' OFFICE OF THE CITY CLERK ' COUNCIL R LUTION—GENERAL FORM PRESENTED BY COMMISSIONE ATF W�iEREAS, Agreement ha.s been ma.de by and between the City of Saint Paul and the City of West Saint Paul whereby standby fire service would be provided to the City of West Saint Paul accord- ing to the terms and conditions therein stated, and it is the intent to amend the said Fire Service Contract, dated the 28th day of May, 1970, so as to permit a refund of unexpended charges in case of cancellation of the said contract; now, therefore, be it RESOLVED, That the Council of the City of Saint Paul does hereby approve the said addendum to Fire Service Agreement between the City of Saint Paul and the City of West Saint Paul, dated the 28th day of Ma.y, 1970, a copy of said Addendum to Agreement being attached hereto and incorporated herein by reference� and the Mayor� City Clerk, Commissioner of Public Safety, and Comptroller are hereby directed to execute the said Addendum to Agreement on beha.lf of the City of Saint Paul. Paul , a municipal corporation organized and existin� under � and by virtue of the laws of the State of hiinnesota , � hereinafter referred to as "City" , and the City of West f Saint Paul , a municipal corporation , hereinafter referred � to as "Applicant" ; � F W3TNESSETH : � � � i i WHEREAS , City and Applicant have entert�d into a Fire Service � Contract , dated the 28th da,y of ?�1ay , 1g70 , whereby City ` agreed to furnish upon certain terms and conditions contained � therein, equipment and personnel of the City' s Fire Departr�ent ; for protection of property situated within the Anplicant ' s ` corporate limits , and the City and Applicant desire to amend the said agreement so as to permit a refund of the annual s payment in the case of cancellation �of the contract by either E party during the term thereof; ` � NOW, TfiEREFORE , City and Applicant do hereby agree that the above referenced agreem�nt between t'�e parties , dated the 28th day of Niay , 1970 , be and is hereby amended be deleting the last para�raph thereof and insertin�; the followin; in lieu thereof: P "This contract shall be for a continuous term, ' sub�ject , however , to cancellation by either party � upon thirty days ' written notice .
