1 BE IT RESOLVED, that, upon the petition of John Kratz, as documented in Real Estate Division File
2 Number O1-2002, public properties hereinafter described aze hereby vacated and discontinued as public
3 property;

5 The properiy to be vacated is described as follows:
that part of unimproved Albion Avenue lying west of the west right-of-way line of Lexington
Parkway and east of a line from the northwest corner of Lot 1, Hartman's Rearrangement to the
southwest corner of Lot 15, Block 19, West End Addition;

11 This vacation shall be subject to the terms and conditions of Chapter 130, codified Mazch l, 1981, of the
12 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall cause a twenty foot alley easement within Albion Avenue hereby vacated
to be dedicated on its redevelopment plat, the location of which easement to be subject to the
approval of the Department of Public Works.
That a Twenty foot wide permanent utility easement, centered on the existing 10 inch sanitary
sewer shall be retained on, over, under and across the vacated area on behalf of the City of Saint
Paul, Department of Public Works to reserve the right of the City to maintain and operate any
sewer in or upon said easement and to enter upon said easement ar any portion thereof at any
time and from time to time, for the purposes of future construction, reconstruction, inspection,
maintenance or repair of the same or any part thereof. Said utility easement shall be subject to
the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normai access to utility facilities for maintenance purposes
will be permitted within the easement area.

1 b. Improvements in or upon the above described easement that do not prohibit the City from
2 exercising its reserved rights may be allowed by obtaining written permission from the
3 Department of Public Works Sewer Division with the understanding that the restoration
4 and costs of such improvements shall be the sole responsibility of the petitioner, its
5 successors and assigns in the event the City exercises its reserved easement rights.

a Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, all removal,
replacement or modificarion costs shall be borne solely by the petitioner.

No change from the e�sting grade within the easement azea will be pernutted without
written pernussion from the Deparhnent of Public Works.
No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
£ The petitioner, its successors and assigns shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
clanns which shall arise from any injuries or damages received or sustained by any break
in any service pipe or connection in said reserved easement arising out of or resulting
from any action or negligence of the petitioner, its employees, agents, or business
invitees.
That the petitioner shall be responsible for having a land surveyor, licensed with the State of
Minnesota, locate and protect, during the development, the existing monument at the southwest
corner of Albion and Lexington. The petitioner shall also search for a monument at the
southwesterly corner of Lot 15, Block 19, West End, and submit a sighed statement of the
findings.
That the petitioner sha11 be responsible for the reconstruction of the intersection of Albion and
Lexington Avenue to the satisfaction of the Deparhnent of Public Works, including, but not
limited to, new curbs, drainage structures, sidewalk, boulevard and signs, to remove all
appeazances of street right-of-way.
That the petitioner shall be responsible for the construction and maintenance of its private drive
and its private utilities that may be installed in the alley and sewer easements required in
conditions 2 and 3 above.
That a permanent utility easement shall be retained on, over, under and across that part of the
vacated area lying north of a line 10.00 feet north of and parallel to the south line of said vacated
azea to protect the interest of Northern States Power Company, d.b.a. Xcel Energy.
That a new easement shall be dedicated to Northern States Power, d.b.a. Xcel Energy, for the
relocation of its electrical facilities, the full cost and expense of said relocarion to be borne by the
petitioner.

That, except as described in the condirions above and with the accompanying Utility Easement
Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest Communications,
Incorporated, Northern States Power Company, d.b.a. Excel Energy, District Energy St. Paul,
Incorporated, MCI Metro Incorporated, A.T. & T. Broadband, the Board of Water
Commissioners, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the above described
vacated azea.
That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
27 14. That the petitioners, their successors and assigns shall, within 6Q days of the effective date of this
28 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
29 and shali, within the period(s) specified in the terms and conditions of this resolution, comply in
30 all respects with these terms and conditions.

The Department of Public Works has completed a review of the above referenced vacation
proposal. In 1912 all of the streets in West End Addition, north of Montreal Ave., south of
Montcalm Court, west of Lexington and east of Edgcumbe Blvd,. were vacated, except for the
portion of Albion now being requested. This portion of Albion and the above referenced
portions of alley are now the only remaining platted access to the entire network of platted alleys
in Blocks 14, I5, 16, 17 and 19, and also the only platted access to the two park properties,
Dawson Pazk and Walsh Park. Therefore we recommend denial of the alley vacations and
recommend approval of the Albion Avenue vacation, subject to the following:
1. That the petitioner shall cause a 20 foot alley easement within vacated Albion Avenue, to be
dedicated on their redevelopment plat; the location of which shall be subject to the approval of
the Department of Public Works.
2. That a 20 foot wide permanent utility easement, centered on the existing 10" sanitary sewer
sha11 be zetained on, over, under and across the vacated area on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any sewer in
or upon said easement and to enter upon said easement or any portion thereof at any time and

from time to time, for the purposes of future construction, reconstruction, inspection,
maintenance, or repair of the same or, any part thereof. Said utility easement shall be subject to
the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage,
fixture, or any other objects which may prohibit normal access to utility facilities
for maintenance purposes will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the
City from exercising its reserved rights may be allowed by obtaining written
permission from the Department of Public Works Sewer Division with the
understanding that the restoration and costs of such improvements shall be the
sole responsibility of the petitioner, its successors and assigns in the event the City
exercises its reserved easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.
d. No change from the existing grade within the easement azea shall be permitted
without written permission from the Department of Public Works Sewer Division.
e. No change in surfacing within the easement area shall be permitted without
written permission from the Department of Public Works Sewer Division.
f. The petitioner, its successors and assigns shall £ully indemnify, defend, and save
harmless the City of Saint Paul, its officers, agents, employees, and servants from
ali suits, actions, or claims which shall azise from any injuries or damages
received or sustained by any break in any service pipe or connection in said
reserved easement arising out of or resulting from any action or negligence of the
petitioner, its employees, agents, or business invitees.
3. That the petitioner shall be responsible for having a land surveyor licensed with the State of
Minnesota, locate, and protect during their development, the existing monument at the southwest
corner of Albion and Lexington. Said surveyor shall also seazch for a monument at the
southwesterly comer of Lot 15, Block 19, W est End and submit a signed statement of their
findings.
4. That the petitioner shall be responsible for the reconstruction of the intersection of Albion and
Lexington Avenue to the satisfaction of the Department of Public Works, including, but not
limited to, new curbs, drainage structures, sidewalk, boulevard, and si�s, to remove all
appearances of street right-of-way.

drive and their private utilities, which may be installed within the a11ey and sewer easements

The Division of Parks and Recreation will not object to the street and alley vacations
proposed under TMS File No. O1-2002, provided that a 20 foot wide access easement is
retained over both the vacated street and the adjoining alley, with the final grading and
landscaping plan subject to approval byParks and Recreation.

The Division of Parks and Recreation is responsible for maintenance of both Walsh Park
and Dawson Park, which are located near the proposed development. The only access to
these parks is via unimproved Albion Avenue and the adjoining alley, and while the need
for access is infrequent, we must none-the-less retain an easement to do so.
