2 WIIEREAS, Chapter 293 of the Saint Paul I,egislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and

9 WHEREAS, the Saint Paul Festival and Heritage Foundarion, represented by Shannon Pierce, Director of
10 Operations, who has been designated as the responsible person on the application, has applied for a variance to
11 allow background music and a sounds and light show for the ice palace, Cleveland Cirlce, 155 7"` St. W.; and

13 WHEREAS, applicant is seeking a variance for the hours of 10:00 a.m. to 12:00 a.m. from January 22, 2004
14 through February 8, 2004; and

16 WHEREAS, if applicant is not granted a variance it will not be able to provide music ; and

18 WHEREAS, the Office of License, Inspecrions, and Environmental Protection has reviewed the applicarion
19 and has made recommendations regarding condirions for the variance; now, therefore, be it

21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the Saint Paul Fesrival
22 and Heritage Foundation, subject to the following conditions:

24 1) The variance shall be for the hours of 10:00 a.m. to 12:00 a.m. from January 22, 2004
25 through February 8, 2004

27 2) All speakers for both the background music and the eight minute sound and light
28 show shall be located within the ice palace structure.

2' 3) All electronically powered equipment used in conjunction with this event shall not
3 exceed 95 dBa as measured 100 feet from the exterior of the ice palace structure.

5 4) The applicant shall verify compliance with condition #3.

7 5) All electronically powered equipment, PA systems, loud speakers, amplified music or similar
8 devices shall be tumed off no later than 11:38 p.m. The background music within the ice palace
9 structure shall be turned off no later than midnight.

11 6) The City Council reserves the right to amend or revoke this variance based on any complaints
12 received or if any of the conditions set forth above aze violated.

Background Music for Ice Palace, Cleveland Circle
Attached is a sound level variance application from Shannon Pierce, representing the Saint
Paul Festival and Heritage Foundation, 75 West Fifth Street, 429 Landmark Center, Saint
Paul, 55102, to allow background music during the Winter Carnival, 155 7th St. W.
(Cleveland Circle). A variance is requested from 10:00 a.m. to 12:00 a.m. from January
22, 2004 to February 8, 2004.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 155 7th St. W.
