WHEREAS, The Minnesota State Highway Department, acting through
its contractor, La.metti & Sons, Inc. , is in the process of con-
structing a storm water tunnel along Fifth Street to provide a
direct connection to the Mississippi River for drainage of Inter-
state Highway 35-E; and
WHEREAS? The said contractor has requested permission from the
City of Saint Paul to construct a stilling basin at ground level to
separate the water from the sandrock removed in the process of con-
structing the said sewer on a triangular tract of City property
bounded by Fifth Street, Kellogg Boulevard and Smith, being described
as:
Lot 6, except Fifth Street, Block 62, Irvine�s Enlargement
to Rice and Irvine� s addition to St. Paul, Minnesota;
for a period of time commencing in March, 1971 and expiring November
1, 1971; now, therefore, be it
RESOLVED, Tha.t the Council of the City of S.aint Paul does
hereby grant permission to Lametti & Sons, Inc. , contractor on
beha.lf of the Minnesota State Highway Department, to construct a
� stilling basin at ground level to separate water from sandrock as -
� part of its construction of a storm water tunnel along Fifth Street
�, at a location on City property described as a triangular tract

A. Tha.t said permittee sl�.a.11 perform all of the said work author-
ized herein on the City property entirely at its own cost and
expense and under the supervision and to the satisfaction of
the Commissioner of Public Works;
B. That said permYttee shall pay all costs of inspection and ad-
ministration incurred by the City of Saint Paul for the work
authorized and use of City property permitted herein, and for
the publication of this resolution; '
C. That said permittee shall restore the City property used by it
pursua.nt to the permission and authority granted herein to
the satisfaction and approval of the Commissioner of Public
Works on or before November 1, 1971;
D. That said permittee expressly agrees and undertakes to fully
indemnify and hold ha.rmless the City of Saint Paul, its agents,
officers and employees from any and all dama.ges, claims,
losses,. suits or expenses arising out of or occasioned by the
performa.nce of all the work contemplated by the, permission and
authority con��.ined herein;
E. Tha.t said permi�tee shall furnish a bond to the Cit of Saint
Paul in the sum of Ten Thousand Dollars ($10,000.00�, conditioned
to comply.with all of the terms of this resolution and to in-
demnify and save harmless the City from all liability, loss,
judgments, suit� costs, cha.rges and expenses that may accrue
to persons or property occasioned by the use of the City prop-
erty granted herein and the work performed by the said permittee,
and including any cost incurred by the City to restore the City
property to satisfactory condition;

Enlargement to Rice and Irvine's addition to St. Paul, Minnesota
Gentlemen:
We are presently in the process of mining in the sandrock a storm water tunnel
along 5th Street under contract with the Minnesota Highway Department. The pur-
pose of the sewer is to provide a direct connection to the river for the drainage
of Interstate Highway 35-E. Our present method of disposal of excavated sandrock
is via a barge system moored at the foot of St. Peter Street. Permission for
this system will shortly expire upon start of the navigation season.
On about March 15, 1971 tunnel progress should reach the above triangular tract.
We propose to construct there a stilling basin at ground level to separate the
water from the sandrock. The excess water will be returned to the tunnel to be
used in the sandrock cutting operation. Excavated sandrock will be used as fill
for a nearby construction project.
We propose to occupy this site for the period from March 1971 to November 1, 1971.
Due to the short time interval remaining before loss of barge operations and need
for a changed set-up, we would greatly appreciate prompt attention to the request
