In the Matter of condemning and taking $n easement in the land necessary for the
slopes, cuts and fills, including right of removal of lateral support from subject
land or remainder thereof, occasioned by excavations thereof, or construction of slopes
in the grading and surfacing with bituminous material the alley in Block 3, Nininger
and Donnelly's Addition and Berryhill and Davidson's Rearrangement from Vietoria Street
to Marshall Avenue as part of the Su�it-University Renewal Area� Contract G-1933,
under Preliminary Order 248179 approved April 2, 1970
The Council of the City of St. Paul having received the report of the Commissioner of Finance
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved and adopted, and the said improvement
is hereby ordered to be proceeded with.
2. That the nature of �he improvement which the Council recommends is
to condemn and take an easement in the land necessary for the slopes� cuts and fills,
including right of removal of lateral support from sub3ect land or remainder thereof,
occasioned by excavations thereof or construction of slopes in the grading and sur-
facing with bituminous material the alley in Block 1, Nininger and Donnelly's Addi-
tion and Berryhill and Davidson's Rearrangement from Victoria Street to Marshall
Avenue as part of the Su�nit-University Renewal Area, Contract G-1933, in accordance
with the blueprint hereto attached and made a parC hereof, the hatched portions show-
ing the cuts and the shaded portions showing the fills,
with no alternatives, and that the estimated cost thereof is $ 60.00
Resolved Further, That a public hearing be had on said improvement on the 22nd day of
" June� 1971 , at the hour of 10 o'clock A.M., in the Council Chamber of the Court
House and City Hail Building in the City of St. Paul. That the Commissioner of Finance give notice of
said meeting to the persons and in the manner provided by the Charter, sta,ting the time and place of
hearing, the nature of the improvement and the total cast thereof as estimated.
