RESOLVEDa Tha.t the proper City officers are hereby authorized
and directed to execute on beha.lf of the City of Saint Paul
Addendum to Agreement between the City and Orfei & Sons, Inc. ,
said Addendum to Agreement pertaining to a Contract whereby the
City agrees to compensate its Contractor for additional services
incurred by the Contractor in the amount of $2,900.00, incurred
in relation to the City's Randolph Avenue-Mississippi River to
Davern Storm Sewer, Project S-991, a copy of said Addendum to
. Agreement being attached hereto and incorporated herein by reference.

ADDEI�TDUM TO AGREEM�NT
THIS AGREEMENT, Made and entered in.to this day of
, 1971, by and between the CITY OF SAINT PAUL, a
municipal corporation of the State o� Minnesota, hereinafter
designated as the "City", and ORFET & SONS , INC. , a Minnesota
corporation, hereina.fter designated as "Contractor",
WITNESSETH:
WH�REAS, City and Contractor have entered into a certain
agreement dated February 10, 1969, whereby Contractor was to fur-
nish and deliver to City a11 labor, tools, equipment, materials
and services necessary to complete the construction of the Randolph
Avenue-Mississippi River to Davern Storm Se�aer, Project S-991, for
the City' s Department of Public Works (L-7087) ; and
WHEREAS , The Special Provisions Item 53 for the contract
direct Contractor to pay the Consulting Engineer directly for en-
gineering and inspection costs incurred after the date of cempletion
of the contract; and
WHEREAS , City and Contractor agree that. because of conditions
beyond thea.r control, Contractor was not able to complete certain
portions of the work during the winter months of 1968-1969 as
indicated in the contract and Contractor was unable to complete the
work by the contract date of completion; and
WHEREAS , Because Contractor did not complete the contract by
the completion date stated in the Special Provisions, Barr Engineer-
_ ing Company, Consultir�g Engineers for the project, received payment
of Twelve Thousand and Five Hundred Dollars ($12,500.00) from
Contractor as provided in Special Provisions Item 53; now,
therefore,
IT IS HEREBY AGREED TO BY AND BETGJEEN THE PARTIES HERETO:
That the agreement dated February 10, 1969, be amended so
as to add five and one-half weeks of engineering and inspection
costs, and that City shall pay Contractor therefor the additional
sum of T��o Thousand and Nine Hundred Dollars ($2,900.00) for the
full and f_aithful performance, subject to the terms and conditions
of the said agreement dated February 10, 1969; this amendment to
agreement is made expressly contingent upon the consent hereto by
Contractor' s Surety, the Seabord Surety Compan�, which consent shall
be represented by written letter attached hereto and incorporated
herein by reference . , .
PROVTDED, FURTHER, That all of the remaining terms and con-
ditions of the said agreement dated February 10, 1969, except as
modified herein, sh.all rema.in in fu11 force and effect, and be
binding upon the parties . `
IN WITNESS WHEREOF, The City and Contractor have executed this
Addeizdum to Agreement the day and year first above written.
