THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Tha.t permission and authority are hereby granted to Shamrock Court Apartments to construct a public sewer in an easement described as follows : The Easterly 32 feet of the Westerly 62 feet of the North 287.12 feet of the following described property: Except the North 150 feet� and except the East 150 feet; � the following: The East 1/2 of the NE 1/4 of the NE 1/4 of Section 11, Township 28� Ra.nge 22 lying South of the South line of Lower Afton Road and North of a line running Westerly at right angles from a point on the Easterly 1/4 section line, said point being 330 feet North of the 1/4 1/4 Section Corner� Ramsey County, Minnesota; said public sewer to serve: � Except the North 150 feet, and except the East 150 feet; the following: The East 1/2 of the NE 1/4 of the NE 1/4 of Section 11, Township 28, Ra.nge 22 lying South of the South line of Lower Afton Road and North of a line running Westerly at right angles from a point on the Easterly 1/4 Section line, said point being 330 feet North of the 1/4 1/4 Section Corner, Ra.msey County, Minnesota. That the Commi.ssioner of Public Works is hereby authorized to issue a permi.t to Shamrock Court Apartments for the construction of such public sewer upon and subject to the following provisions, terms and conditions : a. Tha.t said permittee sha.11 construct said sewer entirely at its own expense� under the supervision and to the satisfaction of the Commissioner of Public Works� and in accordance with the plans and specifi- cations prepared by him. That said permittee shall pay the cost of engineer- ing and inspection of said work, and for the publication of this ordinance. c. Tha,t said permittee sha.11 properly protect all excavations ma.de in the streets both day and night so as to avoid all dama.ge or injury to persons or property; shall properly fill and tamp such streets to avoid settling, and sha.11 restore such streets to their origina.l condition. d. That said permittee, after the inception of said work, shall prosecute the same continuously with diligence, and fully complete said work to the satisfaction and approval of said Commissioner on or before July 1, 1972. e. That said permittee expressly agrees and undertakes to fully indemnify and hold harmless the City of Saint Paul, its agents, officers and employees from any and all dama.ges, claims, losses, judgments, suits or expenses arising out of or occasioned by the per- formance of the work contemplated by this permission and authority. f. Tha.t said permittee shall furnish a bond to the City of Saint Paul in the sum of Ten Thousand Dollars ($10,000.00), conditioned to comply with all the terms of this ordina.nce and to indemnify and save ha.rmless said City of all liability, loss, judgments, suits, costs, charges and expense tha.t may accrue to persons or property occasioned by the making of the improvement or arising out of the same. g. That said permittee shall not proceed to construct said sewer unless and until said permittee shall ha.ve fully complied with the provisions regarding insurance and indemnification contained in the City of Saint Paul, Department of Public Works Specifications for Street and Sewer Construction, dated April 1, 1959, Section numbered 1.44 of said specifications, as amended, applicable to contractors. For the purposes of this ordinance, the aforesaid section of said specifications, numbered 1.44, as amended, shall be read as though the word "permittee" was substituted for the word "contractor", wherever the same appears in the aforesaid Section 1.44, as amended. Said Section 1.44, as amended, of the Specifications for Street and Sewer Construction in the City of Saint Paul is hereby incorporated herein by reference as fully and as completely as if set forth herein ver- batim. Proof of compliance with provisions of the aforesaid section shall be in such form as the Cor- poration Counsel of the City of Saint Paul ma.y direct, and the documents required by the aforesaid Section 1.44 sha.11, after submission to the Corporation Counsel, be filed in the office of the Comptroller of the City of Saint Paul. h. That said permittee shall submit said bond and insur- ance documents to the Office Engineer of the Department of Public Works . The Office Engineer shall request approval of said documents by the Corporation Counsel and upon approval shall file said documents with the office of the Comptroller of the City of Saint Paul.
