Moved by Voigt to adopt the proposed amendments to Article IV, item 1 -- Disposition of Cases and Article VII , item 1 -- Adoption of Other Motions, to conform with Ordinance No. 14734, Council File No. 252511, approved .March 4, 1971 which amends Chapter 55.01, Subdivision b. of the Saint Paul Leqislative Code to define a Ruorum and a m.ajority f�r v�ting purposes . Lilleboe enumerating Housing Code deficiencies located on the property at 409 Laurel Ave . during a survey on November 20 , 1970 by the Housing Code Division of the Bureau af Health . Apartm.ent 1 has three rooms , �partment 2 has two rooms and a private bath, apartment 3 has two rooms , apartment 4 has one room, apartment 5 has one room, apartmen.t 6 has three roams , apartments 7 - 11 have one room each and apartment 12 has two roorns . There is one private and one shared bath on the first : floor and one shared bath on each o_f the other two floors . Ther.� ' are 13 people in 12 units . Ten people share three baths . . . , � Mr. Lilleboe has fixed the light fixture in apartment 2 . Mr. Staffenson said that entry had not been gained to apartments • 3 , 7, 8, and 11. . . . Mr. Lilleboe does not know i..f. the Housing Authority plans to acquire the property. . . . 'I'here is a metal fire escape which extends from the roof by the third floor to the ground. Exit is throuqh the bathroom window and across a flat roof to the fire escape. ACTInN: Moved by Voigt that an inspection of apartments 3 , 7 , 8 and 11 be conducted by the Bureau of Health and that a lif_e- . safety inspection be conducted by tk�e Bureau of Public Buildings . Further moved that Mr. Lilleboe determine if the Housing Autho.rity has any plans to acquire the property and, if not, his eligibility for any rehabilitation loans or grants . Laura Earthfield. � � PROCEEDINGS : Mr. Staffenson reported that a significant amount of work had been completed b_y Mrs . Earthfield. Mrs . Earthfield said that she was appealing the requirement to vent the kitchens because of the significant investment involved. Each kitchen ;i opens to a porch and also has windows that open to the porch area. She felt she would need about six months to correct the ' other deficiencies . . , � x a. r � i C ' 3/24/71 f � . PROCEEDINGS : Mr. Staffenson reported that thP owner of the pro- perty, Markus Dardine has moved Fran the property. The two illee�al basement apartments are Presently occupie�. On March 26 , 1969 the board acted to waive area restrictions , ceiling height restrictions , exit requirements and the requ.irement that no space in any cellar be used for sleeping purpos�s on con- dition that Mr. Dardine convert the basement to one apartment only and that he as owner and caretaker live in the basement apartment and that upon the sale or. transter of ownership of the property, the waiver be nullified. Mr. Dardine was granted a period of sixty days to comply with the waiver. SUBJECT: Denial of request for Permit to build a detached garage in a vacant lot as it is in violation of Section 40 .00 item c. of the St. Paul Legislative Code . APPEARANCES : Hugo Hendrickson, John Polymeros . PROCEEDINGS : Mr. Blue said he had no file on this appeal. It is illegal, however, to build an accessory building on a lat unless a dwelling unit is there. . . . Mr. Hendrickson intends to build a dwelling unit on the lot within 3-4 years but needs the garage now for more storage space . There is no more space in his present lot at 1891 Reany for more storage facilities. It is intended to be a stucco garage with a separate meter to provide lighting for the garage . . . . There is a total of six empty lots where he intends to build the qarage. There are homes facing the empty lots on the opposite side of the street. ACTION : Moved by Tieso that Mr. Anderson determine what steps would be necessary to obtain approval by the adjoining residences �nd inform Mr. Hendrickson of those requirements . Finally moved that the matter be reheard at the April 14 , 1971 meeting. Seconded by Peake. THE VOTE : Ayes : Tieso, Grove, Kamin, Peake, Sommerdorf, Voigt, Nayes : none. Abstentions : none. Motion carried six (6) to zero (0) . Mr. A. J. (Jim) Johnson explained that the Census Tracts 9 and 10 project is a City of St. Paul Federall.y Assisted Code Enforce- ment Program. There are 2,222 homes and 3 ,000 dwelling units in these tracts . The program is scheduled to end in� July, 1971, however, an extension to December 31, 1971, has been requested and there is some assurance that it will be extended. On March 8, 1971 Mr. Johnson was directed by the City Management Committee , composed of Mayor McCarty, Commissioner Butler and Commissioner Sprafka to appear bef.ore the board to explain some of his problems and to ask for help in problem ar_eas . . . . At the end of the project, 95� of the homes are required by HUD, to be up to code standards and 5$ in the hands of the City ' s leqal department. • . . To Mr. Johnson ' s knowledge very few individuals located in the project area have appeared before the boarcl. One question - 4 - � ' 3/24/7] Meeting N�. 48 he tias is whether or not cases can be legally brought before the board on behalf of the people . . . . There are some categories of problems which exist in the area: 1. The project cannot get people to apply f_or loans and grants . 2. Some people refuse entry out of pride. 3. Some people refuse assistance out of pride . 4 . Some welfare recipients either refuse entrance or the money which is available to them is not sufficient to bring their homes u� to code . 5 . Some people refuse on the basis of f_inances -- they can ' t aff.ord to comply even if loans and grants are available. What can be done? 1. Tag the f.ile and require that the home be brouqht up to code at the time of sale. 2. Have selected code items which could probably be. excluded. 3 . Change the code to be concerned more with structural needs and not petty items . Approximately 10� or 200 cases could be brought before the board at this time . . . Mr. �7ohnson is here to outline the pro- blems . . . . Maybe a working committee of the board could be formed. Maybe appeals could be brought in without the appel.lant appearing. Maybe the $S . OQ filing fee could be waived. for those cases . Mr. Staffenson said there are abraut 65$ of the dwelling units presently in non-compliance. There is $6 , 800 ,000 comr.iitted to this project, $1,000 ,000 of this for grants with no cash limit for loans . Inspections will continue through June, loan and _qrant processing until the end of the program. . . . Approximately 450 people have refused entry to inspectors. . . . The project is most concerned with categories of people . . . . No funds to acquire properties are available in this program. . . Mr. Staffen- son said that to grant blanket waivers would�emasculate the Housing Code for the whole city. He also has similar cases of the type Mr. Johnson has described. . . Mr. ,7ohnson noted the success of the project in terms of the numbers of loans and - 5 - ^ � ' 3/24/7] Meeting No. 48 grants processed, the amount of rehabilitation and the physical improvements to the area. A poll of board members revealed a general consensus of the hoard that blanket waivers would to some extent destroy the purpose, not only of the Housing Code but also of the board itself. Mr. Kamin felt a "get tough" policy should be used. Mr. Voigt felt considera- tion of the matter should be made. Mr. Grove f.elt the matter should be considered by the board. Mrs . Peake felt the people should be persuaded as to the benefits of the pro_qram. Mrs. Sommerdorf felt that wholesale variances puts a hardship on those individuals who do comply.
