2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §29311 provides for the granting of variances from the sound level limitations contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hazdship on an applicant, other persons or on the community; and
8
9 WHEREAS, the Saint Paul Festival and Heritage Foundation, represented by Shannon Pierce, Director of
10 Operations, who has been designated as the responsible person on the applicarion, has applied for a variance to
11 allow ice harvesting on Lake Phalen, 1400 Phalen Drive; and
12
13 WHEREAS, applicant is seeking a variance for the hours of 7:00 a.m. to 11:00 p.m. from December 1, 2003
14 through January 20, 2004; and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to harvest ice; and
17
18 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
19 and has made recommendations regarding condirions for the variance; now, therefare, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby gants a variance to the Saint Paul Festival
22 and Heritage Foundation, subject to the following conditions:

24 1) The variance shall be far the hours of 7:00 am. to 11:00 pm. from December �8;
25 2003 through January 20, 2004 !

27 2) The Saint Paul Festival and Heritage Foundarion shall take all practical steps
28 available to minimize the noise levels during this period which do not otherwise
29 unduly hinder the project or unreasonably increase the costs of the project.

2 � 3) The City Council reserves the right to amend or revoke this variance based on any
�' complaints received if any of the conditions set forth above aze violated.

Ice Harvesting for Ice Palace, Lake Phalen
Attached is a sound level variance applicarion from Shannon Pierce, representing the Saint
Paul Festival and Heritage Foundation, 75 West Fifth Street, 429 Landmark Center, Saint
Paul, 55102, to allow ice harvesting on Lake Phalen, 1400 Phalen Park Drive. A variance
is requested from 9:00 a.m. to 11:00 p.m. from December 1, 2003 to January 20, 2004.
Enclosed is the copy of the Public Hearing Norice sent to property owners within 200 feet
of 1400 Phalen Park Drive.

This ls to inform you of a request for a variance from the sound level limitauons as indica[ed in the St. Paul
Noise Ordinance (Chapter 293 of the St. PaW Legislative Code).
A public hearing before the Ciry Council on this variance request will be held on:
