Ma.rshall City Clerk 386 City Hall St. Paul, Minnesota 55102 Dear Sir: This is written in response to the application of John H, White for a permit to install a 46-car customer parking lot on property located on the South- west corner of Dale Street and West Minnehaha Avenue, further described as Lots 1-4, Block 1, Syndicate No. 4 Addition. This matter was heard by the Board of Zoning on July 2, 1970, at which time the staff reported that the western portion of the existing lot was zoned "B" Residential. It was noted that in 1960, the Board of Zoning had recom- mended approval of a permit for a parking lot on this site subject to the submission of revised plans which met design standards, but later changed its recommendation to denial pending the submission of those plans. It was further noted that the present application under new ownership could not be allowed unless it is ruled to be a legal non-conforming use or until the western portion of the property was rezoned. A letter was read which indicated that the Public Works Department was not interested in the property for the widening of Dale Street, The applicant presented a petition in favor of the permit and stated that a bumper fence restricting access to the alley would reduce the number of parking spaces. In considering this matter, the Board discussed the implications of a portion of the property being "B" Residential. They noted that the Traffic Engineer disapproves of this plan because it indicates access to the alley and that adequate plans should be submitted prior to a Council hearing on the matter. Subsequently, the Board heard a motion to recommend approval subject to the recomm�endations of the staff and Traffic Engineer. The motion was seconded and passed by a vote of 4 to l. At the August 5, 1971 Board of Zoning public hearing, when a portion of this pro- perty was considered for rezoning to a Commercial district, it was noted that the Traffic Engineer would review the plan in light of some of the concerns of the awner and neighbors, expressed at that hearing. Therefore, this matter was referred to tl�e Traffic Engineer again and his reply noted that the plan approved for an adjacent bar indicates no alley access and that this plan �� `��'r - � o /� , � � Harry E. Marshall, City Clerk - 2 - should indicate the same. The Traffic Engineer also concluded that limiting alley access from the parking lot would not impair access to priu.ate garages across the alley. He said that the plan on file, which was suggested by the Zoning Board staff, is acceptable, noting that it contains the same number of parking spaces as the applicant's p1an.
