Lillel:�oe PRIOR HEARING : March 24 , 1971 April 14 , 1971 SUBJ�CT : Letter dated February 22 , 1971, to Curtis M. Lillek�oc: enumerating Housing Code deficiencies located on the property at 409 Laurel Ave. during a survey on November 20 , 1970 , by Bureau of Health inspectors . APP�ARANC�S : Curtis M. Lilleboe. ' PROCEEDINGS : A letter dated April 19 , 1971 to Mr. Tom Anderson summarizing an inspection of the property by the Bureau of Publi_c Buildings was reviewed. Mr. Lilleboe stated that h� would lik� to keep the building if it is not going to be acquired by the IIousing Authority within the next three years . Mr. 1lnderson said that. Mr. Delbert Hoppe of the Housing Authority informed him .that t:}ic property would be considered for acquisition if so requested in writing by Mr. Lilleboe. Arlene Dixon Iiolmen SUBJECT : Notice of Condemnation and Order to Vacate dated April ') , 1971 from the Bureau of Health to Mrs . Robert Dixon, 411 North Western. APPEARANCLS : Mrs . Arlene Dixon Holmen. PROCEEDINGS : Mrs . Holmen lived on the property for nine years . The property at 411 Western is going to be acquired by the Fiousing Authority in the very near future and she plans to use that money to rehabilitate 761 Sylvan. She is asking for a six-month exten�.ion of time . ACTION: Moved by Peake to qrant a six-month extension of time as requested; further moved that the placard be suspended for that period of time; finally moved that the matter be reheard on October 27, 1971. APPEARAIdCES : Estelle M. Allbee. PROCEEDItdGS c Mrs . 1�llbee explained that she has lived on thi� premises for ten years . She and five children presently l.ivc� i.ri the house. She has done some plastering and carpeting in thc house since June. She has a son aged 16 , one aged 8, one ageci 9 , and two daughte:rs aged 10 and 11. A total of $2 ,600 is owed oii tlic house . ACTION : Moved by 6�ozniak to continue the matter for a period �f six months to permit correction of al1 Housing Code deficiencies with the exception of installing additional electrical outlets where requested. 2 � 4/2s/�l Meeti.nc� No. 50 � Further moved that the following deficiencies be corrected imme- diately : l. Repair or replace the illegal wiring in the £irst floor bedroom. 2 . Remove the illegal wiring in the first floor north bedroom. 3 . R�pair or replace the faulty electrical plug in the north second floor bedroom. 4. Repair or remove the bare electrical wires in the ceiling of the second floor southeast bedroom. 5 . Provide a safety valve for the hot water heater. 6 . Provide a gas shut-off valve f.or the hot water heater�. Seconded by Peake. Pentel SUBJECT : Notice of Condemnation dated April 14 , 1971 , from thc IIureau of Health to Irwin M. Pentel, 1726 St. Clair. APPEARANCES : Izwin M. Pentel. PROCEEDINGS: Mr. Pentel said the basement unit has been occu��iec� since at least 1942 . A concrete stairwell was put in then. T'rie windows are approximately 50� above grade. Mechanical ventilation has been installed in the bathroom. The bedroom is surrounded by the basement, .therefore he did not install a window as requesterl. The unit has two separate entrances . . . . G1enn Frickson �,aid the bedroom does not comply with the Life Safety Code which requires a direct means of egress to the outside. ACTION: Moved by Wozniak that the requirement of Sections 34 .01 , 54 .07 and 54 . 13 (4) of the St. Paul Legislative Code that no s�:>�ire in any cellar be occupied for sleeping purposes in order to a7.l.ow occupancy of the basement apartment. Further moved that. the requirement of Section 54 . 14 (1) of the St. Paul Legislative Cocic 3 4/2�3/7]. , 1�leeting TJo. 50 1 that th� window space be 10� of the floor area be waived for said apartment. Such waiver is granted until such time as the pro- perty be sold or any other right, title or interest be transferr_ed at which tirne said waiver be nullified. PROC�EUINGS : Mrs . Bachrach explained that all units are occupied by single people. Five units on the third floor share one double bathroom. Ten units on the secand floor share two double bath- rooms . Three units in the basement share one bathroom. 1111 units sharing bathrooms have cooking facilities . ACTION : Moved by Sommerdorf to waive Section 54 . 11 of the St. Pau.l. Legislative Code that each dwelling unit have its own complete bathroom to permit the sharing of bathrooms under present cir- cumstances . Such waiver is to be granted until such time as thc: property be sold or any other right, title or interest be trans- ferred at which time said waiver be nullified. Seconded by �i�ieso. " Meetinq No. i0 . . items not in accordance with the St. Paul Building Code. APPEARANCES : Mrs . George A. Westergren. PROC�EDINGS : Mrs . Westergren said items 1 and 2 in the Subj�ct of Appeal are all that are being appeal�d. A window in one of tl�e cellar apartments is quite small. Dirt could be removed to enl�irge the window. The furnace is contained in a sub-basement. Two apartments are sharing baths but this will be corrected. 1�,part- ment 2B if 5 ' from grade to floor and 2 ' from grade to ceiling. ACTION : Moved by Voigt to waive Sections 34 .01 , 54 .07 and 54. 13 (4) of the St. Paul Legislative Code that no place in any cellar bc used for sleeping purposes in brder to permit continued occupancy of the two existing basement apartments . Such waiver is granted on condition that all other code deficiencies be corr�cteci and that a Certificate of Occupancy be issued on such a basis . Seconded by Grove. Census Tracts 9 and 10 , The board unanimously agreed to accept appeals from the Phal�n arca Neighborhood Improvement Program, Concentrated Code Fnforcement Program on the following basis : l. The project director or his authorized representative may act as an agent for the appellants . 2 . A signature authorizing any appeal must be obtained from all appellants . 3. The project director or his authorized representative may represent an appellant at hearings before thc: board. 4.
