WHEREAS, the Commission's Zoning Committee conducted a public hearing on May
2, 20�2, after having provided notice to affected properry owners and where a11 interested parties
were given and opportuniry to be heard on the matter and, at the close of the hearing, the
Committee recommended that the Commission grant the said application on the condition that
the variance will remain in place so long as the property is used for its cunent use; and
2 WHEREAS, Mike Lawrance, on behalf of SOS Office Futniture, in Zoning�'ile 02-107-
3 935, made application to the Saint Pau1 Planning Commission, (hereinafter "the Commission")
4 for a sign variance pursuant to the provisions of Legislative Code § 66.409, for property located
5 at 2441 Universiry Avenue West and legally described as contained in the said zoning file; and

WHEREAS, the Commission, on May 10, 2002 upheld the Zoni mmittee's
recommendation in its Resolution No. 02-40 based upon the following ndings and conclusions:
1. The applicant, SOS Office Furniture owns and operates an o�ce furniture store at the
property. The business has been at the location for decades. The total square footage of
current business signs is 358 square feet. The applicant is proposing to remove a large
projecting sign and a small wall sign, while adding a new projecting sign and two wall
signs. The total square footage of proposed signs would be 199 square feet. The code
permits 100 square feet of sign area for this properiy. The appiicant is seeking a variance
of 99 square feet.
2. Section 66.409 of the Zoning Code provides conditions under which the Planning
Commission can grant variances from the strict application of the sign chapter. The
conditions and the applicanYs ability to meet them are as follows:

sign needs for a specific building or lot.
This condition is partially met. The property has some unusual conditions
pertaining to sign needs. The 1ot is fairly deep with only 50 feet of street frontage.
The property is located on University Avenue, a major thoroughfaze with fast
traffic. The existing signs aze of a total of 358 square feet, nearly twice as much
as the proposed sign azea.

WHEREAS, pursuant to the provisions of Legislative Code § 64.206, the 5aint Anthony
Pazk Community Council on May 30, 2002, duly filed with the City Clerk an appeal from the
determination made by the Commission and requested a hearing before the Saint Paut Ciry
Council for the purpose of considering the actions taken by the said Commission; and
WHEREAS, acring parsuant to Legislative Code § 64.206 through § 64.208, and upon
noUce to affected parties, a public hearing was duly conducted by the City Council on June 26,
2002, where all interested parties were given and opportunity to be heard; and
WHEREAS, the Council, having heazd the tesfimony and having considered the
application, the report of staff, the record, the minutes, the recommendation of the Zoning
Committee and the resolution of the Commission does hereby;
The signs would not create a hazard.
This condition can be met. 'The applicant stated that the signs would be well
constructed and maintained. The existing sign is deteriorating, and could create a
safety hazard if not removed or fixed soon.
The signs would not violate Minnesota Statutes or rules and regulations developed
pursuant thereto.
This condition is met.
The signs would not be objectionable to adjacent property owners.
This condition appeazs to be met. Staff are unaware of any objections to this
request from adjacent properly owners.
The signs would not adversely affect residential property through excessive glaze
and lighting.
This condition is met. There is no residential property in the immediate area. The
signs will not be lit at night.
The signs are in keeping with the general chazacter of the surrounding area.
This condition is met. The section of University Avenue near Raymond is
commercial and light industrial in nature; and

ST. ANTHONY PARK COMMiINITY COiJNCIL has appealed the decision of the Saint Paul Plamiiug
Commission approving a sign azea variance to allow 199 square feet of business signage (100 square feet
permitted) at 2441 University Avenue W.
The Zoning Committee of the Saint Paul Pl annino Commission held a public hearing on the variance
request on May 2, 2002. The applicant, SOS Office Furniture, addressed the committee. At the close of
the public hearing, the committee voted 4-0 to recommend approval of the sign variance with the condition
that the variance will only remain in place so long as the properry is used for its current use. The Planniug
Commission upheld the Zoning Committee's recommendation for approval with the same condition
attached on a unaniuious vote on May 10, 2002.
This appeal is scheduled to be heard by the City Council on June 26, 2002. Please notify me (266-6659) if

