21 Sec. 2. [COST MAY BE COLLECTED FROM PUBLIC UTZLITIES. J
22 Whenever the matntensnce of pole�, cables, or wire along any
23 of the streeta, avenuesr or alleys of said citY by any .
24 pubtic utility is such that they, ere or will come into
25 contact with the trees on any streetr avenue, or all �y such
26 �s to in)ure seid trees or that inlury is 1 { kely to occur
� 27 therexo� the city of 3t . Paul may cause the necessary
28 trimming to be done and sha11 collect from said publ � c
29 util � ty the cost of the trimming so don�. �
30 Sec. 3. [TREE PRESERVATION AND REFORESTATION FUND. )
31 Notwithstandina �ny Arovision of the ch�rte� of the Eity of
32 St . Paut or enY other statute� the c � ty council of the city

� 2 to att ctihe^ powers by it now possessed, to establish e �`Und
3 to be known and designated as the "7ree Preservation and
4 Reforeatation Fund" which shall be kepfi distinct from a11
5 other funds of the city. Said fund shalt be 1n lieu of
6 ex� sting tax levies for the pl8ntin9r cering forr
7 maintenancs and removal of trees and shrubbery and shall be
8 us�d �or the accomplishment of the purposes enumerated in
� 9 section 1 hereof. On or before Octob�r 10, 1971r end
. 10 annually thereafterr the governing body of the eity councit
ii may levy on the rea) and personal property of the city a tax
. 12 not exc�eding five mills on each dollar of the asa@ssed
� !3 valuatlon of the city. The emount of such levy sha11 be
14 sub) ect to the supervision of any fiscal control agency
15 wh{ch { s now or her�after provi�d@d in the chart�r of any
16 such city.
17 3ec. 4. [CATASTROPHE EMER6ENCY AUTHORIZING �OND
18 ISSUE. ) The city council of the city of St . Paut may
19 authorize the issuance end sale of bonds for a tree
20 emergoncy fund to an aggregate total amount of not to exceed
21 �1� �OOr �O� on1, y ��p.�� «h� ccCJ���RC� ^f �ny or.e ef the
22 fallowing events : (a) in the event a substentiet
� 23 rehabilitat { on program is requir�d by reason of o naturat
24 cat�strophe or (b) an emergency fund is necessery �nd
25 . re4u{ red to defray the costs of control of a disQmse wh � ch
26 has become an epidemic according to technical end expert
27 opinions rendered pursuant to P�innesota Statutesr Section
28 18. 022. The amount of al ) such bonds issued under this act

� ' 1 sha11 be exempt from and shell not be eounted or included .in
• � 2 the net indebtedneas of the city nr ♦ n any computation of
3 the city ' s outstanding indebtedn�ss for the pE�rpose of
4 determ� ning the limit of the net bonded indebtednes of the
5 city. � The monles received from the sale of said bonds shatl
6 be plac�d in a special tree emergency fund end sha11 be used
7 for the rehab� lltaion or disease eradieation program
8 �equired by reason of the epidemic or naturel catest �ophe.

! i lim{ �ation as to rate or amount and 1n excess of existing

19 Sec. 5. [FULL FAITH AND CREDIT PLEDGED; CHARGER
20 LIMITATION. � The bonds her�by authorized .or any p�rt thereof
21 shali be issued end sold pursuant to the provisions of
22 M� nnesota Stetutes, Chapter 475r except that the bonds
23 authorized herein may be issued without first obtaining the
24 epprovat or a vote of the electors and thc full fAith and
25 credit of such city at all times shall be pl �dged for the
26 psym�nt of any s�ch bonds issued und�r this act and for the
27 peyment of the principal and interest thereon. Prior to the
28 sete of the bonds� the city counEil of the city of St . Pau1

I am enclosing a Xerox copy of �a bill which would •
allow the City of St. Paul to raise revenue by mill rate
levy for replacing and removal of trees, and primarily for .
� control of Dutch Elm disease. This bill has been approved �
by the Reviser of the Statutes Office, and a copy placed
in the hands of Dan Klass, corporation counsel.
It is my understanding that Mr. Klass will see �
that the bill is placed on the agenda of the City CounciZ
for sometime in the early part of the week of March 8th.
Once this is done and the Council approves the bi11 as
drafted� then it will be placed before the Ramsey County
Delegation and considered as a Delegation bill. After
approval by the Ramsey County Delegation, the bill will
be placed on the Consent Calendar for approval by the
Legislature.
� Passage of this bill is dependent, then, upon
prompt approval by the City Council, and transmission to
Representative Fred Norton, so that the approvad b�ll
may be placed on the Ramsey County Delegation 's agenda.
, Time is of the essence, since the session is aZready
half complstted. Every effort should be maae to see that
each member of the City Council is aware of� this legisla-
tion so as to avoid confusion anci time-consuming debate.
