Dear Sir:
This is written in response to the appeal of Lila Smith and Marilyn Wilzbauer
to relax the frontage and area requirements on property located on the northeast
corner of Bison Avenue and Midway Parkway, and noted in detail by the legal
description on file.
This matter was heard at the December 3, 1970, Board of Zoning meeting. The
staff reported that the City Architect had notified the appellants that a center
wall was approved as a common wall so that the structure could be considered as
two duplex buildings instead of a 4-plex. The staff reported that the west part
of the building meets the requirements of the Zoning Code but that the east part
of the structure is short in area and frontage. The staff report stated the degree
of variance requested and also noted three letters in opposition. The report
stated that the variances may be considered large, but that this deficiency could
be considered mitigated if the structure is viewed as a double duplex on the
combined sites. The report concluded that approval could be made subject to the
condition that the variance apply only for the life of the present structure and
that the three lots constituting this entire parcel not be separately sold but that
the entire parcel be permanently made available to residents of the eastern part
of the structure for parking and recreation purposes.
The attorney for the appellants said that the building was built in 1921, that
the structure was changed from a 5-plex to a double duplex, and that the appellants
had no intention of changing the site in any way. Iie said he felt that the variance
requested is small and that there is substantial space for parking. He said the
appellants cannot get a certificate of occupancy without this appeal being granted.
Several residents of the neighborhood appeared in opposition. They were
concerned that this action might allow this property to be used differently in the
future. In response to this, it was explained that only uses allowed under "A"
Residence zoning could be developed here without rezoning.
In considering this matter, the Board noted that since this site was zoned "A"
Residence, granting this appeal would not of itself allow multi-family use in the
future. It was moved and seconded to recommend approval. The motion carried by a
vote of 5-0.

Council Chambers of the City Hall and Court Rouse in the City of
St. paul at 10:00 s.m. on December 29, 1970 on the appeal of Lila
Smi.th and Marilya Wilzbauer to relax the frontage and area requires-
ments to al�ow the continued existance of a double duplex on the
Eastern portion of the property described as follows; Lots 19, 20
and 21, except the Northerly 36 feet of the 8ast 10.2 feet of Lot
21, Frankson'a �cmo Park Addition, St. Pau1, Minnesota. The prop-
erty is located on the Northeast corner of Bison Avenue and Midyay
Parkway.

A. ZONING ADMINISTRATOR: In a letter dated 9/9/70 the City Architect notified the
appellant thet the center wall was approved as a common wall and that the
structure would be considered as two duplex buildings and an appeal for a
variance from the density standards could be considered by the Board of Zoning
and the City Council.
B. HISTORY: On 8/1/69 the City Council referred to the Board of 7,oning an appeal.
to relax the density requirements for a double duplex on these same properties.
After investigation by the building inspector, it was determined that the
structure was not a double duplex as defined in the Zoning Code and the appeal
was returned to the City Clerk on 10/24/69.
C. PROPOSED USE: To continue the use as a double duplex.
D. NEED FOR APPEAL: The property as divided is to provide a separate legal
descrigtion for each duplex. The west part of the building meets the requirement
of the Zoning Code as it pertains to densities. The east part of the structure
is short in area and frontage.
E. PRESENT STANDARD: In an "A" Residence District a duplex requires a frontage of
50 feet and an area of 7,500 squere feet.
F. VARIANCE: The duplex under coneic3eration has a frontage of 45 feet, 5 feet or
10� short, and an area of 7,044.5 square feet, 455.5 square feet or 6.07% ahort.
G. AREA ZONING: The area in the vicinity of Frankson, Bison, and Pascal is zoned
Commercial; the rest of the area is zoned "A" Residence.
H, SITE CONDITIONS: The site is developed with a large residential structure and
a 4-car garage. The property is at street grade.
I. AREA CONDITIONS: The area north of Midway Parkway is predominately single-family.
One block west is Holy Childhood School and Church. South across Midway Parkway
is Lyngblomsten Nursing Home.