We beIieve the Pianning Commission made the following errors of finding:
l. In finding thaT the signs would not be contrary to the general intent of the sign code,
the Planning Commission stated that The intent of tre si� ordznance is to encourage
concern for the visuai environment and to identify and promote business and industry in
the city. The Pianning Commission did not consider in its findings that the sign code is
also intended to protect unique bistorical and architectural resources {Section 66.101{5)).
The Raymond and University area is recognized as a unique historical and arckitectural
resource and for that reason is being considered by the city for designation as a fierifage
preseroation district. The Planning Commission erred in not considering whether the
signs would be contrary to the intent of the code to protect this historical and architectural
area.
2. In finding that the signs would not be conhary to the general intent of the sign code,
the Planning Commission also did not consider that the sign code is intended to reduce
the ntunber of nonconforming signs in the city (Section 66.101(8)). The Pianning
Commission merely stated that the proposed signs are consistent with other business
signs along University Avenue. Other properties along University Avenue do not have
business signage exceeding the sign code requirements by neazly 200%. The Planning
Commission erred in not considering whether the amount of signage requested for this
property was consistent with the amount of signage on other pzoperties in the area.
3. In finding that the signs are in keeping with the.general character of the sunounding
area, the Planning Commission stated that the section of University Avenue near
Raymond is commercial and light industrial in nature. The Raymond and University area
is zoned B3 General Business District, and no industrial uses are permitted. It is instead
a stable busine�s community k•�th a growing number of artists and art organizarior.s. The
Planning Commission ened in.mischaracterizing the area as industrial and failing to
consider the character of the azea as a developing arts community with sigaifcant
historical and architectural resources.

Dear Mr. Dubruiel,
On April 11, 2002, the St. Anthony Park Community Council unanimously approved a motion regazding the
proposed variance at 2441 University Avenue as follows:
• Approve the new projecfing si�.
• Allow the existing wall sign on the east side of the building to remain, but not be expanded to
include the logo. (The exisfing sign could be repainted to include a logo without increasing the
nonconfomuty.)
• Not allow the wall sign on the west side of the building. (This has not been needed in the past,
may be too high to be effective, may exceed the height pernutted under the sign code, and would
generally znake the Avenue look tackier.)
• Approve a variance to allow 114-sq. ft. of signage on the building, the total azea of the new
projecting sign and eacisring sign on the east side of the building, exceeding the 100-sq. ft. limit
imposed by the current sign code.
• Place a condition on the variance that the existing wall sign and any new wall sign not be
itluminated. (This condition is not to be ptaced on the projeciing sign. The letter submitted with
the applicarion ittdicates that the current plan is for the signs to all be non-illuminatedJ
• Place a condition on the variance that the variance will only remain in place so long as the
properry is used for its current use. The variance should be reconsidered if the use ever changes.
The sign code (66.409) allows variances for unique signs or for unusual conditions pertaining to sign needs
for a specific building or lot. This particular building or lot does not have such an unusual condirion as to
warrant a 100% variance.

Yang Zhang presented the staffi report. Ms. Zhang stated District 12 recommends partial
approval with conditions and the zoning staff recommends approval of the sign variance.
Mr. Mike Lawrence, representing the app{icant, stated they were unaware of the District
Councii's recommendation of partial approval. He stated the sign on the westerly wall would
inform passing-by traffic well in advance where SOS Office Furniture is located, and would
pemtit people to make lane changes. The projecting sign currently positioned on the building
is deteriorating and is a hazard to the pedestrians below. 1t is a fair compromise in reducing
the amount of signs on the building and is conducive with the surrounding area.
No one spoke in suppo�t.
Mr. Robert Straughn, representative of St. Anthony Park District 12 Gommunity Council,
appeared and stated the community council objected to the wall sign on the upper part of the
building facing west because it would not be a benefit to the appearance of the community to
have a wall sign so high in that location. They feel that the present sign coufd be repaired and
repainted without expanding the nonconformity. The Community Council feels that a 20
percent increase above the allowable signage wouid be acceptabie, but a 100% increase is
not warranted. There is a lot of sign clutter on University Avenue, which is a detriment to the
area. The code should be enforced as to reduce the variances for signage and to keep
signage away which makes the community work better. Raymond and University is being
considered by the Heritage Preservation Commission for special designation because of the
number of historic and architecturally significant buifdings located there. One of the purposes
of the sign code is to protect this type of areas. The conditions the St. Anthony Park
Community Council requested are 1) The existing signage on the east side of the buiiding and
the wall sign on the west side if approved not be illuminated. 2) The variance applies for only
as long as the buiiding is used for its existing use.
Mr. Mike Lawrence stated that aVthough the proposed sign is a 100 percent increase over the
� allowable amount, the current sign is 200 percent over the allowable amount. The current sign
cannot be amortized away and the current sign has not fallen from the building completely.
The current sign cou4d be rehabilitated and maintained but they are proposing to remove it
voluntarily and replacing it with something that is onfy 100 percent greater than what the code
permits instead of 200 percent greater. The designation of a historic preservation area is only
potential and not a guarantee. Even when it is designated as such, with the existing
businesses there, amortizaYion of that sign canrtot occur.
The hearing was closed.
Commissioner Faricy moved approval of the sign variance with the condition that the variance
will only remain in place as long as the properEy is used for its current use. Commissioner
Kramer seconded the motion.
The motion passed by a vote of 4-0

