� ��''��s is written in response to the appeal of the Northwestern
nell Telephone Company to permit an addition to an existing telephone
building in an "A" Residence District on property located on the
southwest corner of South Fairview and Juliet Avenues. This property
is further described as:
Lots 1 and 2, Block 2, Juliet Place.
This matter was first heard on March 4, 1971, as a proposed
amendment at which time the Zoning Administrator indicated that the
Telephone Company's proposed expansion could be accomplished without
a rezoning by appealing under Section 64.03 (g) of the Zoning Code,
which states that the City Council can authorize the construction of
a utilities building in any zoning district. The Zoning Administrator
judged that section to still be valid even though the 1965 State
Enabling Legislation invalidated other appeals sections of the Code.
At this hearing, the Board discussed the proposed plans with
Telephone Company representatives and agreed to hear the matter as
an appeal.
This matter was heard as an appeal at the April 1, 1971, Board of
Zoning meeting, at which time the staff reviewed the written staff report.
The Board discussed the proposed expansion with Telephone Company
representatives. The possibility of providing internal parking for
employees under the proposed structure was discussed.
Subsequently, a motion was heard to recommend approval. The motion
was seconded and passed by a vote of 5-0.

The Northwestern Bell Telephone Company located at 70 W. 4th St.
St. Paul , Minnesota, telephone number 221-5955, is submitting this
zoning appeal for your consideration.
The legal description of the property is:
1822 Juliet - Lot 1 - Block 2 - Juliet Place
1826 Juliet - Lot 2 - Block 2 - Juliet Place
The property is located on the South-West corner of South Fairview
Avenue and Juliet Avenue.
At the present time there are two houses on the property owned by
the Northwestern Bell Telephone Company.
This property is to be used for a proposed building addition to the
existing telephone exchange building abutting South of the property.
This appeal is made under Legislative Code, Chapter 6403, paragraph G.
The new building addition will have brick facing, tile roof, and
copper overhang, and will be designed to be compatible with the existing
structure.
The building addition will house telephone equipment to serve that
area of St. Paul , and will not involve large numbers of employees or
create parking problems. The average number of employees working in the
building will be about six.

A. ZONING ADMINISTRATOR: The Zoning Administrator judged that the legal opinion of
3/6/68 which held invalid certain appeal sections of the Zoning Code which provide
for extensions of use did not invalidate Section 64.03(g) which grants Council the
power to allow by appeal a utilities building in any district.
B. HISTORY: Two appeals to enlarge the telephone building on the adjoining property
were granted by the City Council i.n 1926 and in 1961. A petition to rezone this
property was withdrawn on 3/25/71 after it was decided to request authorization to
expand telephone company facilities on this site by means of appeal.
C. PROPOSAL: The Northwestern Bell Telephone Company proposes to construct an
addition to the existing building on the property under consideration.
D. PRESENT STANDARD: Utility buildings such as the type proposed are not automatically
authorized in a residential district.
E. VARIANCE: The appellant is requesting a variance from the limitations imposed by
the Zoning Code as to the type of land use permitted.
�. AREA ZONING: This and the surrounding area is zoned "A" Residence.
G. SITE CONDITIONS: The site is developed with two single-family residences fronting
on Juliet Avenue.
H. AREA CONDITIONS: The surrounding area is developed with single-family residences
except for the existing telephone building. Fairview Avenue is a collector street
with a high traffic count.

I�ro Rosetter pointed out thst this proposal had prevfously been on
file as e petition to rezone. Itowever, st a former 2oning Board
meeting it was decided that th� rezoning petition should be withdrawn
and fr�Ilowed by an appeal ta permit this use.
Mr. Ames noted that u�ader ?,oni.ng Code Chapter 64.03 (g� there is a provision
to permit a puolic utiLity building in any zoning district, thereby
constituting a valid appeal, Mr. Ames read the appropri�te paragr�ph.
Mr. Rosetter su�mmarized the staff report, a part of the file, stating
that utility buildings such ms tha.s one sre not automaticaLly authorized
in a residential distr�ct. The surrounding area is developed with
single-family residences eKcept for the existi.ig telephone building.
Fairvfew Avenue is a collector street with a high traffic counto At
aresent, two residences stand on �:he lots proposed to be used for this
�ddition. The appell�ant has submitted a site plan, and they do nat tlave
any pla�n� giving a rendition of what the proposed building would lootc
like. Mre Rosetter suggested t:t.at peri�aps the xoard would pref�r �
condition that the building be significant�.y similar to the architectur�
of what is presently there. Another possible condition that would alleviate
some of the parking problems in the area would be far the appell.ant Co
install a 6-car parkin� Lot as it appears there would ta� room for one on
the property. Mr. Ames pointed out that at tk�e March 4, 1971, meeCing one
lady appeared on this matter, obviously opposed to �ny parking lot
installatfon on the land. She indicated at that publfc hearing tlx�t she
is neti opposed to an addition to the existing building, as long as the
zoning wouYd �emain "A" Residence.
Mr, Brown. of the staff explei�ted tl�at teleghone �r�ciuiries have come inCo
the staff's office noting opp�sir.ion to s parking lot.
Representing the appeal eaas Mro Co Vo Linci, who noted that most of tt�e time
the maximum number of cars at the present builditag is s�x. There is room
in the back of the existing buxlding for paricing.

Mrs. Cochrane asked if it would be possible to integrate underground
parking into the proposed buildin�. Mro Lind agreed that her idea is
a possibility but that the telephone company doesn't have any building
plans es yete The building is proposed to be constructed in 197?..
N:rse Cochrane noted that the grade of the sfte is above the street
almost to the exteat that a car could be driven in quite easily.
Mr. Ames said that with the six momths or so of inclement weather
that Minnesota faces, he feels the underground parking suggestioa ia
noteworthy. Mr. Lind agreed they will keep that snggestion in mind.
Mr. McPartlin moved for approval of the varfance. The motion was
seconded by Mr, Mansur, and carried unanimously.
