addressed to l�i�. FrGn� A. Staffenson with regard to the above .
matter. I am in complete disagreernent wi�.h �the lega�, c�r.clusions
you have stated in this letter and I wish to explain to you the
City's positi�n.
I fail to see the applic�bility of any doctrine of estoDFel
or conduct which constitutes tresp�.ss by the �ity of St. Paul.
If your ar ent was carried to its conclusion, it would mean
th�t if a icense is granted to an establishir.ent the Health
Department would be e�topped from ever condemning that property.
I am sure tt:at if you attempt to hare your application fee refunded
i�nediately, it will be so refunded. - .
In your letter you also indicate3 and eluded to the fact
that the Health Departrsent was without �uthority to ta�e the
action they did. As you are well aware, the suthority to condec�t
and order vacated a piece of property is authority vested in a ,
local health agency pursuar.t to constitutiona.2ly �alid police
po�ers of the municipality. The City of St. Paul, through Legis-
lative Code Chapter SS, guarantees to an aggrieved party all consti-
tutional protections in the form of administrati.ve review `and -
jud�.cial review. Whether or not a building is unfit for habitation
and dangerous to life and health by reason of the want of repa.ir
is a discretionary decision which is vested in the St. Paul Bureau
� of Health and nowhere in this present matter is there any evidence

by the notice o� condemnation also attached thereto which indicates
more specitically which housing and health code violations are presently

the Saint Paul Legislative Code, Section 55.02.
According to a letter from Mr, Dar�iel P. MeLaughlin, License
Inspector, to the petitioner, Gordon F3. Struck, dated A�ril
8, 1971, a resoluicion is to be submit�ed to the City Council
in denial of a rooming,house licensure for the sub�ect premises
on Thursday, at 10:00 am, April 15, 1971.
As attorney for Gordon A. Struck, I seek co�tinuance of the
resolution matter pendin.g hearing and determination before and
by the Bc>ard of Appeals. The issues are the same in both pro-
ceedings, though the Board of Appeals� case includes both.

Dear Mr. Ma.rshall:
Attached hereto is a letter I have sent to Mr. Robert Shea,
an attorney at law who represents Dr. G. R. Struck in the ma.tter
of the condemna.tion of 1977 Ma.rshall Avenue. Mr. Shea has
attempted to argue tha.t because the City Clerk's Office accepted
the fee for his application for a boarding house license on March
30, 1971, the Health Department is prevented from condemning the
property at the same address. Mr. Shea specifically refers to St.
Paul City Ordinance 335A.03, Subd. B, wherein the last sentence
provides "The City Clerk shall not accept the fee on new
applications unless approved by the health officer".
From the file that I ha.ve in this ma.tter, it appears tha.t
Dr. Struck was notified on Ma.rch 26, 1971, that the dwelling
at 1977 Marshall would be condemned unless numerous changes and
repairs were made in the premises. Mr. Staffenson informed Dr.
Struck and Mr. Shea that if they were, in fact, to get a boarding
and rooming house license some of these repairs would not be
necessary. On March 30, 1z37� the application was made in your
office by Dr. Struck for a boarding and rooming house license and
a fee was accepted by your office. Mr. Shea is attempting to

• As part of an area-wide program, a survey was made of your property
located at 1q7�J��rshall on A�� 4 p ,. The purpose
of this survey �s to aid property owners in m�improvements and
repairs to their property. On the enclosure are listed the items
on your property which do not meet the Housing Code. These items
should be corrected as soon as possible.
� A progress inspection will be conducted in approximately ninet
����_r . If you encounter any difficulties in bring�ng your �
property �nto compliance with the Code, please contact our office
(223-4636). You will be given an extension of time to complete any
. outside work which is impossible to complete due to inclement weather.
Your cooperation in making these improvements will help maintain the
value of your property as well as make your cortnnunity a better place
in which to live.
A permit is required for all electrical and plumbing repairs and/or �
new installations. Changes and/or additions to an electrical system
- with a 30 ampere service may require upgrading of the service size to '
100 ampere minimum. Electrical and plumbing repairs and/or new in-
stallations must be made in accordance with the Plumbing and Elec-
trical Codes.

