1 WHEREAS, the Office of License, Inspections and Environmental Protection initiated
2 adverse action against the Grocery (C) license held by Gehad Elfarra, d/b/a Kormann's
3 Superxnazket for the premises located at 719 Burr Street by Notice of Violarion dated July 19,
4 2002, alleging an illegal sale of fireworks at the store on June 25, 2002; and
6 WHEREAS, the Notice of Violation advised the licensee of the right to contest the
7 allegation, and fiirther advised that the recommended penalty was a fine of $500, and that if there
8 was no response to the letter that the matter would be placed on the consent agenda and the
9 recommended penaity would be imposed; and

11 WHEREAS, no response to the Notice of Violation was received by the City Attorney's
12 Office or the Office of LIEP; now, therefore be it
13
14 RESOLVED, that a fine of $500 is hereby imposed upon the Grocery (C) license held by
15 Gehad Elfarra, d/b/a Kormann's Supermarket for the premises located at 719 Burr Street for
16 illegal sale of fireworks at the store on June 25, 2002. Said fine shall be paid to the Office of
17 LIEP within thirty days of the passage and approval of this resolution.

Please take notice that this matter has been set on the Consent Agenda for the Council
meeting scheduled for 3:30 p.m., Wednesday, September 18, 2002 in the City Council
Chambers, Third Floor, Saint Paul City Hail and Ramsey County Courthouse.
Enclosed aze copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested matter, in that the
facts concerning the sale of fireworks have not been denied. As indicated, this matter has been
placed on the consent agenda portion of the City Council meeting, during which no public
discussion is ailowed. The recommendation of the license office is for a$500.00 fine.

Dear Mr. Elfana:
The Office of License Inspections and Environmental Protection (LIEP) has
recommended adverse action against the grocery (C) license held by you for the premises located
at 719 Burr Street in Saint Paul. The basis for the recommendation is as follows:
On June 25, 2002 police received complaints about sales of
fireworks at your establishment, specifically that underage
individuals were being permitted to purchase fireworks and
that illegal fireworks were being sold. Police observed the
store at approximately 12:22 p.m. and watched an individual
enter the store and return with ten packs of Black Cat
firecrackers. The police then went into the store and spoke to
Suod Mustof Salem, who admitted being advised several da��s
earlier that he could not sell firecrackers, as they were not legal
fireworks under the new law. Rather than getting rid of them,
he put them underneath the counter, and the clerk who Fvas
present admitted selling them five minutes before the officers
came into the store.
If you do not dispute the above facts please send me a letter �vith a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear and speak on
your own behalf, or to have someone appear there for you. The recommendation of the license
office is for a�500 fine.

On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearin� before an Administrative Law Jud�e (ALJ). If you wish to have such a hearing, please
send me a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing," so you will know when and where to appear, and what the basis for the hearin� will be.
In either case, please let me know in writing no later than Monday, July 29, 2002,
how you would like to proceed. If I have not heard from you by that date, I will assume
that you are not contesting the facts. I will then schedule this matter for the St. Paul City
Councii and have it placed on the Consent Agenda during which no public discussion is
allowed and the recommended penalty will be imposed.