H. FINDINGS:
The applicant, SOS office Fumiture, owns and operafes an office fumiture store at
the property. The business has been at the location for decades. The totai square
footage of current business signs is 358 square feet. The applicant is proposing to
remove a large projecting sign and a smal( wali sign, while adding a new projecting
sign and two wail signs. The total square footage of proposed signs would be 199
square feet. The code permits 100 square feet of sign area for this property, The
appiicant is seeking a variance of 99 square feef.
2. Section 66.409 of the Zon+ng Code provides cortditions under which the Planning
Commission can grant variances from the strict application of the sign chapter. The
conditions and the appiicanYs ability to meet them are as follows:

Signcrafters is requesting a variance in ihe sign ordinance on behalf of SOS Office Fumiture at 2441
University Avenue. The cuzrent ordinance allows for 100 squaze feet of sigiage and we aze requesting 197.
Glurently the site has 230 square feet of signage. According to the variance filling information the
Planning Commission must make six fmdings to gant the variance. Below please fmd our answers to
those six quesrions.
1. The signs would nat be contrazy to the sign code.
Al] of the proposed signs would meet the definitions of allowed or approved signage for the location.
2. The signs would not create a hazard.
All of the proposed signs would be securely fastened to the building and would meet or exceed all
applicable building codes. None of the proposed signs would create a visual haZazd to street haffic. The
current projecrion sign is deteriorating rapidly, and has had safery issues recently. It is for flus reason that
the owner wants the sign removed and replaced with a smaller more secure sign.
• 3. The signs would not violate Minnesota Statutes oz xules and regulations developed pwsuant hereto.
Ali of the signs pxoposed would meet all applicable state statutes and rules.

We are not awaze of any objecrions by adjacent property owners or any local proper[y owners. The
proposed signage package urilizes some of the existing signs and incorporates new smallez signs that
should meet with everyone's approval.
5. The sign would not adversely affect residential property tiuough excessive glare and lighting.
The signs aze all non-illuminated and we aze aware of no residential property that is close enough to be
affected by these signs.
6. The signs would be in keeping with the general chazacier of the sunounding area.
Tke signs pxoposed include projecting and wall mounted signs, both w]xich aze prevalent in the surrounding
business district, as stated before, some of the sigas proposed akeady exist and therefore make up part of
the general chazacter of the azea.

The Saint Paul City Council will conduct a public hearing on Wednesday, 3une 26,
2002, at 5:30 p.m. in the City Council Chambers, Third Floor, City Hall-
Courthouse, 15 West Kellogg Boulevard, Saint Paul, NIN, to consider the appeal of
the St. Anthony Park Community Council to a decision of the Planning
Commission approving a sign variance, with a condition, allowing 199 square feet
of business signage (100 square feet permitted) at 2441 University Avenue West
(between Raymond Avenue and Pelham Boulevard).

The qnestions follow:
When and where was baseline measurements of noise and air quality performed in the
vicuuty of Ayd Mili Road to enable the assessment of noise and air quality measurements
during the test period?
2. Will the city's air quality tests include testing for CO2, air to�rins and ozone?
Will the Adininistration commit to restripe Lexington Parkway as a traffic ca.hning
measure if tr�c volumes drop to allowable levels?
4. Does the test have a hypothesis? For example, would the Administration consider an
increase in lraffic on easUwest streets such as St. Clair Avenue, Crraud Avenue, Stunmit
Avenue, and Selby Avenue to be a posifive or negative outcome to the test? Would the
Aduiinistration consider an increase in traffic on Ayd Mill Road a positive or negative
outcome? Would the Administration consider a decrease in pedestrian and bicycle
movements in the surrounding neighborhoods to be a posifive or negative outcome?
5. Will the Admiuistration rule out using Hamline Avenue as the principle connector
between Ayd Mill Road and Interstate 94 as a permanent condifion, and return to those
alternatives identified in the EIS, once the test has ended?
Additional quesfions (resolved converted to questions for Adminislration's 6/26 report (emailed
today at about 2:15 p.m.):
Will the Administration discontinue tke test if tra£fic counts on Hamline Ave. exceed the
Public Works DeparkmenYs projecfions of an increase of 7,000-4,000 vehicles per day?
2, Will the Administrarion discontinue the test if air pollution exceed health benclunarks at
any location in the test area?
3. Will the Adininisiration discontinue the test if noise levels eceed state statutes anywhere
in the test azea due to increased vehicular traffic?
4. Will the Aduiinistration discontinue the test if there is an increase in accident rates in the
test azea?
30. Cultural STAR add-ons. Has Dan talked to Randy about this? Our supposition was
that this was connected to 1VIF funding. In any case, getting Midway Contemporary Art
makes tlus one worthwhile for us.

We object to the approval of business signage at 2441 University Avenue West. Our
objections are based on the fact that trends in this area have been toward office and
commercial development, and the approval of a huge sign would contradict those recent
developments. In addition, a large sign would create an unfavorable image to those
considering establishing and conducting business in this area.
