LEASE AGREEMEIVT
THIS AGREEI�'IEN`T, Made and entered into this day of
, 1971, by and between the CITY OF 3A�AUL, a mun-
lci�pa� corporation of the State of Minnesota, hereina.fter referred
to as "City", and the COUNTY OF RAMSEY, a subdivision of the State
of Minnesota, hereinafter referred to as "County";
WITNESSETH:
WHEREAS, The County is authorized by La.ws 1969, Chapter 1055,
to acquire from any source, by purchase, gift, lease or condemna-
tion, sites for eight Artificial Ice Arena.s to be maintained and
operated by the County; and
WHEREAS , The County ha.s requested that the City lease, at no
compensation, a portion of the City' s property located in the
vicinity of the City' s Midway Stadium for the purpose of construct-
ing an Artificial Ice Arena; and
WHEREAS , The City desires to cooperate with the County in
making possible the construction of the said Artificial Ice Arena;
NOW, THEREFOZE, THE CITY A.ND COUNTY AGREE AS FOLLOWS :
l. The City, for the consideration hereina.fter set forth,
does hereby let unto County certain property located within the
City of Saint Paul, Ramsey County, State of Minnesota, described
as follows, for a term of ninety-nine (99) years, commencing the
day and year first above written.
The North 152 feet of the South 987 feet of the East
270 feet of the West 591 feet of the Southwest
qua.rter of the Northwest qua.rter of Section 27, Township
29� North, Range 23 West, subject to streets.
2. County agrees to use the above-described real property
for the co�str-sctio:� and operation of an Artificial Ice Arena Diily,
and if the use of the demised premises for an Artificial Ice Arena
is discontin�ued by the County, this Lease sha.11 termina.te, and the
City shall be entitled to possession of the leased premises with-
out further action by either the City or County.
3. County agrees to operate the Artificial Ice Arena. in the
ma.nner set forth in La.ws 1969, Chapter 1055, and, further, that it
wi11 extend the use of the facilities free to public, parochial and
private secondary schools located in Ramsey County, and such other
free uses as the County shall be permitted to provide.
4. County shall construct, operate and maintain this Artifi-
cial Ice Arena. in strict com�liance with a11 applicable laws and

at its o•�rn cost and expense, and County expressly agrees and under-
takes herewith to fully indem:.�ify and hold harmless and defend the
City, its agents, officers and e�plo�ees from any and all dam�ges,
claims, losses, judgments, suits, expenses, actions or causes of
action of whatsoever m,�.nner arising out of or occasioned by the
occupation or use of the demised premises by the County.
Upon the termination of this Lease Agreement or �he discontinued
use of_ the demised premises for an A.rtificial Ice Arena, the County
expressly agrees, at its own expense, to remove a11 improvements
on the demised premises and to restore .the demised premises to its
original condition and to the satisfaction of the City.
At a11 times during the term of this Lease, City sha.11 have the
right to enter into and upon the demised premises and improvements
thereon during reasonable business hours for the purpose of examin-
ing and inspecting the sane and determining w'nether �he County sha11
have complied with its obligations hereunder in respect to the care
and maintena.nce and use of the premises.
IN WITNESS WHEREOF, The City and County have caused this Leas e
Agreement to be executed purs�.ant to authority of its City Council
- and Board of Coanty Commissioners, respectively, as of the day and
year first above written.
