The meeting was called to order at 1:32 p.m.
STAFF PRESENT: Michael Urmann, Fire Prevention; Joe Yanarelly, Code Enforcement
977 Fuller Avenue (Laid over from 8-27-02)
Richard Hawke, attorney, appeazed and stated they aze still inclvng forward. He just got off the
phone with Pattie Kelley (Plamiiiig and Economic Development). It now looks promising that
Cherie Eula Johnson (owner) will get funding that way. Ms. Keiley is optimistic that she has
everything now, and they will be abie to commit loans to Ms. Johnson. A backup source has
been identified.
Gerry Strathxnan laid over this matter to the October 8, 2002, Praperty Code Enfarcement
meeting. He taiked to Ms. Kelley earlier today, and she is optimisric that they will be able to
make a loan in this case.

Mike Urmann reported the appeilant was appealing the order to reduce the nuxnber of occixpants
to four ox less. He is not sure why they are appealing now because the original orders were f1pri1
10, 2002.

Michael Urmann reported that this should be the standard appeal.
Gerry Strathman granted the variance on the nonconforming doors on the following conditions:

fire rated door assemblies; 2) The building will otherwise be maintained in compliance with a11
applicable codes and ordinances.
975 Cromwell Avenue
Ronald J. Dufault, owner, appeazed and stated he is looking for a delay in the order so he has
sufficient time to clean up the property. There aze concrete sidewalk blocks and some wood that
will be thrown away. Regarding the blocks, he put in about 10 feet on Saturday and has about 35
feet more to go, which will take approximately 32 hours. After that, he will get a dumpster to get
rid of the other rubbish.
Gerry Strathman asked can he get the dumpster sooner. Mr. Dufault responded it is hard to get
one in the azea because of where the blocks aze located. It is a marginal area anyway to get a
dumpster in because of power lines above the area.
Mr. Strathman asked when will the sidewalk be finished so he can get the dumpster in. Mr.
Dufault responded most will be done by the end of the weekend if there aren't any major
rainstroms in the next couple of days. There will be another eight feet to complete after that.
Joe Yanareliy reported he issued the orders on August b, 2002, and the notice was sent August
20. He told Mr. Dufault that it could not be extended anymore.
Mr. Strathman asked is anything there hazardous. Mr. Dufault responded there is nothing
hazardous. There are some aquariums. The complainant says it looks like a garden stare back
there, and it basically does. There are hundreds of pots and walking stones.
Mr. Strathman asked can it be cleaned up in a month. Mr. Dufault responded yes.
Mr. Dufault stated there is a bathtub that is used as a water garden. He would like Uiat to remain.
Mr. Strathman responded as long as it is a well kept yard fixture and is in working order, that is
fine. If it is just being stored there, that will not be okay. Mr. Yanarelly responded as long as it
is in the yard, that will be okay.
Mr. Strathman extended the compliance date to October 1, 2002, on the Conection Notice dated
August 20, 2002. If the yazd is not cleaned up by October 1, Code Enforcement will take action
to clean it for hixn. It will be expensive for the owner if the City cleans it. Mr. Yanazelly added
it will cost thousands of dollars if the City removes a11 of it.
124 Dale Street North
Ann M. Webster, owner, appeared and stated she needs the gazage and deck torn down this yeaz.
Half of the Second Floor and part of the Third Floor is the Third Fioor apartment, wluch needs
$50,000 to $100,000 of work. It has been vacant for over a year. 5he has not been working this
year, and does not have the funds to repair it. Mike Ricketson (Fire Prevention) suggested that
she close off the Third Floor and turn the building into a duplex. The building was built as a

duplex, and an efficiency apartment was added on each end. She could convert it back to a
duplex, which is the way she has been renting it anyway.
Ms. VJebster stated the Second Floor has been almost completely renovated. She rented it out to
a tenant, and that aparhnent is approved. The exit door from the Second Floor is not being used
anyway. She was told that if she took the door out, put a window in or something, that would be
okay.
The First Floor efficiency and the front apartment were opened up as one unit, stated Ms.
Webster. The First Floor was like a tuck under gazage, but it was rotting. It was torn down. She
ran out of funds to rebuild. She cleaned it up and put the railings back in. T`he neighbors were
probably complaining. It is almost completely torn down.
Mr. Strathman asked what she wanted to do. Ms. Webster responded she would like to convert
the building back to dupiex status. In that way, it would be up to code.
Mr. Stratlunan asked would she have to make any major repairs. Ms. Webster responded for a
while. She wouid clean up the garage area, but she would sYill have the Third Floor to deal with.
She had a teenager up there that wrecked it.
Mike Urmann reported he spoke at length with Inspector Ricketson today. This has been a long
term problem. The original orders came out November 5, 2001. The orders that exist today
existed then. There have been no addirional orders. Around May 14, 2002, it became necessary
to revoke the Certificate of Occupancy. The owner and tenant continued to occupy the building
with a revoked Certificate of Occupancy. Rather than citing them and bringing them to court, the
field inspector deternuned that it would be more accurate to condemn the building. At this point,
they condemned the building, and expect it to be in full compliance by September 23, 2002. The
only new order is the condemnation.
Mr. Strathman asked about the proposal to make it a duplex and what she has to do to convert to
a duplex. Mr. Urmann responded that has been an option since November 5, 2001. She has
proposed several times to make that change. If she had made motion to do that, Fire Prevention
would have accepted it. Because there has been no action, they moved to condemn the whole
building. She wouid haue to obtain zoning approval to change from a triplex to a duplex.
Mr. Strathman asked is there any reason to believe zoning would deny the application. Mr.
Urmann responded he has not had an opporhuiity to research this with zoning.
Mr. Strathman stated he understands the property is condemned, but he does not get the
impression it is an immediate hazazd. Mr. Urmann responded there aze hazards referring to the
disrepair of the garage and missing guardrails and handraiis that could cause someone to fall ten
feet. This was why it became necessary to condemn the building.
Mr. Strathman asked about the lack of fire alarms. Ms. Webster responded she has hard wire and
battery opexated backup, but Mr. Urmann asked for interconnected ones.

Gerry Strathman laid over this matter to the October 8, 2002, Properry Code Enfarcement
meeting. In the meantime, the owner needs to get together with zoning staff, tell them what she
wants to do, and get her application in process. If the situafion is like it is today, Mr. Strathman
will support the condemnation.
