This is written in response to the appeal of Frederick J. Blees to permit use of a building of insufficient area as a 3-plex on the southwest corner of Burr Street and Case Avenue. This property is further described as: North 10 feet of the east 98 feet of Lot 11 and the east 98 feet of Lot 12, Block 9, Edmund Rice's lst Addition. This matter was heard by the Board of Zoning on December 17, 1970 at which time the staff reported that the variances requested involve 34.66% of the square footage and 8% of the frontage. The staff noted that this site was rezoned to "C" Residence on October 3, 1970 in order to continue use of the building as a 3-plex. Mr. Frederick Blees appeared on behalf of the appeal saying that the structure has been used as a 3-plex for 35 years and that he does not pl.an to build an apartment on this site. In considering this matter, the Board discussed parking problems in the area and noted that the City Council changed the zoning on this property by means of a negative easement. Subsequently, the Board heard a motion to recommend approval of this appeal since it is a hardship case and the structure has existed for so many years. HISTORY: This site was rezoned to "C" Residence on 10/3/70 in order to continue use of the building as a 3-plex. The Zoning Board recommended denial of the rezoning. C. NEED FOR APPEAL: The existing 3-plex in a "C" Residence District does not have the required frontage and area. D. PRESENT STANDARDS: A 3-unit structure in a "C" Residence District requires an area of 6,900 square feet and a f.rontage of_ SQ feet. I:. VARIANCE: 'i'tiis I�roperty has a frontage oI 46 fec�t on Burr Street, 4 feet or 8% short of t}ie required frontage. The area of the site is 4,508 square feet, �ohich is 2,392 square feet or 34.66% short of the required area. F. The are� required is 6,9Q0 square fee�, and the subject site contains 4,508 square fe�t, resulting in a 34.66� variance.
