1 WI�REAS, the Ciry of Saint Paul ("City"), as part of its public improvement project to construct
2 Phalen Boulevard, is in need of permanent and temporary easements from properry owners affected by
3 said project; and

5 WHEREAS, Richard A. Wybierala, a property owner affected by said project, has agreed to assign the
6 easement rights to the City for a permanent sewer easement and permanent utility easement, which are
7 necessary for the construction of Phalen Boulevard; now, therefore be it
9 RESOLVED, that the proper City officials, on behalf of the City of Saint Paul, are hereby authorized
10 and directed to accept the easement rights assigned by Richard A. Wybierala and to file said easements
11 with Ramsey County.

The City plans to begin construction of one of the inifial phases of the Phalen Boulevard project Before
contracts may be awarded, the City must acquire all the necessary property rights. As part of that
acquisition prceess, a permanent sewer easement and permanent urility easement must be purchased from
property owner in the project area. This resolution authorizes the City to accept those easements.
