The St. Paul Pofice Department will conduct a Law Enforcement Certificate Program for 51 Police
Officer Recruits, which includes 16 Metropolitan State University students. The Metropolitan State
University will reimburse the Saint Police Department for the training provided.

PILOT LAW ENFORCEMENT CERTIFICATE PROGRAM
Memorandum of Aqreement
THIS JOINT POWERS AGREEMENT (hereinafter "contract") is between the
State of Minnesota, acting through its Board of Trustees of the Minnesota State
Colleges and Universities, on behalf of Metropolitan State University (hereinafter
referred to as "Metropolitan State University") and the City of Saint Paul,
Minnesota through its Pofice Department (hereinafter referred to as "St. Paul
Police Department"), both political subdivisions within the State of Minnesota,
which are empowered to enter into joint powers agreements pursuant to Minn.
Stat. � 471.59, subd. 10.
1. Metropolitan State University will offer a pilot law enforcement certificate
program in collaboration with the St. Paul Police Department. The certificate
program will be composed of 26 semester credits and will cover, at a minimum,
all POST learning objectives.
2. St. Paul Police Department will provide instruction and facilities for all aspects
of the program. The community faculty/instructor of record witl be Commander
Matthew Bostrom, head of the departmenYs training division or whomever might
subsequently hold that position. Resumes for ail primary instructors will be
provided to Metropolitan State University, as well as bios for special content
instructors.
3. The faculty/instructors who are employees of the St. Paul Police Department
will remain employees of the Department and other faculty/instructors who
provide instruction for the program will be subcontractors of the St. Paul Police
Department.
4. The certificate program cohort will be composed of 32 students, 16 of whom
wiil be St. Paul Police Department cadets. All students wiil be registered for the
law enforcement certificate program at Metropolitan State University.

5. All students will provide Metropolitan State University with official transcripts
documenti�g that they have an earned baccalaureate degree from an accredited
institution.
6. Grading will be pass/fail, but students wiil be given the option of letter grades.
7. Metropolitan State University will pay the St. Paul Police Department a total of
$126,688 (based on 16 non-cadet enrollment). The St. Paul Police Department
will pay $81,088 tuition for 16 students. (The following formula will be used for
payment: $126,688 less $81,088 results in payment from Metropolitan State
University to the Saint Paul Police Department in the amount of $45,600.)
Payment shall be made by Metropolitan State University according to the
following schedule:
522,800 on Octuber 15, 2002
$22,800 on February 3, 2003
both payments to be subject to acceptance of the services provided by the St.
Paul Police Department by Metropolitan State University's authorized
representative (Ms. Virginia Lane, Executive Director, School of Law
Enforcement).
8. The St. Paul Police Department shall indemnify, save, and hold Metropolitan
State University, its representatives and employees harmless from any and all
claims or causes of negligent action, including all attorney fees, incurred by the
Metropolitan State University, arising from the performance of this contract by
the St. Paui Police Department or its agents or employees. This clause shali not
be construed to bar any legal remedies nor to hold the St. Paul Police
Department responsible for attorney fees for Metropolitan State University,
where the St. Paul Police Department may have claims or causes of action for
Metropolitan State University's failure to fulfill its obligations pursuant to this
contract. The liability of both parties shall be governed by the provisions of the
Minnesota Torts Claims Act and other applicable law. �Approved rev�sed section

9. The St. Paul Police Department must comply with the Minnesota Government
Data Practices Act, Minn Stat Chapter 13, as it applies to all data provided by
Metropolitan State University in accordance with this contract, and as it applies
to all data created, collected, received, stored, used, maintained or disseminated
by the St. Paul Police Department in accordance with this contract.

10. This contract shall be effecfive on September 3, 2002, or upon the data that
the final required signature is obtained, whichever occurs later, and shall remain
in effect until January 24, 2003, or until all obligations set forth in this contract
have been satisfactorily fulfilied, whichever occurs last.
