RESOLUTION ADOPTING FINDINGS OF FACT RELATED TO STRUCTURALLY
SUBSTANDARD BUILDINGS LOCATED IN PROPOSED FUTURE KOCH MOBIL TAX
INCREMENT FINANCING DISTRICT

WHEREAS, the City of Saint Paul (the "City") has been advised that the Housing and Redevelopment
Authority of the City of Saint Paul, Minnesota (the "Authorit}�') intends to establish a redevelopment tax
increment financing district in the area generally bounded by West Seventh Street, Otto Avenue, Shepard
Road and the Crosby Lake Business Park (the "DistricY'); and
10 WHEREAS, prior to certification of the District, the City Council of the City of Saint Paul (the "City
11 Council") is required to make the findings required by Minnesota Statutes Section 469.175, Subdivision 3,
12 including the reasons and facts supporting the determination that the District meets the statutory requirements
13 for a redevelopment dishict; and

15 WHEREAS, the City has been further advised that, prior to certification of the District, and for health and
16 safety reasons, the Authority intends to demolish two residential buildings currently located on two parcels to
17 be included in the District, which buildings are located at 764 Otto and 1534 Adrian Street, St Paul, Mn (the

`Buildings"); and
WHEREAS, as set forth in its Resolution adopted by the Authority on December 10, 2003 (the "Authority
Resolution") the Authority has determined that the Buildings are "structurally substandard" within the
meaning of Minnesota Statutes, Section 469.174, subdivision 10; and
WHEREAS, the City Council, in reliance on the information provided to it by the Authority, including but
not limited to the November 24, 2003 report prepared by Short Elliot Hendrickson, Inc. ("SEH Report"), and
on its own investigation, concurs with the Authority's determination that the Buildings are "structurally
substandard" within the meaning of Minnesota Statutes, Section 469.174, subdivision 10; and
WHEREAS, the purpose of this action is to set forth the factual findings of the City Council befare the
Buildings aze demolished, which factual fmding may then be relied on by the City Council at such time as the
City Council considers whether the proposed District, as a whole, meets the statutory requirements of a
redevelopment district;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saint Paul that, on the basis
of information provided to it by the Authority, including the SEH Report, and its own investigation, the City
Council finds that the Buildings are "structurally substandard" within the meaning of Minnesota Statutes,
Section 469.174, subdivision 10.
