1 WHEREAS, Saint Paul Legislative Code §409.06(n) prohibits the issuance of �f€�
2 liquor license within 300 feet of any public or parochial school, church or synagogue; and

WHEREAS, the council may disregazd this prohibition upon receipt of a written petition
signed on behalf of the school, church or synagogue so located, by five-sevenths vote; and
WHEREAS, Eagle Street Grille, Inc. d/b/a Eagle Street Grille has applied for on-sale
liquor and Sunday on-sale liquor license for the premises located at 174 West 7`" Street, which is
within 300 feet of Free at Last Church of God; and
WHEREAS, Free at L,ast Church of God has consented to a waiver of the distance
limitation; now therefore, be it
RESOLVED, that the City Council hereby waives the prohibition contained in Saint Paul
I.egislafive Code §409.06(n) with respect to the issuance of the on-sale and Sunday on-sale
liquor licenses to Eagle Street Grille, Inc. d/b/a Eagle Street Grille at 174 West 7�' Street. Said
waiver does not operate as consent to issue the licenses until all other conditions and
requirements of law have been met.
