OFFICE OF THE CITY CLERK COUNCIL RESOLUTION-GENERAL FORM � PRESENTED BY DEAN MEREDITH F COMMISSIONE DATF WHEREAS� State Law requires that amendments to By-Laws of Firemen's Relief Associations shall be approved by the City's governing body before becoming effective, and WHEREAS� certain amendments to the Constitution aAd By-Lews of the St. Paul Fire Departmeat 8�lief Associatfon as listed below were adopted by a referendum vote of the membership on April 6, 1971, therefore be it RESOLVED� that the Council of the City of St. Paul do hereby approve the amendments to the Constit�tion and By-Laws of the St. Paul Fire Dep�rtment Relief Associa�ion as listed below: Amend Article VII, Section 1 of the By-Laws by striking out the sum of $5�0 and insert ia lieu thereof the sum of $800. Amend Article VII, Section 2 of the By-Laws bq striking out the sum of $1,000 and insert in lieu thereof the s�m of $1,S�U; also, strike $500 and insert $800. A new section of the By-Laws as followss Article VII, Section 3. When the beneficiary of a deceesed member �as been determined and payment of death bene£it is authoriaed to be p�id to such bene£iciary or estate, the amouat of death benefit provided for in this Article shall be increased at the rate of $l0U for e�ch complete calendar year of �ervice on the roster of the St. Paul Fire Department, or as a member of the Relief Association. Death Benefit B. Amount of Disability Pension paid to a Disability Pensioner with dependent children in school State law requires that the St.Paul City Council approve of the amend- ments before they can be put into effect. Copies of the amendments are attached as part of a resolution being presen��d to the City Council and are attached hereto: Ezplanation DEATH BENEFIT. Since the founding of the Relief Association in 1885, a Benefit has been paid in the event of the death of a member. $500 in almost all instances, or �1000 where an active member dies single with no dependents to receive a penaion. �There is no refund of any kind provided in our fund.) The amendment changes the basic amount of Death Benefit from �500 to $800; it also changes the single member's �1000 to �1500. It also � provides a step s,ystem increase of $100 per year in the Death Benefit for the next seven yeaxs. The Death Benefit is �sid out of the qperational (General� fund of the Association which ie supported by +�°� of salary of th� membere. 4 DISABILITY PENSION. The a.mendment appliea only to a Fire Department � member who is forced off the �ob because of his disability and has more than two children dependent upon him. In instances where there are three such children or more, the amount that would have been paid to his widow in the event of his death might be greater than his dis- . ability amount. The amendment provides that his pension shall be • increased to provide for the third child, as lon� as the child is a student and otherwise qualifies. The cost of this amendment as far as public funds is concerned only applies to the third child (similar to the pension for a first and second child). Any child in excess of , three would be paid out of the operational (General� fund, which is supported by �f of firefighters' salary. l
