3 WHEREAS, the City of Saint Paul, on August 3Q 2002, received a Notice of License
4 Revocation from the State of Minnesota stating that M T Bears, Inc. owes delinquent taxes to the
5 State of Minnesota; and
7 WIlEREAS, M T Bears, Inc., d/b/a Billy T's Saloon has On-Sale Liquor and Sunday On-
8 Sale Liquor licenses for the premises located at 1082 Arcade Street in Saint Paul (License ID#:
9 0019265); and

I 1 WIIEREAS, Minn. Stat. §270.72, subd. 1 requires the revocation of any license for the
12 conduct of a profession, occupation, trade, or business held by an applicant who owes more than
13 $500.00 in delinquent tases or has not filed returns; and

WHEREAS, under said statute the State of Minnesota must notify the applicant of the
intent to require revocation of such license, and of their right to a hearing; and
WHEREAS, a hearing under this statute is expressly provided to be in lieu of any other
hearings or other proceedings required by law, which would include the hearing provisions of
Saint Paui Legislative Code §310.05; and
WHEREAS, the City has agreed with the Department of Revenue that the definition of
"revoke" as used in the stahxte is procedurally the same as the process used by the City of Saint
Paul for a license suspension; and
WHEREAS, the license suspension must be implemented within thirty (30) days of
receipt of the Notice of Tax Liability, and is in effect until the Commissioner issues a tax
clearance certificate; and
WHEREAS, no taac clearance certificate has been forwarded to the City of Saint Paul,
Office of LIEP, by either the applicant or the Commissioner of the Minnesota Department of
Revenue; now therefore, be it

Bears, Inc., d/b/a Billy T's Saloon for the premises located at 1082 Arcade Street in Saint Paul,
be and hereby aze suspended effecrive at 12:01 am. on Thursday, October 10, 2002, and will not
be reinstated until such time as the City of Saint Paui has received a tax clearance certificate from
the Commissioner of the Minnesota Deparhnent of Revenue, and has given written notice to the
licensee of the lifting of his suspension.
