

Becauae of the depth of these lots, Mr, Maietta felt the setback requirement
was uareasonable; and since there is no established physical conforanity and
ao homea facing Hazelwood on thia block becauae the cemetery runa �long
there, Mr. Maiett8 moved for approvel of Che appeal and permit. The motion
wss secoaded by Mre Manse�r, who noted th� buffer zone to the norgh, and in
view of the traffic pattern being approved, he feels Captain Schra� should
bring thia to the attention of the City Council in regard to ingress and
egress, fire hydrants, etc. The motion ca�rried by a 3-1 vote, with
Mrs. Cochrane casting a dissenting vote.
