part of Lot 13, 61ock 2, of said addition lying East of a line run from a
point on the South line of Lot 13, 7� foot distant East from the Southwest
L corner of said lot to a point on the North line of said Lot 13, 100 foot ,
distant East from the Northwest corner of said Lot. Also a 40 foot strip of
� land on, over and across the Burlington Northern Inc. right-of-way in the
Northwest � of the Northeast � of Section 32, Township 29 North, Range 22
West, lying Northeasterly of and adjacent to a line runhing across said .�`
t right-of-way in a Southeasterly direction beginning at the South corner of

42 degrees, 50 minutes, with the Southerly extension of the West line of
Block 2, Irvine's SecQnd Addition to Saint Paul on, over and across the
. 1 Burlington Northern, Inc. right-of-way in the Northwest � of the Northeast �
of Section 32, Township 29 North, Range 22 West, lying between the Northeasterly
line of the above described 40 foot wide strip of land and the North line of

22 West, and lying Southeasterly of and adjacent to the Southeasterly line of
Block 2, Irvine's Second Addition to Saint Paul . This easement is necessary
for the construction of the Phalen Creek rel�ef and clearwater sewer being

The Co�nissioner of Public Works, having had under consideration the pre-
liminary order of the Council� known as Council File No. 253413
approved April 2, 19 71 relative to
Condemning and taking a permanent easement for utility purposes on� over�
and across those parcels of land in the NW� of the NE� Section 32� Township
+ 29� Range 22 described as follows:
,_ All of Lot 14, Block 2, Irvine's 2nd Addition and that part of Lot 13 of --
said addition lying east of a line run from a point on the south line of Lot
� 13, 70 foot distance from the SW corner of said lot to a point on the north —
line of Lot 13, 100 foot distance from the NW corner of said lot.
_ A 40 foot strip of land across' the Burlington Northern Right-of-Way lying —
NEIy of and adjacent to a line running across said R/W in the southeasterly
_ direction beginning at the south corner of Lot 14, Block 2, Irvine's 2nd —
Addltion having an angle of 42° 50' with the southerly extension of the east
alline of Drewry Lane. �
Also except for Minnehaha Avenue a 25 foot wide strip of land lying between
the northeasterly line of above described 40 foot wide strip of land and the —
north line of the NW� of the NE� Section 32, Township 29� Range 22 and lying
_. southeasterly of and adjacent to the southeasterly Iine of Block 2, Irvine's
2nd Addition. This easement being necessary for the construction of a relief
— and clearwater sewer being built under Public Works Project S-1359g PHALEN --
CREEK�North Street to Weide Street.