NARRATIVE
I OFF. KOEHNEN AND OFF. FORD CURI2ENTLY ASSIGNED TO THE FORCE UNIT. THE
FORCE UNIT DEALS WITH PROBLEM PROPERTIES AND STREET LEVEL NARCOTICS.
ON TODAYS DATE WE WERE ASSIGNED TO THE RAIL ROAD ISLAND AREA WHERE
THERE HAS BEEN MANY COMPLAINTS AT THE BURR/MINNEHAHA INTERSECTION. THE
COMPLAINTS VARY FROM PEOPLE LOITERING AT KORMANS MARKET, SELLING
NARCOTICS AND BLOCKING TRAFFIC. DUE TO THE MANY COMPLAINTS THIS
INTERSECTION IS NO TOLERANCE AREA.
WHILE OUT ON FOOT IN THE AREA WE WERE TALKED TO A FEW NEIGHBORS WHO WERE
CONCERNED WITH ALL THE ACTIVITY HAPPENING AT KORMANS MARKET. THEY STATED
THAT YOUNG JUVENILES ARE COMING AND GOING TO THE STORE AND HANGING OUT
FOR LONG PERIODS OF TIME. ON OF THE INDIVIDUALS STATED THAT THE OWNER OF
THE STORE WAS ALLOWING FIRECRACKERS TO BE SOLD ILLEGALLY OUT OF KORMANS
MARKET AT 719 BURR. THIS PERSON STATED THAT HE! SHE WISHED TO REMAIN
UNANIMOUS; HOWEVER HE/SHE STATED THAT HE/SHE WOULD TRY TO BUY SOME
FIRECRACKERS FOR US. AT THIS POINT HE/SHE WALKED TO THE STORE WITH US
WATCHING HIM THE WHOLE TIME. HE/SHE WENT INTO THE STORE AND RETURNED TO
OUR LOCATION WITH IN A COUPLE OF MINUTES. HE/SHE THEN HANDED US 10 PACKS OF
BLACK CAT FIREWORKS, WHICH HE/SHE SAID WAS PURCHASED FROM A BLK/FEMALE
WHO WAS BEHIND THE COUNTER FOR 5 DOLLARS OF HIS OWN MONEY. HE/SHE STATED
THAT WHEN THEY WENT INTO THE STORE HE/SHE ASKED WHAT THEY HAD FOR SALE
POINTING TO A DISPLAY OF LEGAL FIREWORKS THAT WHERE IN FRONT OF THE STORE. "
THE FEMALE BEHIND THE CQUNTER STATED THAT SHE HAD SOME OTHER STUFF
BEHIND THE COUNTER. SHE THEN PULLED OUT SOME BLACK CAT FIRECRACKERS FROM
A BROWN BOX BEHIND THE COUNTER. HE/SHE THEN BOUGHT 10 PACKS OF BLACK CAT
FIRECRACKERS FOR 5 DOLLARS AND LEFT THE STORE..
A SHORT TIME LATER WE WENT TO THE STORE AND TALKED TO THE OWNER WHO
IDENTIFIED HIMSELF AS OD MUSTAF SALEM 2-1-62 WE
ALSO OBSERVED A BLK/F � IND THE COU IDENTIFIED
TO THE OW jA ��D TO H� THE SII TUqTIpN, HE TOLD ME THAT HE H D
SOME BLACK CAT FIRECRACKERS BEHIND THE COUNTER AND THAT HE WAS TOLD A
FEW DAYS AGO BY A EASTSIDE PATROLMAN NOT TO SELL FIRECRACKERS ANYMORE
AND TO GET RID OF THEM. I THEN ASKED HIM WHY HE HAD THEM Aiv'D WHY DIDNT HE
GET RID OF THEM. HE STATED THAT HE HASNT HAD TIME TO GET RID OF THEM. I THEN
EXPLAINED TO HIM THAT SHORTLY BEFORE WE GOT THERE THE FE�IALE WHO WAS
IDENTIFIED AS JADE ONEAL SOLD SOME FIRECRACKERS FROM BEHIhD THE COU\TER.
AT THIS POINT SALEM ASKED ONEAL IF SHE SOLD ANY FIRECRACKERS TO ANYONE
TONIGHT WITH HER STATING THAT SHE SOLD SOME TO A WHITE/MALE ADULT 15
MINUTES PRIOR TO US ARRIVING. MYSELF AND OFFICER FORD R'ERE STAhDING \EXT
TO THEM AT THE THE TIME OF THE ADMISSION. THEY BOTH STATED THAT THEY
THOUGHT IT WAS OK TO SELL FIRECRACKERS TO ADULTS ALO�G AS THEY WERE OVER
18 YRS OF AGE. I THEN EXPLAINED TO THEM THAT IT WAS ILLEGAL TO SELL THELf OR
HAVE THEM IN THERE POSSESION. SALEM THEN WENT BEHIND THE COUNTER AND
TURNED OVER TO US 30 BRICKS OF BLACK CAT FIRECRACKERS OVE BOX H?D 24 BRICKS
INSIDE AND THE OTHER HAD 6 BRICKS INSIDE. THESE ITEMS WERE RECOVERED AND
TURNED INTO THE EXPLOSNES LOCKER ALONG WITH THE 10 PACKS THAT WERE
ORIGINALLY BOUGHT.
