Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the appeal of Don Rieck to allow a Commercial parking lot in a "C" Residence District on property located on the southeast corner of Pascal Street and Sherburne Avenue. This property is further described as: Lots 13, 14, and 15, Block 29, Syndicate No. 5 Addition. This matter was first heard at the December 17, 1970, Board of Zoning meeting. The staff report noted that a similar appeal was previously heard by the Board of Zoning and City Council. The last official action in that matter was denial of the appeal by the City Council on June 25, 1970. The staff report also noted that there had been a question as to whether this appeal could be heard in view of recent state enabling legislation which prohibits a variance as to use. A 1ega1 opinion from the Corporation Counsel's office, however, states that this type of appeal may be heard. The appellant, Mr. Don Rieck, and his attorney, Mr. Sidney Abramson, appeared on behalf of the appeal. Mr. Abramson showed a drawing of the proposal to the Board, explaining that the site is presently rough-graded and chained-off. He explained that the appellant employs over 300 people who need a place to park in order to ease the traffic problem in the area. Mr. Rieck said the proposed parking lot would help the neighborhood by getting cars off the street. A number of area residents appeared in opposition to the appeal. Their statements expressed concern over the safety of children in the neighborhood, fears that this type of proposal would lead to commercial intrusion into their neighborhood, and that this type of proposal would deteriorate the residential character of their neighborhood. It was stated that there is no parking problem for residents and that parking lots would be a menace to the neighborhood and bring in unwanted elements. Mr. Merrill Robinson, representing the Hamline Community Association, also appeared in opposition. Mr. Robinson noted the single-family residential character of the neighborhood, and stated that this appeal would change this character. He said that type of proposal would eventually be detrimental to life in St. Paul. The staff noted they had received one letter which f�vored the proposal but which suggested a fence be erected around the parking lot. The staff also acknowledged the receipt of one letter in opposition. In considering this matter, the Board questioned the availability of on-street parking in the area and discussed the threat of commercial encroachment into the residential neighborhood.
