FILE NO. 02-337 PENDING FINAL COLTNCIL ACTION ON THE PLANNING
CONIMISSION'S IRVINE AVENUE DEVELOPMENT PLAN SUBMITTED TO THE CITY

8 Whereas, on Apri124, 2002, the Council of the City of Saint Paul adopted Council File
9 No. 02-337 to temporarily prohibit development on any parcel of land or part thereof wittzin the
10 area designated therein as Irvine Avenue Study pending the formal adoption of an interim
11 ordinance to that effect pursuant to the provisions of Minn. Stat. 462355, Subd. (4); and

13 Whereas, a planning commission task force completed work on a series of
14 recommendations including proposed amendments to the City's comprehensive municipal plan
15 and to its official zoning controls within the Irvine Avenue Study Area; and

Whereas, the planning commission, on October ll, 2002, approved the Irvine Avenue
Development Plan far transmission to the City Council; and
Whereas, the Ciry Couucil will review and act upon the planning commission's
recommendations in a manner established by statute, ordinance and policy, including providing
sufficient notice for such public hearings as may be required; and
24 Whereas, while the recommendations of the said plan are under consideration by the City
25 Council, development within the Irvine Avenue Study Area could result in land uses that would
26 not be consistent with the propased policies and official zoning controls; and

28 Now, therefore, be it resolved, the Council of the City of Saint Paul will prohibit, on any
29 parcel of land or part thereof within the area of the Irvine Avenue Study, the issuance of plan
30 approvals, lot splits or building and zoning permits until the expiration of 90 days as provided in
31 Minn Stat. 462355, Subd. (4), or until such earlier time as the Council of the City of Saint Paul
32 has taken action on the recommendations made by the Planning Commission; and

34 Be it further resolved, pending the amendment of the interim ordinance described above,
35 no plan approvals, 1ot splits or building and zoning permits shall be issued from this date and
36 until the expiration of ninety (90) days as allowed by Minn. Stat. 462.355, Subd. (4) or until
37 such earlier time as the Council of the City of Saint Paul has taken action on the
38 recommendations contained in the study; and

Be it finally resolved, that the following are exempted from the provisions of this
resolution and from the conditions imposed under an interim ordinance:

5 1. Building, plumbing, mechanical and electrical permits for repairs or minor
6 alterations to conforming ar non-conforming structures, or for work on dangerous
7 or vacant buildings administered under Legislative Code Chapter 43.

maintain health and safety of occupants.
Demolition pernuts far nuisance buiidings pursaant to Legislative Code Chapter

Buiiding permits for permitted, non-residential or non-commercial accessory
structures as defined in Legislative Code §60.201.A.
19 5. Building permits for uses consistent with the recommendations from the Irvine
20 Avenue Development Plan as approved by the Saint Paul Planning Commission on
21 October 11, 2002.
