In the Matter of condemning and taking an easement in the land necessary for the
slopes, cuts and fills, including right of remonal of lateral aupport from subject

under Preliminary Order 2�0914 approved october 23� 1970
The Council of the City of St. Paul having received the report of the Commissioner of Finanee
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approve,d'and adopted, and the said improvemenx
is hereby ordered to be proceeded with.
2. That the nature of the impmvement which the Council recommends is
to condema and take an eaeement in the Iand necessary for the slopes, cuts and.
fills, including right of removal of l,ateral support frc� subject land or r�mafnder
theraof, occasioned b}r excavations thereof or eonstruction of slopes in the grading
and surtacing with bituminous material the alley in Block 12, Prospect. Plateau, from
Bancroft to Anita, to a width of 16 fee�, ,in accordanee with the blueprint hereto

portioas showing the fills, .
with no alternatives, and that the e$timated cost thereof is $ 110,00
Resolved Further, That a public hearing be had on said improvement on the '�r� day of
Februarv, 1971 , at the hour of 10 o'clock A.M., in the Council Chamber of the Court
House and City Hall Building in the City of St. Paul. That the Commissioner of Finance give notice of
said meeting to the persons and in the manner provided by the Charter, stating the time and place of
hearin,g, the nature of the improvement and the total cast thereof as esti�nated.