, We are in receipt o£ your referral regarding 1977 Marshall
Avenue owned by a Dr. Gordon Struck. Our records indicate
that this building was constructed in 1905 as a dwelling. No
permits have been issued for separate living quarters on the
third floor. Ins�ection indicates the occupancy of this
building is in violation of the building and housing code as
� there is an apartment in the basement, as well as on the third
floor. 'I'here is on�y one bathroom on the first floor and one
bathroom on second floor which is shared by the tennant. '1"here
is a water closet on the third floor. We have written to Dr.
Struck regarding these violations. It is possibly more
expedient to placard the '�uilding as unfit for human habitation.
If your intentions are not to placard the bui.lding for the
above violation, please. ],et us know and we will take other
action in the form oi ari ordinance violation tic?cet. I will
suspend this file until I hear what action you intend to take.

acting under the authority conferred upon him by Chapter 54, Section 54.19,

Dear Ms. Staffenson:
I tried several times unsuccessfully to reach you at your office
during the afte�noon of last Friday, April 2. I understand now
that you executed an Order of condemnation-vacation sometime in
that F`riday afternoon period, and that the Order, as posted, con-
demns and vacates the entire premises and all units.
It is my regretful duty to notice that an apparent, serious vi- �
olation of law has occurred here.
Under the Ordinance, Chapter 33�A.03, subd. 2, the City C1erk
of the City of Saint Paul is enjoined not "to accept the fee on
new applicatians unles� approved by the Health Officer."
The circuMStanees axe that as a result of my conversation with
you I was led to advise Dr. Struck to apply for a rooming-house
license. The follo�r�ing day� i��:arch 30, he made such application.
On �Iarch 31, I, fo.rmally and by letter, requested a several day�'
stay or abidement of the matter pending the proce.ssing of the ap-
plication for the rooming-house license . You� nex�. day's letter
(April 1) stated that yo� were in receip� of my letter requesting
postponement of the placarding of the property, that the application
i for a rooming-house license did not negate the other violations of
i ` the Housing Code, and that should Dr. Struck have any further
! questions, he should Please contact your office .

This afternoon, Fire Inspector Sutton (#1) told Dr. Struck that
he could not even initiate his inspection of the premises under
' the rooming-house license application procedure, in view of the
. Bureau of Health`s posted condemnation-vacation Order.
It cannot be assumed that' the City Clerk, P�Ir. I�arry P�:arshall,
acted in derogation (per his designee) of the mandatory duty

imPosed upon him under the Ordinnnce in processing this
application thr.ough his office, and the license bureau,
and in accepting the .�4�.00 license fee, without prior
cognizance and/or approval of the Health Officero
The only �aa�umption which can be made is that the City Clerk
acted in obedience to the mandate of the Ordinance in accepting
the fee, and that the Health Officer had approved this ap-
plication.
Accordingly, the next day's condemnation-eviction Order of the
' Health Officer was perforce void. Being void, its execution
constitutes an act of trespass by the City of Saint Paul, within
the treble-damage trespass statute, as well as a tak�.ng of
property without compensation in the face of cor_stitutional
' Provisions nroscriPtive of such an act.
The apparent authority of the City Health Officer to condemn
and order vacated property on findi� that it is "unfit for
human habitation A�tD dan�erous to life and health" Presupposes,
; it seems to me, that the finding be both that the premises is
i � unfit� for human habitation and dangerous to life and health.
� �
The Notice you posted merely declared that the property was
unfit for human habitatior_. There was no reference made to its
; being dangeraus to life and health. �
Also, it appears to me that both due process of law and the
concept of "findings" under administrative law, mean that the �
; Health Officer may no+ make such finrlings and determination as
a basis for a conc�eMnation and vacation Order without a prior '
hearing, at which tre o�vner is given opportunity to be heard,
after due prior notice. This procedural safeguard is, I believe,
basic constitutional-administrative law. ("Appeal" procedure
inherently contemi�lates a prior due-process hearing at which
evidence is taken and both sides heard. "Ap?�eal"- connotes a
"review" on the recor�i 'of an ori�inal proceeding. )
The fundamental principles of the law of estoppel deny to the
City of Saint Paul any right to que�tion the integrity of the
ac�ion of the City Clerk in accepting the fee and processing
the application herein.
Furthermore, `these are not congenitally uninhabitable premises,
nor are they perfore �r se dangerous to 'life and healtho
These are not "slum" dwellings, and the tenants are not at all
in the least dissatisfied. Their _health suffe•rs not.
Permits may be found in the City's own files for the present
use and structure of these premises, dating from (circa) 19460
